The groundbreaking <a href=\"https:\/\/icjia.illinois.gov\/researchhub\/articles\/the-2021-safe-t-act-icjia-roles-and-responsibilities\">SAFE-T Act<\/a> \u200bwent\u2062 into effect on Monday, September 18<sup>th<\/sup>. <\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>The state of\u2063 Illinois has made \u2063the bold decision to end cash bail as a requirement for Pretrial Release. <\/p>\n<p>This landmark ruling comes after the Supreme \u200bCourt of Illinois deemed it constitutional\u2063 to enact a new law known \u2063as the &#8220;Illinois Pretrial Fairness Act.&#8221; This act ensures the elimination of cash bail. <\/p>\n<blockquote class=\"wp-block-quote\">\n<p><a href=\"https:\/\/www.courts.ca.gov\/pretrial.htm\">Pretrial Release<\/a> refers to the release of individuals accused of a crime, who have been booked into custody, before their \u2063trial, with charges pending, either with \u2064or without conditions.<\/p>\n<\/blockquote>\n<p>As a result, Illinois becomes the\u2063 first state in \u2063the nation to completely\u2063 eradicate monetary cash bail. <\/p>\n<p>However, defendants charged\u200d with specific \u200cfelonies and violent misdemeanors will still be detained before their trial. The state will determine \u2064whether the defendant poses a flight risk or a \u2064danger to the community.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cToday,\u2063 Illinois\u2062 is no longer criminalizing \u200bpoverty, and the entire nation has their\u2063 eyes on \u200dus,\u201d declared Illinois House Speaker Emanuel Chris Welch during a <a href=\"https:\/\/www.nbcchicago.com\/news\/local\/how-will-cashless-bail-work-in-illinois-heres-an-explainer\/3230518\/\">press conference<\/a> on Monday.<\/p>\n<\/blockquote>\n<p>From now \u2063on, detention\u2063 decisions will not involve \u200bthe exchange of money for release. Instead, they will be based \u2062on the \u200cnature of the allegations, the potential threat to the public, \u200band the risk of fleeing prosecution.<\/p>\n<p>The Pretrial Fairness Act is part\u200b of the\u2064 SAFE-T Act, a comprehensive \u200dcriminal \u200cjustice reform \u2063law aimed\u2062 at eliminating the use of cash bail throughout the state. <\/p>\n<p>Cash bail\u2064 has \u200dlong been criticized\u200b as a system\u2062 that penalizes poverty, granting preferential \u200ctreatment to those who can afford to buy their freedom. <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThis landmark ruling refutes false narratives about cash bail.\u200d The truth is that abolishing cash\u200c bail\u2063 improves public safety by allowing people to \u2062return to their communities and families who would otherwise be in jail only because \u2063they can\u2019t pay for their freedom,\u201d \u2064stated the ACLU in a July statement. \u201cWhen\u200d people can go\u200b home,\u200b take care of their families, and keep up with school or work, that stability makes all our communities \u200csafer and stronger.\u201d<\/p>\n<\/blockquote>\n<p>However, opponents of the decision to abolish cash bail fear that it will hinder\u2063 law \u200denforcement&#8217;s ability \u2062to \u200bkeep communities safe by detaining suspected criminals. <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/illinois-becomes-first-state-to-eliminate-cash-bail\/\" title=\"Illinois abolishes cash bail, a historic first.\">money bond system wrongly tied access<\/a> \u200cto financial \u2064resources to pretrial freedom.
