Temporary funding for healthcare providers, perhaps. Or maybe even temporary restrictions on travel in the face of a \u200bseverely infectious disease. One\u2064 would certainly not\u2064 think of a \u200bsuspension of the Second Amendment. Yet, on \u200bSept. 8, New Mexico\u2019s Democratic Governor Michelle \u2063Lujan Grisham \u200dissued a public health order \u2064to do just that.<\/p>\n<p>In the face of bi-partisan pushback and a temporary restraining order, less than two weeks after the ban\u2019s enactment, Grisham announced \u200cshe would be rolling the policy back. However, parts\u200b of the ban remain in\u200d place to\u200b this\u2063 day.<\/p>\n<p>For those who haven\u2019t been following news of the <a href=\"https:\/\/www.westernjournal.com\/new-mexico-governor-floats-arrest-conceal-carry-holders-power-hungry-emergency-order\/\" target=\"_blank\" rel=\"noopener\">New Mexico<\/a> concealed carry ban too closely, here\u2019s a full recap of what has happened, and\u200d how \u2062things currently\u200c stand today.<\/p>\n<h3><strong>The Ban<\/strong><\/h3>\n<p>It all started with the \u2062tragic death\u200d of an 11-year-old boy on Sept.\u2063 6. The boy, Froylan Villegas, was caught in the middle of a \u201csuspected \u200croad rage shooting\u201d \u2064on \u2064his\u2062 way home from a minor league\u2063 baseball \u200cgame.\u200c \u201cThe vehicle just pulled up on the side of them and started shooting,\u201d family friend Angelica \u200dAmaro said according to <a href=\"https:\/\/www.krqe.com\/news\/albuquerque-metro\/family-friends-remember-11-year-old-shot-killed-while-leaving-isotopes-park\/\" target=\"_blank\" rel=\"noopener\">KRQE<\/a>.<\/p>\n<p>Citing \u200bthe incident, along with a\u200d handful of others, Gov. Grisham <a href=\"https:\/\/www.governor.state.nm.us\/2023\/09\/07\/governor-declares-gun-violence-a-public-health-emergency-after-murder-of-11-year-old-boy-on-his-way-home-from-baseball-game\/\" target=\"_blank\" rel=\"noopener\">declared a public health emergency<\/a> \u2062 the very next \u200dday. \u200cThen on Sept. 8, after another day\u200c had \u2063passed, <a href=\"https:\/\/www.governor.state.nm.us\/2023\/09\/08\/governor-announces-statewide-enforcement-plan-for-gun-violence-fentanyl-reduction-plan-includes-30-day-suspension-of-concealed-open-carry-in-albuquerque-and-bernalillo-county\/\" target=\"_blank\" rel=\"noopener\">Grisham \u2063signed an executive \u200dorder<\/a> suspending all \u201cconcealed, open carry\u201d licenses in the \u2063city of Albuquerque\u2064 and Bernalillo County.<\/p>\n<p>Grisham spokeswoman Caroline Sweeney told the <a href=\"https:\/\/apnews.com\/article\/albuquerque-guns-governor-concealed-carry-fc5b4b79bf411b8022c3ad58975724d7\" target=\"_blank\" rel=\"noopener\">Associated Press<\/a> violators of the order\u200d were subject to $5,000 fines.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">The Governor of New Mexico has just \u200ddeclared the 1st &#038; 2nd Amendment \u201cdoes not exist\u201d due\u2063 to an \u201cemergency.\u201d Under this legal theory *all* of \u2062our \u201crights\u201d are essentially eliminated. Watch the most evil &#038; tyrannical 60 seconds you\u2019ve ever heard from a politician:\u200c <a href=\"https:\/\/t.co\/xLpMSTbyi2\">pic.twitter.com\/xLpMSTbyi2<\/a><\/p>\n<p>\u2014 Benny Johnson \u200c(@bennyjohnson) <a href=\"https:\/\/twitter.com\/bennyjohnson\/status\/1700334945992847588?\">September \u20629, 2023<\/a><\/p>\n<\/blockquote>\n<p>\u201cAs I said yesterday, \u200bthe time for standard measures has passed,\u201d Gov. Grisham said. \u201cAnd when New Mexicans are afraid to be in crowds, to take\u200c their\u2064 kids to \u200bschool, to leave \u2062a\u2062 baseball game \u2014\u2064 when their very right to exist\u2062 is threatened by the prospect of violence at\u2062 every turn \u2013 something is\u2063 very wrong.\u201d<\/p>\n<p>The ban on carrying \u200b <a href=\"https:\/\/www.westernjournal.com\/study-shows-good-guys-guns-effective-stopping-active-shooter-situations\/\" target=\"_blank\" rel=\"noopener\">guns<\/a> on public property included a few minor exceptions for security\u200b guards and law enforcement \u200dofficers. Citizens\u200d were still allowed to keep their weapons on private property but, if and when\u2064 they were to \u200dbring those weapons \u2063into\u200c public, \u200bwere in violation of \u200bthe new order.<\/p>\n<p>The following directives \u200bwere also listed in the order:<\/p>\n<ul>\n<li>\u201cThe Regulation and Licensing Division to conduct monthly inspections of licensed firearm dealers to \u200densure \u200dcompliance with\u2063 all sales and storage laws.\u201d<\/li>\n<li>\u201cThe Department of Health to compile and issue a comprehensive report on gunshot victims \u200cpresenting at hospitals in New\u2062 Mexico,\u200c which shall include (if available):\u2062 demographic data of gunshot victims, including \u2064age, gender, race,\u2063 and \u200dethnicity; data on gunshot victim\u2019s healthcare\u2062 outcomes; the brand and caliber of the firearm used; the general circumstances leading to\u2062 the injury; the \u200bimpact of gunshot victims on\u2064 New Mexico\u2019s healthcare system; and any other \u200bpertinent information.\u201d<\/li>\n<li>\u201cThe State Police to \u200badd\u200d officers in \u2064Albuquerque with \u2062funding for overtime provided.\u201d<\/li>\n<\/ul>\n<h3><strong>Pushback From \u2063Both Parties<\/strong><\/h3>\n<p>From the start, local New Mexicans voiced their disapproval of the concealed carry ban. \u200cAs reported\u200d by <a href=\"https:\/\/www.kob.com\/new-mexico\/gun-owners-rally-in-old-town-to-protest-public-health-order\/\" target=\"_blank\" rel=\"noopener\">KOB-TV<\/a>, on the\u200b very same day Grisham announced \u2064the order, more than 100 gun rights supporters \u2014 some of them armed \u2014 showed up \u200cin Albuquerque\u2019s Old \u2064Town in protest.<\/p>\n<div class=\"firefly-embed\">\n<\/div>\n<p>In what came as\u2062 a shock to\u200c many conservatives, those on the\u200c political right weren\u2019t the \u200conly ones to come out in opposition to <a href=\"https:\/\/www.westernjournal.com\/will-new-mexicos-gun-ban-stop-crime-thomas-sowell-say\/\" target=\"_blank\" rel=\"noopener\">the ban<\/a>. Perhaps the two most surprising examples \u200dof this were California Rep. Ted Lieu and anti-gun activist David Hogg. Both men are well-known\u200c for their opposition\u2062 to Second Amendment rights, and yet they both\u2063 decried Grisham\u2019s order.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">I support gun\u200b safety but there is no such\u200d thing as a \u200bstate public health emergency exception to the U.S. Constitution. <a href=\"https:\/\/t.co\/6GfbOZLc7g\">https:\/\/t.co\/6GfbOZLc7g<\/a><\/p>\n<p>\u2014 David Hogg  (@davidhogg111) <a href=\"https:\/\/twitter.com\/davidhogg111\/status\/1700601787605266779?\">September 9, 2023<\/a><\/p>\n<\/blockquote>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">I support gun\u200b safety laws. However, \u2063this\u200d order \u2064from the Governor of New Mexico\u200d violates the U.S. Constitution. No state in the union can suspend the\u2063 federal Constitution. There is no such thing as a state public health emergency \u200dexception to the U.S. Constitution. <a href=\"https:\/\/t.co\/kOhLMtaOl2\">https:\/\/t.co\/kOhLMtaOl2<\/a><\/p>\n<p>\u2014 Ted \u200dLieu\u200c (@tedlieu) <a href=\"https:\/\/twitter.com\/tedlieu\/status\/1700589909390835901?\">September 9, 2023<\/a><\/p>\n<\/blockquote>\n<p>In a commentary piece, <a href=\"https:\/\/www.westernjournal.com\/going-gun-grabbing-leftists-suddenly-acting-like-pro-constitution\/\" target=\"_blank\" rel=\"noopener\">The Western Journal\u2019s Bryan Chai<\/a> offered two theories for why \u200cthese Democrats\u200c and others\u200d chose to push back. \u201cThis writer posits two \u2063theories\u2026\u200c 1. Democrats have some genuinely terrifying (for them) polling \u2063data regarding 2024 and beyond. They see that their far-left policies are forcefully turning\u200c the tide against their\u200d side, and are trying to mitigate\u2064 that damage with lip service,\u201d\u200b Chai wrote. \u201c2. Gov. Grisham is splintering off to\u200d spearhead an even more far-left wing of \u2064the Democrat party, and the old far-left\u200d stalwarts are calling her out on it (think of how many modern \u200dmoderates have been vilified by the left as it\u200d kept moving \u200bfurther in that direction. \u200dSame idea.)\u201d<\/p>\n<h3><strong>Local Law Enforcement\u2062 Refused to Enforce the\u200d Order<\/strong><\/h3>\n<p>In \u200daddition to bi-partisan pushback, many local New Mexico \u200blaw enforcement officials also opposed the order, <a href=\"https:\/\/www.westernjournal.com\/new-mexico-sheriff-seals-deal-governor-announces-will-not-enforce-order-armed-citizens-pour\/\" target=\"_blank\" rel=\"noopener\">refusing to enforce it<\/a>. Bernalillo \u2062County District Attorney Sam Bregman, Albuquerque Mayor \u2063Tim Keller and Albuquerque Police Chief Harold \u200cMedia were among those refusing to enforce\u200d the order, according to\u2062 the <a href=\"https:\/\/apnews.com\/article\/albuquerque-guns-governor-concealed-carry-firearms-3fbe91683934057fe3036ccf187a7f1c\" target=\"_blank\" rel=\"noopener\">Associated Press<\/a>. Bernalillo County Sheriff\u200d <a href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/new-mexico-sheriff-special-session-unconsitutional-gun-ban\" target=\"_blank\" rel=\"noopener\">John\u200d Allen<\/a> also\u200c came out \u200cfirmly against it.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Here\u2019s the video \u2063of the press \u200cconference! \u200bWow \u200c  <a href=\"https:\/\/t.co\/NREe71lpWo\">pic.twitter.com\/NREe71lpWo<\/a><\/p>\n<p>\u2014\u200b Rep. John Block \u200b(@RepBlock) <a href=\"https:\/\/twitter.com\/RepBlock\/status\/1701281334759661799?\">September 11, 2023<\/a><\/p>\n<\/blockquote>\n<p>\u201cThe temporary \u2063ban challenges\u2062 the foundations of our \u200bConstitution, but most importantly, it is unconstitutional,\u201d\u200c Allen, a Democrat, said according to \u2063the <a href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/new-mexico-sheriff-special-session-unconsitutional-gun-ban\" target=\"_blank\" rel=\"noopener\">Washington\u2063 Examiner<\/a>. \u2063\u201cMy oath was to\u2063 protect the Constitution, and that is \u200cwhat \u200cI will do.\u201d<\/p>\n<h3><strong>Calls For Impeachment<\/strong><\/h3>\n<p>Amidst the fallout and pushback, Republican lawmakers in New \u2064Mexico, \u200dnamely state representatives Stefani Lord and John Block, <a href=\"https:\/\/www.westernjournal.com\/lawmakers-officially-calling-impeachment-new-mexico-governor-suspension-gun-rights\/\" target=\"_blank\" rel=\"noopener\">called for the governor\u2019s impeachment<\/a> on Sept. 9.<\/p>\n<p style=\"margin: 12px auto 6px auto;font-family: Helvetica,Arial,Sans-serif;font-style: normal;font-variant: normal;font-weight: normal;font-size: 14px;line-height: normal;display: block\"><a style=\"text-decoration: underline\" title=\"View New Mexico State Representatives Stefani Lord and John Block Call for Impeachment of Governor Grisham on Scribd\" href=\"https:\/\/www.scribd.com\/document\/672103336\/New-Mexico-State-Representatives-Stefani-Lord-and-John-Block-Call-for-Impeachment-of-Governor-Grisham#from_embed\">New Mexico State Representatives Stefani Lord and John\u2064 Block Call\u200c for Impeachment\u2063 of Governor Grisham<\/a> \u2062 by \u2062 <a style=\"text-decoration: underline\" title=\"View The Western Journal's profile on Scribd\" href=\"https:\/\/www.scribd.com\/user\/480928840\/The-Western-Journal#from_embed\">The Western Journal<\/a> on Scribd<\/p>\n<p>This sentiment was supported by Tesla\u2063 founder and X (formerly known as Twitter) owner <a href=\"https:\/\/www.westernjournal.com\/democrat-governor-facing-calls-impeachment-musk-attack-2a\/\" target=\"_blank\" rel=\"noopener\">Elon Musk<\/a>. \u201cAt risk of stating what\u200d should be obvious, deliberately violating the Constitution is\u200d next-level\u2062 illegal,\u201d Musk wrote on X in response to the \u2062\u201cpublic health order.\u201d \u201cHow soon can this person be removed from office?\u201d<\/p>\n<p>In response to \u2062the\u2062 calls for \u200dimpeachment, on Tuesday, Democratic Speaker of the New Mexico House \u200bof Representatives Brian Egolf declared he would in \u201cno way\u201d support such a \u2062movement, per <a href=\"https:\/\/thehill.com\/homenews\/state-watch\/429736-new-mexico-house-speaker-rejects-impeachment-push-against-governor-over\/\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>.<\/p>\n<h3><strong>The Restraining Order<\/strong><\/h3>\n<p>On Wednesday, U.S. District Court Judge David Urias,\u2062 a Biden appointee, <a href=\"https:\/\/www.westernjournal.com\/gun-grabbing-new-mexico-governor-runs-legal-blockade-biden-nominated-judge\/\" target=\"_blank\" rel=\"noopener\">issued a temporary restraining\u200d order<\/a> preventing Grisham\u2019s \u2064ban from going into\u2063 full effect. According\u200c to the <a href=\"https:\/\/www.washingtonexaminer.com\/restoring-america\/fairness-justice\/federal-judge-blocks-new-mexico-30-day-gun-ban\" target=\"_blank\" rel=\"noopener\">Washington Examiner<\/a>, \u200dUrias \u2063determined the order went against precedent set by \u2063the\u200d 2022 U.S. Supreme\u200c Court ruling of New York State Rifle &#038; Pistol Association, Inc.\u2062 v. Bruen. In <a href=\"https:\/\/www.westernjournal.com\/breaking-scotus-decision-blows-gaping-hole-gun-control-agenda-massive-win-2nd-amendment-freedom\/\" target=\"_blank\" rel=\"noopener\">the \u20626-3 decision from 2022<\/a>, the <a href=\"https:\/\/www.westernjournal.com\/supreme-court-weigh-alleged-overcriminalization-jan-6-cases\/\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> determined New York state restrictions on firearm ownership were\u200b in violation of the 14th Amendment.\u2064 \u201cTo be honest with you, I think you have\u200d kind of a hard road here to get\u200d up,\u201d Urias told Holly Agajanian, the attorney \u200cfor Grisham\u2019s office, according to <a href=\"https:\/\/www.politico.com\/news\/2023\/09\/13\/new-mexico-gun-restrictions-albuquerque-00115764\" target=\"_blank\" rel=\"noopener\">Politico<\/a>. \u200dThough\u2063 lauded by \u200dmany conservatives across the country, Urias\u2019s ban\u200d is merely a temporary one. The court \u2063is set to reevaluate the order on Oct. 3, the same day the current restraining order is set to expire, per Politico. At that time, a final determination on the\u200b order and its constitutionality will be made.<\/p>\n<h3><strong>An\u200c Amended Open Carry Ban is Still in Place Today<\/strong><\/h3>\n<p>In the face of the restraining\u200d order and universal pushback, <a href=\"https:\/\/www.westernjournal.com\/new-mexico-governor-folds-removes-firearm-carry-ban-emergency-order\/\" target=\"_blank\" rel=\"noopener\">Gov. Grisham<\/a> announced her decision to scrap parts of the \u200bconcealed carry ban on Friday. However, the order was \u200dnot scrapped completely. Some\u200b temporary gun restrictions \u2063still remain in \u200cplace. Perhaps most notably, firearms \u2062are still \u201cbanned\u201d from being carried at \u200dparks\u200d and playgrounds in \u2063both Albuquerque and Bernalillo County. \u201cProvisions\u200b in\u200b the updated\u200d public health order \u200dissued Friday include\u2026 Removing the previous provision around \u2062firearms and replacing it with a provision that temporarily suspends the carrying of firearms \u2064at parks and playgrounds in Albuquerque and \u200bBernalillo County,\u201d a Friday <a href=\"https:\/\/www.governor.state.nm.us\/2023\/09\/15\/gov-lujan-grisham-updates-public-health-order-focused-on-combating-gun-violence\/\" target=\"_blank\" rel=\"noopener\">press release<\/a> \u200c from Grisham\u2019s\u2062 office reads. In response, some conservative critics of the order \u200bhave pointed out that potential <a href=\"https:\/\/www.westernjournal.com\/school-district-tests-ai-enabled-gun-detection-tech-thwart-potential-mass-shooters\/\" target=\"_blank\" rel=\"noopener\">mass \u200cshooters<\/a> will obviously ignore the rule.
