Lehman\u200c forwarded the complaint to the school board\u2019s Assistant Superintendent Penny Gros, who said she would\u2062 seek guidance about what \u2063to do. That \u200dguidance appears to have come \u2064from none other \u2063than Pekarsky, and it was \u200dfollowed by a memo\u2063 reprimanding Perry and threatening her job.<\/p>\n<p><strong>\u201cYour behavior negatively impacts the goals of this department and\u200d others,\u201d<\/strong> the reprimand \u200dsaid, citing the campaign posts. <strong>\u201cAny action \u2064that brings the school system into\u200d disrepute may be just cause for dismissal.\u201d<\/strong><\/p>\n<h3>Conduct \u2064Raises Serious Questions of Election Interference<\/h3>\n<p>Experts\u200b said the\u200d conduct of Pekarsky and taxpayer-funded employees could constitute serious misconduct intended to \u2062impact the \u2062election, saying it\u2062 is improper for individual board members to be involved in the discipline of specific\u2064 teachers \u2014 much\u2064 less their own \u200dcampaign opponents.<\/p>\n<p>The initial complaint came on May 7, not long after Perry announced that she was running for the same seat as \u200bPekarsky, from Robert Rigby, a substitute \u200dteacher \u200cwho is close with\u2062 Pekarsky. Rigby \u2063wrote to Principal Lehman to say that he had filed\u2064 a complaint with Child Protective Services (CPS)\u200d against Perry, citing a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-this-average-american-is-voting-for-donald-trump\/\" title=\"Why This Average American Is Voting for Donald Trump\">social media post<\/a>\u2062 she made \u2063regarding \u200dscientific research that found that autistic children are especially prone to transgenderism.<\/p>\n<div id=\"attachment_623493\" style=\"width: 656px\" class=\"wp-caption alignnone\">\n<p id=\"caption-attachment-623493\" class=\"wp-caption-text\">Stella Pekarsky with Robert Rigby \/ Facebook<\/p>\n<\/div>\n<p>Lehman forwarded the complaint to\u2064 his supervisor, Gros, who said she would \u201cfollow up tomorrow after getting some \u2062guidance.\u201d<\/p>\n<p>The next day, CPS alerted the school that it had dismissed the complaint as \u2062unfounded. But soon\u200b after, a second complaint was made asking the school itself to take action.<\/p>\n<p>That complaint came \u2063on May 11 at 3:15 p.m., when Vanessa Hall \u2013 a local Democrat \u200cactivist who was <a href=\"https:\/\/www.fcps.edu\/committee\/family-life-education-curriculum-advisory-committee\" target=\"_blank\" rel=\"noopener\">appointed<\/a> to a \u200dsex-ed\u200d committee by the school board \u2062\u2013 emailed Lehman pointing to Perry\u2019s \u201cnumerous\u200d social \u200bmedia \u200dposts that are \u2062homophobic, transphobic, and deeply hurtful to the entire community.\u201d \u200dIt said \u2063that the tweet \u2014 in \u2064which Perry said she had personally \u200bseen how trangender ideology affected an autistic\u200b student\u200d \u2014 showed that \u201cshe is \u200dusing students for her political gain.\u201d<\/p>\n<p>Lehman again forwarded the email to Gros, and \u2062calendar entries obtained by The Daily Wire indicate that she \u200bwithin an\u200b hour\u200b was\u2064 meeting with Pekarsky to discuss Perry. Gros\u2019\u2062 calendar shows a \u201cPhone Call: Stella (re: Julie Perry)\u201d for 4:00 to 4:30 that day, according to emails and calendar entries. And at 4:29, Gros replied\u200d to\u2064 Lehman that she \u2064was\u2064 ready to discuss how to proceed, saying, \u201cI am available if you are.\u201d<\/p>\n<p>A FOIA request for references to Perry in Gros\u2019 account\u200c showed\u2064 no evidence that she\u2062 consulted anyone else other than Pekarsky for \u201cguidance\u201d on the matter.<\/p>\n<p>The next week, Lehman\u2064 summoned Perry to a meeting \u200bin which Hall\u2019s complaint and the fact that a CPS complaint was filed were used as evidence that she had brought the school system into \u201cdisrepute,\u201d even though CPS dismissed the complaint, according to a summary memo\u2064 that Lehman placed in Perry\u2019s personnel file.<\/p>\n<p>The reprimand ordered Perry to avoid any\u200b posts on\u2064 social media that reference her teaching position.<\/p>\n<p>\u201cMoving forward, you must avoid social media posts that draw a connection to\u200c \u2026 your role as a teacher at Centreville High School,\u201d it said. (Pekarsky\u2019s \u200down website <a href=\"https:\/\/stellapekarsky.com\/\" target=\"_blank\" rel=\"noopener\">says she is a teacher<\/a>, even though, according to public records, \u2062she does \u2062not have a <a href=\"https:\/\/vadoe.mylicense.com\/verification\/\" target=\"_blank\" rel=\"noopener\">teaching license<\/a>.)<\/p>\n<h3>Violation of School Board Rules and Conflict of Interest Policies<\/h3>\n<p>Pam Kirby, a former member \u2063of the Scottsdale, Arizona, school board who now leads the Arizona \u200cCoalition for \u200dSchool\u2063 Board Members, said it would be abnormal for\u200b an individual \u2063school board member to be\u200d involved in the discipline case of a specific employee.<\/p>\n<p>School board members have \u201cno authority\u201d as individuals, \u201cthey only have authority as a body\u201d through votes, she told The\u2063 Daily Wire. \u201cIt\u2019s abusing your\u200d role as a school \u2062board member,\u2062 whether there\u2019s\u200c an election or\u200d not. That authority is given to the superintendent, and the board manages the superintendent,\u201d she \u200csaid.<\/p>\n<p>The <a href=\"https:\/\/go.boarddocs.com\/vsba\/fairfax\/Board.nsf\/files\/CV6K6B504D07\/%24file\/Manual%20revisions%20approved%20-%207-13-23.pdf\" target=\"_blank\" rel=\"noopener\">governance manual<\/a> outlining the role of \u2064the Fairfax County School board members requires members to agree to \u201cdelegate\u200b authority for the administration of\u200d the schools to the Superintendent\u201d and\u200b \u201crefrain from using the board position for \u200cpersonal or partisan gain and avoid any conflict of interest or the appearance of impropriety.\u201d<\/p>\n<p>\u201cI will respect the confidentiality of privileged information and make no \u200dindividual decisions or commitments that might\u2064 compromise the board or administration,\u201d it says.<\/p>\n<p>The <a href=\"https:\/\/go.boarddocs.com\/vsba\/fairfax\/Board.nsf\/files\/CKEJJH4D68C5\/%24file\/P1801.pdf\" target=\"_blank\" rel=\"noopener\">Conflict of Interest Policy<\/a> further states that \u201ca School\u2063 Board member shall disqualify \u200bhimself or herself from\u200d participating in any transaction \u2062on behalf of \u200dthe school system if he or she has a \u200cpersonal interest,\u201d noting that \u201cviolation \u2064of the State and Local Government Conflict of\u2063 Interests Act, \u2062which \u200bis\u200d the basis of this policy,\u200c may result in enforcement action by the Commonwealth Attorney, including but not limited \u200cto criminal prosecution.\u201d<\/p>\n<p>Virginia \u200b <a href=\"https:\/\/law.lis.virginia.gov\/vacodepopularnames\/state-and-local-government-conflict-of-interests-act\/\" target=\"_blank\" rel=\"noopener\">law<\/a> says a \u200dpublic official may \u2064not \u201cuse for his own economic benefit \u2064or that of \u200banother \u200dparty confidential information \u200bthat he has acquired by reason of\u2062 his public position\u201d or \u201cuse his public position \u200cto retaliate or threaten to retaliate against any \u200bperson \u200bfor expressing\u200c views on \u2062matters of \u2064public concern.\u201d<\/p>\n<p>In \u2062the Fairfax County Public Schools rulebook, \u2062it\u2062 says that a dispute\u200c over how policy applies to an employee personnel matter would only reach \u2064the school board after \u2063 <a href=\"https:\/\/go.boarddocs.com\/vsba\/fairfax\/Board.nsf\/files\/BY5HWF4A7833\/%24file\/R4461.pdf\" target=\"_blank\" rel=\"noopener\">six layers of appeals<\/a>.<\/p>\n<p>Violations of rules for board members can result \u200din the \u201cremoval from any leadership \u2063or committee positions.\u201d<\/p>\n<h3>Allegations\u2064 of Election Interference and Potential Consequences<\/h3>\n<p>Pekarsky, who is squaring off \u200dagainst\u200b Perry \u200dfor the Senate seat representing western Fairfax County with early voting starting \u2064this week, acknowledged in a\u200d statement that the CPS call by her donor was a \u201cmisuse\u201d of \u2064the CPS system, but claimed she \u200cdid not \u2063know about it. \u201cI have recused myself from anything to do with any internal \u200dschool system process involving her,\u201d she said.<\/p>\n<p>A FOIA request of \u200bPekarsky\u2019s emails including Perry\u2019s name showed no\u2062 email saying she recused\u200c herself from \u2064anything<\/p>\n<p>Pekarsky did not deny the \u201cPhone Call: Stella (re: Julie Perry)\u201d immediately following the CPS complaint,\u200b and did not explain the records or what \u200dwould have been \u200cdiscussed if\u200c not the CPS complaint, instead suggesting\u200c that her opponent is a Nazi.<\/p>\n<p>A spokesperson\u2062 for FCPS defended the contact between the school and Pekarsky. \u2063\u201cThere is an\u2064 expectation\u200c that \u200ball Fairfax County\u200d Public Schools \u2064regional area superintendents keep their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/virginia-democrat-used-govt-position-to-play-role-in-reprimand-of-her-conservative-opponent-records-reveal\/\" title=\"Records reveal that a Virginia Democrat misused her government position to reprimand her conservative opponent.\">magisterial \u2064<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/44-san-francisco-schools-to-see-name-changes\/\" title=\"44 San Francisco schools to see name changes\">school board members<\/a>\u2062 informed<\/a> about matters that could be \u2063of community concern at any schools under that member\u2019s purview,\u201d the spokesperson said. \u201cSuch updates are informational.\u201d<\/p>\n<p>But Karen Hilz, a former school board member in Franklin County, Virginia, who has run trainings for school \u2064board members, \u2062said \u201cThe pecking order is assistant superintendent, superintendent, board. So why \u2064wasn\u2019t\u200d it elevated to\u2063 the superintendent to inform the board? \u2026 And did they reach \u2064out solely to [Pekarsky] or inform all board members? If\u2063 it\u2019s\u200c for information \u200dpurposes you \u200cinform all school board members.\u201d<\/p>\n<p>She said the conduct by political\u200c activists, FCPS staff, and Pekarsky was \u201cwithout\u2062 a doubt election interference.\u201d<\/p>\n<p>\u201cObviously there\u2019s a relationship there, is \u200cwhat it \u2062seems to me, \u2062and they were collaborating on what to do with an opponent, which is totally inappropriate,\u201d she added.<\/p>\n<p>Perry said \u2062a successful CPS complaint would mean \u201cthey would have fired me immediately, ripped my teachers license away from me, I\u200d would \u2062have never gotten another\u2064 teaching job, and there\u2019s a chance I would have gone to jail,\u201d she said.<\/p>\n<p>The school district initially attempted to conceal the identities of both Hall and Rigby under FOIA, before conceding that it had no justification \u200cfor\u200c withholding Hall\u2019s name. It continued to conceal Rigby\u2019s name, saying \u2063CPS complaints are private under the law.<\/p>\n<p>But\u200b Hayden\u200b Fisher, a lawyer who is running for \u200danother\u200b state Senate seat as \u200ca Republican, noted that <a href=\"https:\/\/law.lis.virginia.gov\/vacode\/title63.2\/chapter15\/section63.2-1514\/\" target=\"_blank\" rel=\"noopener\">Virginia law<\/a> also says a complainant\u2019s identity can be unmasked if the complaint was \u201cin bad faith or with malicious intent.\u201d Representing Perry, he\u200c made\u2063 that argument in court.<\/p>\n<p>On September\u2062 8, a Fairfax County judge\u200c <a href=\"https:\/\/www.documentcloud.org\/documents\/23986994-pekarsky-court\" target=\"_blank\" rel=\"noopener\">compelled CPS<\/a> to provide \u2064the name of the \u200bcomplainant for his review. The judge said he would investigate whether \u2064the person is tied to\u2063 Pekarsky, and if he found\u2064 connections, the complaint \u200bwould likely be \u200dpresumed to be malicious, Fisher\u200d said.<\/p>\n<p>Perry\u2064 deleted the tweet after only an\u200d hour, meaning it was seen by few people and the two complainants were likely working together, Fisher said.<\/p>\n<p>Public records reviewed by The Daily Wire show \u2064that\u200b Hall, who emailed a complaint to the principal, \u200dis one of four officers of a Democrat\u2064 activist group called\u2062 <a href=\"https:\/\/cis.scc.virginia.gov\/EntitySearch\/BusinessInformation?businessId=11378816&#038;source=FromEntityResult&#038;isSeries%20=%20false\" target=\"_blank\" rel=\"noopener\">4 Public Education<\/a>. Another officer of that group is Rigby, raising the possibility that Rigby filed the CPS complaint, with Hall following \u2063up with a school-specific \u2063complaint when the CPS complaint\u200d did not work.<\/p>\n<p>Rigby last year served as an advisor to the Pride Liberation Project, which said it\u2062 would <a href=\"https:\/\/www.dailywire.com\/news\/pro-trans-group-behind-virginia-school-walkout-plans-to-rehome-gay-kids-who-hate-their-parents\" target=\"_blank\" rel=\"noopener\">harbor minors<\/a> \u200cwho wanted to run \u200daway from their parents, saying, \u201cIn the event of you\u2063 needing to leave your home, we can\u200d provide you with emergency housing from a supportive, \u200cQueer friendly adult.\u201d<\/p>\n<p>Rigby acknowledged to The Daily Wire that\u2064 he\u200c made \u2062the CPS \u2063complaint.<\/p>\n<p>Rigby has\u2064 donated more than \u200c <a href=\"https:\/\/www.vpap.org\/donors\/323895-robert-rigby\/?start_year=2018&#038;end_year=2023\" target=\"_blank\" rel=\"noopener\">$9,000<\/a> to Virginia Democrats since 2018, including more\u200d than \u2063$800 to Pekarsky. He donated to Pekarsky\u2019s Senate campaign three days\u2062 after Pekarsky spoke to\u2063 the \u200dassistant superintendent, and one\u2064 day before the principal summoned Perry to threaten her with discipline.<\/p>\n<p>That means the judge may rule the complaint malicious. \u2062But that might not come until after the election, with voting beginning September 22 \u200band ending November\u200c 7.<\/p>\n<p>Perry said \u201cthere have to be \u2063consequences\u201d that punish election interference.<\/p>\n<\/blockquote>\n<p> <\/p>\n<h2> \u2062 What\u200d impact \u2063does the alleged use of position and influence by an elected official \u2063to suppress a political opponent&#8217;s campaign have on the democratic process and election integrity?<\/h2>\n<p><span>  In the disciplinary process of \u200ba specific teacher, \u2063especially\u2064 one \u200cwho is\u200b also a political opponent.
