Jean Carroll brought against him, but it has ordered that the appeal be expedited.<\/p>\n<blockquote><p>&#8220;It would\u200c be in the interest of the parties, as confirmed \u200bduring oral argument, for the\u2063 Court \u200cto resolve \u200cthe issue\u2062 of \u2063absolute \u2062presidential immunity as presented in the\u2064 two appeals expeditiously,&#8221; \u2062the \u200dcourt clerk wrote on Wednesday.<\/p><\/blockquote>\n<p>President Trump will have to submit his brief by Sept.\u200d 28,\u200b and Ms. Carroll a response 15 days after that,\u200c after which Mr. Trump can file a response within five days if necessary. The former \u2062president\u2063 is campaigning to run for reelection\u200c in 2024 and faces a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/suspicions-arise-after-trumps-georgia-trial-date-proposed-look-whats-scheduled-for-the-next-day\/\" title=\"Trump's Georgia trial date raises suspicions - intriguing events follow.\">busy court schedule<\/a> as he\u200b continues to lead the GOP field by double\u200d digits.<\/p>\n<p>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-is-an-american-legal-giant\/\" title=\"Sidney Powell Is an American Legal Giant\">federal judge<\/a> had\u200b denied President\u200d Trump&#8217;s request \u2062to delay \u2062the trial,\u2064 and denied another\u2064 motion to dismiss the suit \u200centirely based \u200con the &#8220;absolute immunity&#8221; a U.S. president is granted.\u2064 President Trump&#8217;s countersuit alleging Ms. \u200cCarroll defamed him was also \u200bthrown\u2064 out.<\/p>\n<p>Judge\u200d Lewis Kaplan, presiding over the \u2063case, has previously \u200bruled against President Trump in\u200b several motions related to the cases Ms. Carroll\u200c brought against him.<\/p>\n<div class=\"my-5\">\n<p>    \u2062  In the current case, the judge has already ruled for Ms. Carroll, writing that the trial in January\u2064 will only\u2064 deal with how much President Trump owes her in \u200cdamages.<\/p>\n<h2>Two\u200b Lawsuits<\/h2>\n<p>    Ms. Carroll had first brought \u2062the defamation case against \u2063the former president in 2022, based on remarks he made in office denying\u200b her\u2063 allegations of sexual assault, later updated to include several more \u2064comments he made to \u2064the press \u200cout of office.\n  <\/p><\/div>\n<p>Ms. \u200bCarroll \u2064had alleged that President Trump raped her, in 1996, in a department store dressing \u2064room.\u2062 He denied\u200c this via a \u200cstatement \u2062and \u2064later in interviews and comments to the press, alleging he had never met her and\u200d that\u200d she had\u2062 made \u2062the \u200cstory up.<\/p>\n<p>Ms. Carroll then sought damages for his comments in one lawsuit,\u2062 and later\u2064 brought forth a \u2062second lawsuit when New York passed the Adult Survivors\u200c Act, allowing\u2062 victims \u2063to bring forth sexual offense cases outside of the statute of limitations for one year, between November 2022 and November 2023.<\/p>\n<p>In May, a jury awarded \u2064Ms. Carroll $5 million in the second lawsuit, finding him \u200dliable for both defamation and &#8220;sexual battery,&#8221; which is\u2063 the term the court used. Attorneys\u2063 for\u200b President Trump noted that even though Ms. Carroll had brought forward a &#8220;rape&#8221; case, the jury did not\u2062 rule that he had raped her, \u200cyet still ruled in her favor. President Trump appealed the ruling, but a judge \u200bdenied both a new trial for the case or a reduction to\u200c the damages he was ordered to pay Ms.\u200c Carroll.<\/p>\n<div class=\"my-5\">\n<p>    \u200c The court \u200calso allowed Ms. Carroll to amend her first \u2063lawsuit to seek \u200bmore damages, which she did,\u2063 asking for \u2064$10 \u2062million.\u2063 A jury in the\u200c January\u200c trial will decide how much Ms. Carroll is to be awarded, if President Trump&#8217;s\u2064 immunity defense \u2062does not hold up.<br \/>\n \u200d<\/p>\n<h2>Absolute \u2063Immunity<\/h2>\n<p>    \u2062 The &#8220;absolute immunity&#8221;\u200d of a president arose from the\u200b section of \u2063the\u200d U.S.\u200b Constitution describing his official duties. Although it does \u2064not\u2064 include \u2063&#8221;immunity,&#8221;\u2063 various U.S.\u200d Supreme\u2062 Court rulings that use this section as\u200d a basis \u2063have conferred immunity to U.S. presidents for \u200cactions taken \u2063while in office.\n  <\/p><\/div>\n<p>The first lawsuit against a U.S. president as\u200d brought forth in \u20621867, when the State of Mississippi sued President\u2064 Andrew Johnson to\u200c delay Reconstruction efforts. The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/court-expedites-trumps-absolute-immunity-appeal-in-defamation-case\/\" title=\"Court speeds up Trump's appeal in defamation case over 'absolute immunity'.\">high court ruling \u2062effectively put<\/a> the president\u200c beyond the \u2062sphere of the \u200cjudiciary, writing that\u2062 it had &#8220;no \u2064 <\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>to resolve this case as quickly as possible,&#8221; the court stated. Trump&#8217;s legal team argued that the case should be delayed until he leaves office, but the court rejected this argument.
