Another count indicts Hunter for possessing the handgun while he was addicted to and using illicit substances.<\/p>\n<p>Despite his extensive history with narcotics, Hunter marked \u201cno\u201d on the Firearms Transaction Record that asks potential gun buyers if they are an \u201cunlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance.\u201d<\/p>\n<p>At the time of the problematic purchase, Hunter had already been discharged from the Navy Reserve for cocaine use and attended alcohol and\u00a0<a href=\"https:\/\/www.businessinsider.com\/hunter-biden-opens-about-addiction-struggles-divorce-new-yorker-2019-7\" target=\"_blank\" rel=\"noreferrer noopener\">drug rehab<\/a>\u00a0programs in 2003, 2010, and 2014. The infamous Apple laptop that he dropped off for repairs in 2019 showed the younger Biden deep in the\u00a0<a href=\"https:\/\/www.dailymail.co.uk\/news\/article-8901717\/Hunter-Bidens-laptop-lays-bare-world-depravity-makes-target-blackmail.html\" target=\"_blank\" rel=\"noreferrer noopener\">world of sex and drugs<\/a>, with graphic pictures and video of him allegedly smoking crack cocaine from a pipe while engaged in a sex act.<\/p>\n<p>News about Hunter\u2019s reported \u201cfalse and fictitious\u201d form became public knowledge <a href=\"https:\/\/thefederalist.com\/2021\/03\/25\/report-hunter-biden-may-have-lied-on-federal-background-check-form-to-purchase-a-gun\/\" target=\"_blank\" rel=\"noreferrer noopener\">in 2021<\/a> when Politico obtained a copy of his 4473 and transaction receipt. Government officials such as local police, <a href=\"https:\/\/thefdrlst.wpengine.com\/2021\/03\/25\/report-secret-service-tried-to-clean-up-biden-family-mess-in-hunters-missing-gun-incident\/\" target=\"_blank\" rel=\"noreferrer noopener\">the Secret Service<\/a>, the FBI, and the ATF likely knew about Hunter\u2019s lie earlier than that because the revolver soon became the center of a missing gun investigation.<\/p>\n<p>Yet, it wasn\u2019t until earlier this summer that the DOJ\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/23854024-hunter-letter\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> it would charge the president\u2019s youngest son with two federal misdemeanor counts for failing to pay his taxes and one federal felony charge for possessing a\u00a0gun while being an illegal drug user and addict. Weiss previously delayed bringing these charges against Hunter because he believed it would\u00a0<a href=\"https:\/\/thefederalist.com\/2021\/07\/16\/federal-prosecutor-deliberately-delayed-hunter-biden-probe-to-shield-2020-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">hurt<\/a>\u00a0Biden\u2019s presidential chances.<\/p>\n<p>Hunter\u2019s lawyers used the<a href=\"https:\/\/thefederalist.com\/2023\/06\/20\/hunter-bidens-wrist-slap-on-gun-tax-crimes-is-a-complete-smokescreen\/\" target=\"_blank\" rel=\"noreferrer noopener\"> sweetheart deal<\/a> as an excuse to conclude that \u201cthe five-year investigation\u201d into their client was finally \u201cresolved,\u201d a claim that corporate media were all too happy to amplify. Their carefully orchestrated plea deal with DOJ and Hunter meant the younger Biden would only face probation \u2014 not jail time \u2014 for the two misdemeanor tax charges he planned to plead guilty to. The government planned to drop the original felony gun charge as long as Hunter pledged to forsake his drug-plagued lifestyle for 24 months and\u00a0<a href=\"https:\/\/www.nytimes.com\/live\/2023\/06\/20\/us\/hunter-biden-plea-deal#hunter-biden-plea-deal\" target=\"_blank\" rel=\"noreferrer noopener\">never own a gun again<\/a>.<\/p>\n<p>Federal Judge\u00a0Maryellen Noreika\u00a0<a href=\"https:\/\/thefederalist.com\/2023\/08\/23\/after-hunters-sweetheart-deal-went-south-heres-whats-next-from-bidens-compromised-doj\/\" target=\"_blank\" rel=\"noreferrer noopener\">immediately called foul <\/a>on the pretrial diversion agreement after she noted it could protect Hunter from other crimes in the same time span. The <a href=\"https:\/\/thefederalist.com\/2023\/07\/27\/hunter-bidens-plea-deal-wasnt-supposed-to-protect-him-it-was-supposed-to-protect-joe\/\" target=\"_blank\" rel=\"noreferrer noopener\">plea deal fell apart<\/a>, and Attorney General Merrick Garland scrambled to name Weiss as special counsel to rework the charges while prosecutors worked on charging Hunter for tax crimes in California or Washington, D.C.<\/p>\n<p>It\u2019s unclear whether the pretrial diversion agreement supersedes the new indictment, as Hunter\u2019s lawyers\u2019 <a href=\"https:\/\/thefederalist.com\/2023\/08\/23\/after-hunters-sweetheart-deal-went-south-heres-whats-next-from-bidens-compromised-doj\/\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a>.
