You are not a cow. Seriously, y&#8217;all. Stop\u2064 it.&#8221;<\/div>\n<div class=\"my-5\">The FDA&#8217;s webpage on ivermectin has also not been updated and continues to advise against its use for COVID-19.<\/div>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/div>\n<\/div>\n<p>The appeals court \u200cdid not require the \u200dFDA to \u200btake immediate action, \u2064but Dr. Robert Apter, the lead plaintiff in \u2064the case, believes the\u2063 FDA\u200b should comply with the court&#8217;s directive.<\/p>\n<p>Dr. Apter stated, &#8220;From an \u2063ethical standpoint, the FDA \u200bhas\u200b been instructed not to do what they are doing. He made this argument during oral arguments before the panel.<\/div>\n<p>Initially, U.S. District Judge Jeffrey Brown \u2062ruled in \u2064favor of the FDA, stating that the agency\u200b acted within its authority under the Federal Food, Drug, and \u2062Cosmetic \u200bAct.<\/p>\n<p>However, the appeals court panel disagreed \u2063with Judge Brown&#8217;s ruling.<\/p>\n<p>Judge Willett wrote, &#8220;FDA never points \u2063to any authority that allows it\u2063 to issue\u200c recommendations or \u2064give medical advice. Nothing in the act\u2019s plain text \u200bauthorizes FDA to issue medical advice or recommendations.&#8221;<\/p>\n<p>Mr. Kelson, the doctors&#8217; attorney, stated, &#8220;The decision is pretty clear that the FDA is not a physician and\u200b cannot endorse specific treatments or advise on how to approach any specific \u200cillness.&#8221;<\/p>\n<p>He declined to comment on whether the FDA should update its\u200c statements.<\/p>\n<p>While the appeals court ruling supersedes the \u200dprevious decision, the case will be returned to Judge Brown, who will reconsider the issue \u200dof standing.<\/p>\n<p>The\u2062 FDA had requested the appeals court to dismiss the case based on \u200black of standing, but the\u200d court chose not to address\u2064 that issue.<\/p>\n<p>The panel stated, &#8220;We \u2063believe it is more\u2062 appropriate for the district court to address standing and\u2062 any other jurisdictional issues. We express \u200dno view on those issues and trust the \u2063district court&#8217;s sound judgment.&#8221;<\/p>\n<p>This \u2062means that\u2062 Judge Brown will revisit the case, and \u200chis ruling on standing could be overturned.<\/p>\n<p>The government also has the option to appeal the \u200crecent appeals court \u2064ruling to\u2064 the\u2063 U.S. Supreme Court.
