Scott Perry (R-Pa.), which the FBI had seized.<\/p>\n<div class=\"my-5\">&#8220;Representative Perry&#8217;s conversations with other Members concerned the passage of proposed legislation as well as the exercise of the constitutional duty to certify the electoral votes from the 2020 election. These communications were privileged,&#8221; wrote\u00a0Judge Neomi Rao in the Sept. 5 opinion unsealed on Sept. 13 (<a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/53FDEC7E544D232E85258A29005F24EC\/$file\/23-3001-2016705.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>), ruling that the district court had incorrectly withheld privilege previously.<\/div>\n<p>The district court had ruled that Mr. Perry&#8217;s conversations were &#8220;purely political&#8221; and any relation to the upcoming certification was only &#8220;incidental.&#8221;<\/p>\n<div class=\"shortcode\">\n<div class=\"border-comp-divider mb-4 mr-4 w-full max-w-[500px] border px-5 py-4 text-[16px] leading-[20px] text-[#262626] md:float-left\" id=\"in_article_related_stories\">\n<div class=\"mb-3 font-sans text-[16px] font-semibold uppercase leading-[19px] text-[#2F2F2F]\">Related Story<\/div>\n<div class=\"mb-4 flex gap-2\">\n<div class=\"grow\">\n<div class=\"mb-1 line-clamp-2\"><a href=\"http:\/\/www.theepochtimes.com\/us\/court-blocks-jack-smiths-bid-to-obtain-rep-scott-perrys-fbi-seized-phone-records-5486662\">Court Blocks Jack Smith&#8217;s Bid to Obtain Rep. Scott Perry&#8217;s FBI-Seized Phone Records<\/a><\/div>\n<div class=\"text-comp-caption text-[14px] leading-[18px]\">9\/5\/2023<\/div>\n<\/div>\n<div class=\"shrink-0 basis-[120px]\"><a href=\"http:\/\/www.theepochtimes.com\/us\/court-blocks-jack-smiths-bid-to-obtain-rep-scott-perrys-fbi-seized-phone-records-5486662\"><\/a><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>&#8220;The district court inadequately considered the context of these conversations, which involved Member deliberations about upcoming votes,&#8221; Judge Rao wrote.<\/p>\n<div class=\"my-5\">&#8220;While elections are political events, a Member\u2019s deliberation about whether to certify a presidential election or how to assess information relevant to legislation about federal election procedures are textbook legislative acts protected by <a href=\"https:\/\/www.oyez.org\/cases\/1971\/71-1017\" target=\"_blank\" rel=\"noopener\">Gravel<\/a>,&#8221; she wrote, citing a 1972 case when Sen. Mike Gravel received a copy of the Pentagon Papers.<\/div>\n<p>Mr. Smith was appointed special counsel by the Justice Department (DOJ) in November 2022 to investigate crimes related to the events of Jan. 6, 2021, at the U.S. Capitol and former President Donald Trump&#8217;s alleged mishandling of classified documents. The 45th president, who is once again campaigning for the post for 2024, has been indicted in both cases.<\/p>\n<div class=\"my-5\">As part of investigation, Mr. Smith has sought evidence from Trump allies regarding his challenge of the 2020 election results, such as the thousands of messages on <a href=\"https:\/\/www.theepochtimes.com\/us\/court-blocks-jack-smiths-bid-to-obtain-rep-scott-perrys-fbi-seized-phone-records-5486662\" target=\"_blank\" rel=\"noopener\">Mr. Perry&#8217;s phone<\/a>.  <\/p>\n<h2>Phone Seizure<\/h2>\n<p>  Mr. Perry used this phone to communicate with several other representatives about alleged fraud in the wake of the 2020 elections, as well as members of the executive branch and those outside of the federal government.<\/p><\/div>\n<p>In August 2022, after the raid of President Trump&#8217;s Mar-a-Lago estate, a Pennsylvania judge approved a search warrant allowing the FBI to seize Mr. Perry&#8217;s phone and create a copy of its contents. Mr. Smith&#8217;s office did not immediately obtain access to it, and the FBI had to obtain a separate search warrant from the District Court of the District of Columbia to allow it.<\/p>\n<div class=\"my-5\">\u201cI\u2019m outraged\u2014though not surprised\u2014that the FBI under the direction of [Attorney General] Merrick Garland\u2019s [DOJ], would seize the phone of a sitting Member of Congress,&#8221; the congressman said in a statement <a href=\"https:\/\/www.theepochtimes.com\/us\/rep-scott-perry-says-fbi-seized-his-cell-phone-after-mar-a-lago-raid-4654179\" target=\"_blank\" rel=\"noopener\">at the time<\/a>.<\/div>\n<p>&#8220;My phone contains info about my legislative and political activities, and personal\/private discussions with my wife, family, constituents, and friends. None of this is the government\u2019s business,&#8221; he said.\u00a0\u201cAs with President Trump last night, DOJ chose this unnecessary and aggressive action instead of simply contacting my attorneys.\u201d<\/p>\n<p>Mr. Perry had argued that his 2,219 messages were privileged from disclosure because &#8220;informal factfinding&#8221; by members of Congress constituted legislative acts, and therefore privileged speech.<\/p>\n<p>The district court ruled that it was not, putting his communications into three categories: messages to people outside the government that was not privileged because it was informal factfinding, messages with people in Congress that were &#8220;too far removed&#8221; from legislative acts to be privileged, and messages with members of the executive branch that were &#8220;political&#8221; and not factfinding or privileged.
