The court will continue to review their case. The\u2062 Escondido \u200bUnion School District implemented its confidentiality policy to align with\u200b the state&#8217;s non-binding guidance, which advises \u200bschools \u2063to keep parents unaware of their children&#8217;s\u200c gender exploration.<\/p>\n<blockquote>\n<p>&#8220;The school&#8217;s policy is a trifecta of harm: \u200bit harms the child who needs parental\u2063 guidance and possibly mental health intervention to determine if the \u2062incongruence is organic or whether it is the result of \u200cbullying, peer pressure, or\u200c a fleeting impulse,&#8221; stated U.S. District Court judge \u200dRoger Benitez. &#8220;It harms the parents by depriving them of the long recognized Fourteenth Amendment right to care, guide, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tennessee-introduces-bill-allowing-fathers-to-prevent-an-abortion\/\" title=\"Tennessee Introduces Bill Allowing Fathers To Prevent An Abortion\">make health care decisions<\/a> for their children. And finally, it harms plaintiffs\u2063 who are \u200bcompelled to violate the parent&#8217;s rights by \u200cforcing plaintiffs to conceal information \u2063they feel is critical for the welfare of their students.&#8221;<\/p>\n<\/blockquote>\n<p>This ruling comes as California attorney general\u200c Rob \u2064Bonta wages a \u200bfierce battle against an\u2062 increasing number of \u200dschool districts that defy state \u2063guidance by secretly facilitating\u2064 gender transitions for students. Bonta recently obtained a state \u200dcourt restraining order against Chino\u2064 Valley Unified School \u200dDistrict,\u200c which was \u2062the first to adopt a parental notification policy \u2064for students requesting to be treated as a different gender at school. A comprehensive hearing\u200c on the case is \u200cscheduled\u2064 for next month.<\/p>\n<p>Judge Benitez criticized Bonta and the state&#8217;s Democratic leaders who seek\u2064 to enforce a confidentiality policy \u200bin every school district. He\u200c called for a universal court order against California&#8217;s guidance for schools to deceive parents, stating that it contradicts &#8220;knowledgeable medical opinion.&#8221;<\/p>\n<p>California attorney \u200dgeneral Rob Bonta did not provide a comment \u200cwhen requested.<\/p>\n<p>Opponents of the \u2062state&#8217;s campaign against\u200d transparency in schools welcomed the injunction, asserting that it exposes the flaws in California&#8217;s stance.<\/p>\n<blockquote>\n<p>&#8220;The secret policies are unlawful in the first place,&#8221; said\u200c Julie \u2063Hamill, an attorney and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/big-guns-coffee-father-fosters-daughters-entrepreneurial-spirit\/\" title=\"Big Guns Coffee: Nurturing Entrepreneurial Spirit\">school board \u2062member<\/a> \u200dfrom the Los\u2063 Angeles\u200d area. &#8220;There&#8217;s no logical or legal justification for a school \u200bdistrict to devise a plan with \u2062a \u200cchild \u200cfor \u2062a gender transition without involving the child&#8217;s family in the discussion.&#8221;<\/p>\n<\/blockquote>\n<p>The teachers involved in the Escondido case are Elizabeth Mirabelli and \u2062Lori Ann West. They filed a lawsuit in April 2023\u200b after unsuccessfully seeking a religious\u2062 exemption\u200d from their district&#8217;s confidentiality policy, which was implemented without any input from the school board or the public. According\u200b to legal documents, administrators did not \u2062inform parents about the \u2064policy. In a presentation to teachers,\u2063 a\u2063 district social worker stated \u2062that\u200b parents and\u2062 guardians &#8220;do not have a legitimate need \u2064for the information&#8221; regarding their child&#8217;s gender confusion.<\/p>\n<p>Attorneys representing the school\u200b district instructed Mirabelli and West\u200c to\u2064 evade any questions\u2064 from parents about their child&#8217;s gender identity. The teachers were advised to respond \u2064that the parents&#8217; inquiries were &#8220;outside the scope of the intent of their interaction,&#8221; as stated in legal filings.<\/p>\n<p>Meanwhile, school \u2064counselors were guiding\u2062 students through gender transitions, utilizing a &#8220;gender support \u2063plan&#8221; and \u200cregularly sending emails to staff on which children were\u2064 beginning to socially\u2064 transition\u200c and\u200c how to keep this information hidden from parents.<\/p>\n<p>If the teachers\u200b succeed, their victory will likely lead to a legal battle\u200c in the Ninth \u2062U.S. \u2062Circuit Court of Appeals, as it contradicts a separate federal court ruling from July. \u2064In that case, \u200da judge dismissed a mother&#8217;s lawsuit against \u2063a Northern California school district that secretly facilitated her daughter&#8217;s transition.
