Federal Election Commission <a href=\"https:\/\/www.fec.gov\/data\/receipts\/?committee_id=C00728097&#038;two_year_transaction_period=2024&#038;data_type=processed\" target=\"_blank\" rel=\"noopener\">records<\/a> show that he has raised zero dollars and gave his own \u200cpresidential \u200ccampaign $20 million.<\/p>\n<\/div>\n<p>\u201cPetitioner Castro is an FEC-registered Republican presidential\u2064 candidate actively pursuing the nomination of the Republican Party to pursue the Office of the Presidency of \u2063the United States,&#8221; he claimed, adding\u2063 that &#8220;Trump is causing a political competitive injury upon\u2064 Petitioner Castro \u200din the form of diminution of potential votes, political support, and political campaign contributions.&#8221;<\/p>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/div>\n<p>According to an\u2064 interview he gave to Newsweek, \u200che&#8217;s filed lawsuits against the\u200b former president in more than\u2063 a dozen \u200bstates. \u2062So far, President Trump has not responded to Mr. Castro&#8217;s claims\u200c in court.<\/p>\n<p>Mr. Castro&#8217;s effort is one of several attempts to keep \u2062President Trump \u200coff\u2062 the ballots in several states based on\u2063 a novel interpretation of \u2064the 14th Amendment.<\/p>\n<div class=\"my-5\">\n<blockquote>\n<p>In\u200d August, the left-wing group Free Speech for People \u200bwrote to the secretaries of state of Florida, New Hampshire, New Mexico, Ohio, and Wisconsin, calling on them\u200c to not include President Trump\u200c on state\u200b ballots. (Madalina Vasiliu\/The Epoch \u200dTimes)<\/figcaption><\/figure>\n<\/div>\n<p>Under Section 3 of the 14th\u2063 Amendment, a clause stipulates that a \u200dcandidate \u200bcan \u200cbe disqualified \u2063if a person &#8220;engaged in insurrection or rebellion against&#8221; the United States or had &#8220;given aid or comfort to the\u2062 enemies thereof.&#8221; \u200dWhile \u200cthe\u2062 federal government has\u200c charged the former\u200d president in relation to his\u200c activity after\u200d the 2020 election, he has not\u2064 been\u200b charged\u2064 with engaging in an insurrection against the U.S. government or similar crimes.<\/p>\n<p>A number of legal\u200c experts and even some Democratic officials have disputed the legitimacy of the 14th Amendment-based attempts to block the former\u200d president from running.<\/p>\n<div class=\"my-5\">\n<blockquote>\n<p>Retired Harvard Law Professor \u200cAlan Dershowitz has long argued \u200dthat arguments to block the former president \u200con 14th Amendment grounds are problematic, noting\u200c that the\u2062 amendment was\u200c ratified after the Civil War. Some critics of the move took umbrage with claims that secretaries of state, who are voted into office, can unilaterally disqualify a candidate under such pretenses.<\/p>\n<\/blockquote>\n<\/div>\n<p>He added: \u201cIn the absence of any such designation, it would be possible for individual\u2062 states to disqualify a candidate,\u200c while\u2064 others qualify him. \u200dIt would also be possible for the incumbent president to seek \u200dto disqualify his rival, or for a partisan congress to do so. There is no explicit provision for the courts to intervene in what they might \u2062regard as a political question.\u201d<\/p>\n<p>New Hampshire\u2064 Secretary of State David Scanlan, a Republican,\u2062 said this month that he cannot\u2062 disqualify the former president under the 14th Amendment.<\/p>\n<p>&#8220;There\u200d is \u200dnothing in our state statute that gives the secretary of \u200bstate discretion in entertaining \u2063qualification issues,&#8221; he said at \u200da recent\u200b news \u2064conference. &#8220;If \u200ba\u2062 candidate for president preferably submits their paperwork during the filing period \u200band pays\u200d the required\u200b fee, \u200btheir name will appear on\u200d the ballot.&#8221;<\/p>\n<p>Michigan&#8217;s Secretary of State Jocelyn Benson, a Democrat who had railed against the former president&#8217;s 2020 claims of voter fraud in her state, also argued in a recent opinion\u200d article \u2064that only a court can decide.<\/p>\n<p>&#8220;Michigan, unless a\u2062 court rules otherwise, Donald Trump will be on the ballot for \u200cour Republican presidential primary \u200don Feb. 27, 2024,&#8221; Mrs. Benson wrote. \u200b&#8221;Whether Trump is eligible to run \u2064for president \u200cagain \u200bis a decision \u200cnot for secretaries\u200c of state\u2064 but for\u200d the\u2062 courts.&#8221;<\/p>\n<p>Gabriel Sterling, a Georgia elections official who opposed President Trump, told ABC News that courts will likely throw out such\u2062 cases because \u2063the former president hasn&#8217;t been convicted.<\/p>\n<p>&#8220;If somebody&#8217;s adjudicated\u2014if they&#8217;re convicted, somewhere of insurrection\u2014that&#8217;s one thing.\u200c That&#8217;s not the case here and even in these other cases that are running right now. Our big concern \u200cis if \u200byou\u200d have a hung jury or is acquitted on anything, \u200bhe will\u200c take his full exoneration,&#8221; Mr. Sterling said.<\/p>\n<p> <\/p>\n<h2> What is the central \u200bissue in\u2064 the case of\u200d Mr. Castro&#8217;s appeal to the Supreme Court regarding President Trump&#8217;s disqualification from holding \u200cfuture public office?<\/h2>\n<p><span>  Nstitution\u2062 is hereby affirmed,\u201d Judge Cannon stated in her ruling.
