All have pleaded not \u2064guilty.<\/p>\n<p>Last week, Mrs. Powell\u2014who generated headlines in 2020 for her &#8220;Kraken&#8221; election lawsuit predictions\u2014stated in her motion to dismiss the case that Georgia&#8217;s statute is vague\u2063 in its present\u2063 application by the Fulton \u2062County District Attorney&#8217;s office.<\/p>\n<p>\u201cIf the Georgia RICO\u200b statute reaches the conduct alleged here, then it \u2064is unconstitutionally vague. Already, its application \u200dhas\u2064 necessarily \u2064been decided on a case-by-case basis,&#8221; \u200cher lawyers \u200bstated. &#8220;It has enabled the District Attorney\u2019s\u2062 office to make life-altering\u2063 choices\u2063 of those to indict\u2014when thousands of people fall within the prosecutors\u2019 definition of RICO here &#8230; the State has\u200d even indicted First Amendment protected speech and \u2063conduct.\u201d<\/p>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/div>\n<\/div>\n<p>Meanwhile,\u200c she argued that the state&#8217;s RICO statute, referring to the Racketeer Influenced and \u2063Corrupt Organizations Act law, cannot survive a constitutional test if a court &#8220;reads\u200c into it an element of criminal financial gain for the individual and enterprise, and the economic or physical threat or injury.\u201d Failing that, it \u2062would allow for the &#8220;punishment of \u2063speech and political conduct long and\u200d fully protected \u2063under \u2063the First Amendment,&#8221; \u2062the \u2063court papers added.<\/p>\n<p>Mrs. Powell and election lawyer Kenneth Chesebro, another co-defendant, have requested expedited proceedings and are slated\u2062 to\u2063 go to trial on\u200c Oct. \u206323. Both attempted to sever their\u200b cases from one another, while both their cases\u200d were severed from the 17 other co-defendants&#8217; cases, including President Trump&#8217;s.<\/p>\n<p>Last week,\u2063 Fulton County Judge Scott McAfee shut down a plan from Ms. Willis&#8217; office to try all \u2062the co-defendants at the same time. Under Mrs. Willis&#8217; timeline, their trial would \u2062start next month, but\u2064 the judge said it&#8217;s not feasible.<\/p>\n<p>&#8220;Beginning\u200b with the logistical concerns, the\u2064 Fulton County Courthouse simply contains no <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-wont-stand-trial-in-october-over-alleged-2020-georgia-election-interference-judge-rules\/\" title=\"Judge rules Trump won't face trial in October for alleged 2020 Georgia election interference.\">courtroom adequately large<\/a> enough to hold all 19 defendants, their multiple attorneys and support staff, the sheriff&#8217;s deputies, court personnel, and \u2064the State&#8217;s\u200d prosecutorial team,&#8221;\u200c he wrote in his ruling. &#8220;Relocating to another <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-adopts-sidney-powells-effort-to-dismiss-georgia-charge\/\" title=\"Trump supports Sidney Powell's attempt to dismiss Georgia charges.\">larger \u200bvenue raises security concerns<\/a>\u200c that cannot be rapidly addressed.&#8221;<\/p>\n<p>The predicted length of \u2062the trial would also be a significant issue, the judge wrote. Prosecutors said that it could \u200dtake as long as four\u2064 months, but in a\u200d prior hearing, Judge McAfee said it may be double that.<\/p>\n<p>&#8220;We must consider the ripple effects of a monthslong, multi-defendant trial on the local criminal justice\u2063 system, sidelining dozens of \u200bdefense counsel from handling \u2064other cases and preventing this Court\u2014and quite likely most colleagues\u2014from managing the rest of the docket,&#8221; the judge said.<\/p>\n<p>Judge McAfee also noted that five co-defendants are currently seeking to move\u200c their cases to federal court and litigation \u200bon the issue\u200c is ongoing. Should they succeed in \u200bmoving their trials, it&#8217;s not clear what the\u2062 impact \u2064would \u2063be, \u200che wrote.<\/p>\n<p>The former president\u200c also faces state charges\u2064 in New York City after Manhattan District Attorney\u2062 Alvin Bragg indicted him \u2064for allegedly \u200bfalsifying \u200bbusiness \u2062records in connection to the\u200d 2016 election. Federal prosecutors earlier this summer charged President Trump over his alleged mishandling of classified documents after he left the White House and for his actions following the 2020 election.<\/p>\n<p>In a court filing late last week,\u2064 special\u2062 counsel\u200c Jack Smith&#8217;s team filed court papers to place a \u200bgag order on the\u2064 former president to prevent him from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fact-check-did-joe-biden-say-mark-my-words-peace-and-democracy-will-be-made-in-uganda\/\" title=\"FACT CHECK: Did Joe Biden Say, \u2018Mark My Words: Peace And Democracy Will Be Made In Uganda\u2019?\">making public statements<\/a> about the 2020 election case. Over the weekend, President Trump said that the\u2064 move is an attempt by Mr. Smith to &#8220;take out&#8221; a leading\u2064 political opposition\u2062 candidate.<\/p>\n<p> <\/p>\n<h2> Why does Sidney Powell \u2062argue that Georgia&#8217;s RICO \u2064statute is vague \u2063and unconstitutional in its application<\/h2>\n<p><span>  Trump&#8217;s lawyers have made a court filing in the racketeering\u2064 case against the former President, echoing an argument previously made by Sidney Powell, one of his 2020 election lawyers. The motion seeks to dismiss the racketeering count that Trump faces in Georgia.<\/p>\n<p>In the court motion, Trump&#8217;s lawyer,\u200c Steven Sadow, referenced Powell&#8217;s arguments \u2064that were\u2062 made in court papers last week. The motion states that &#8220;President Trump hereby adopts the general demurrer timely filed by co-defendant Powell as to count one.&#8221; It further explains \u200bthat Trump adopts Powell&#8217;s argument in Part\u2063 III, which argues for \u2063the dismissal of count one due to a violation\u200d of constitutional \u200cprinciples of due process and fair \u200bwarning.
