This program \u2064protects \u200cindividuals who were brought illegally\u200c into the U.S. as children\u200b from deportation.<\/p>\n<blockquote>\n<p>In \u2064his <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txsd.1501682\/gov.uscourts.txsd.1501682.728.0_3.pdf\" target=\"_blank\" rel=\"noopener\">40-page opinion<\/a> for the\u200b Southern District of Texas, federal Judge Andrew Hanen emphasized that the executive branch cannot &#8220;usurp&#8221; congressional \u200cauthority. Over half\u200b a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/analysis-bidens-immigration-policies-may-fuel-migrant-caravan-crisis-at-southern-border\/\" title=\"Analysis: Biden\u2019s immigration policies may fuel migrant caravan crisis at southern border\">million illegal immigrants<\/a> have been shielded from deportation under this Obama-era rule, which was later adopted\u2063 and amended\u2064 by the Biden\u2062 administration.<\/p>\n<\/blockquote>\n<p>According to Hanen, the responsibility to address the deficiencies of the DACA program lies with the legislature, not the executive or\u200b judicial\u200c branches. He wrote,\u2064 &#8220;Congress, for any number of reasons, decided not \u200dto pass\u2064 DACA-like legislation.&#8221;<\/p>\n<blockquote>\n<p>&#8220;Congress&#8217; alleged failure to pass,\u200b or, stated differently, its decision\u2064 not to enact legislation,\u2062 does not\u2063 empower the Executive Branch to &#8216;legislate&#8217; on its own \u2014 especially when \u200bthat \u200b&#8217;legislation&#8217; \u2064is contrary to actual existing legislation. The \u2063Executive Branch cannot usurp the power bestowed on Congress \u2014 even \u2064to fill a void,&#8221; the judge added.<\/p>\n<\/blockquote>\n<p>This ruling came after nine states, \u200bincluding Texas, Alabama, Arkansas, Louisiana, \u2064Nebraska, South Carolina, \u200bWest Virginia, Kansas, and Mississippi, filed a\u2064 lawsuit\u200d to stop DACA, arguing that it was unlawfully\u2064 implemented\u2063 by both the Obama\u2063 and Biden administrations. Texas Attorney General Ken Paxton \u200d <a href=\"https:\/\/texasattorneygeneral.gov\/news\/releases\/paxton-leads-coalition-defeat-daca-after-biden-administration-attempts-salvage-illegal-immigration\" target=\"_blank\" rel=\"noopener\">stated<\/a> that the Biden administration was\u2063 attempting to implement \u200d&#8221;mass amnesty&#8221; through\u2062 executive authority.<\/p>\n<p>The fate of DACA will likely be determined by the Supreme Court, which \u2062 <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/federal-judge-declares-daca-illegal-again-issue-likely-to-be-decided-by-supreme-court#:~:text=In%202016%2C%20the%20Supreme%20Court,it%20to%20stay%20in%20place.\" target=\"_blank\" rel=\"noopener\">previously ruled<\/a> 5-4 in 2020 that the Trump administration could \u2062not end the program.<\/p>\n<p>The Biden administration\u2063 expressed disappointment with the \u200ddecision and plans to urge Congress to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-new-york-gopers-demand-elections-board-clean-up-voter-rolls-inflated-by-3-million-voters-missing-id-info\/\" title=\"Exclusive: New York GOPers Demand Elections Board Clean Up Voter Rolls Inflated By 3 Million Voters Missing ID Info\">pass legislation similar<\/a> to DACA.
