The transcript from the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/footage-released-of-violent-myanmar-protests-after-at-least-38-people-killed\/\" title=\"Footage Released Of Violent Myanmar Protests After At Least 38 People Killed\">closed-door session<\/a>, \u2062which The Federalist has reviewed in full, reveals a rare find:\u200c an FBI agent \u200bstill involved in the\u200b Hunter Biden investigation who will admit the obvious \u2014 that Delaware U.S. Attorney David Weiss did not have ultimate authority to charge the president\u2019s son.<\/p>\n<p>Monday\u2019s interview of the Baltimore ASAC, whose name is being withheld by\u200b the House Judiciary Committee, followed the questioning last week of \u200bher\u200b boss, Thomas Sobocinski, the special agent \u200cin charge. Both \u200dSobocinski and the ASAC attended the Oct. 7, 2022, meeting in which, according to IRS whistleblower Gary Shapley, Weiss said he\u2064 was not the \u200cfinal decisionmaker\u200c on whether to bring charges against Hunter Biden.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-943062287\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-28baf4b9fe9cea1ee2955f6b1b332665 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-28baf4b9fe9cea1ee2955f6b1b332665\"><\/div>\n<p>In questioning the \u200dASAC, the Judiciary \u200cCommittee asked about her understanding of Weiss\u2019s authority.\u200c She initially\u2063 testified that she understood \u2062Weiss had the\u200b authority <strong>to move forward and bring charges if that was what the determination was and he would go forth in doing that.<\/strong> But\u2062 after several back-and-forths,\u2064 which included the ASAC reviewing the statutory language that would allow Weiss to bring\u2062 charges in another\u200c district, she acknowledged\u2062 that\u200c Weiss did not have the ultimate authority to charge Hunter Biden. <\/p>\n<p><strong>\u201cBut based on what we just discussed, it\u2019s true that\u200d Mr.\u00a0Weiss alone was not the deciding person on whether charges\u200c are filed?\u201d<\/strong> the House attorney queried.<\/p>\n<p><strong>\u201cI would say, based on the\u2062 statute, seeing that,\u200d as it reads here \u2026 yes, I would \u200bsay that there is \u200csomeone else, the Attorney General, as\u2063 it\u2019s noted here in the statute, \u200bthat is involved in this process,\u201d<\/strong> the ASAC replied. <\/p>\n<p>The House attorney continued:\u2064 <strong>\u201c[I]s it your understanding today that there \u200bis another person involved in whether Mr.\u00a0Weiss could \u2062bring\u200c charges in another jurisdiction?\u201d<\/strong><\/p>\n<div class=\"fdrlst__b89e9-243c7a0e60e1f8ce743aef48778f6e84 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-243c7a0e60e1f8ce743aef48778f6e84\"><\/div>\n<p><strong>\u201cYes,\u201d<\/strong> the ASAC concurred.<\/p>\n<p>The ASAC\u2019s answer has been obvious to everyone\u200d for months, yet Democrats, the legacy \u200dmedia, and Weiss and Merrick Garland apologists have refused \u200dto acknowledge the reality. Even the ASAC\u2019s boss, throughout his interview with the House Judiciary \u200cCommittee, maintained, <strong>\u201cWeiss\u200b had \u2064the\u200d authority in the U.S. to\u200b bring the charges where venue presented\u2064 itself,\u201d<\/strong> wherever he wanted, whether it be in California or D.C. And even when pushed on the limitations of \u2063a\u200b U.S. attorney\u2019s authority, Sobocinski said Weiss\u2064 had the authority and it was merely a matter of administrative hoop-jumping for the Delaware U.S. attorney\u2062 to charge Biden in another district. <\/p>\n<p>In fact, that Sobocinski \u2062couldn\u2019t admit the truth \u2064rendered \u200bhis entire testimony <a href=\"https:\/\/thefederalist.com\/2023\/09\/13\/fbi-agent-trying-to-discredit-whistleblower-testimony-blew-his-own-credibility-in-covering-for-weiss\/\" target=\"_blank\" rel=\"noreferrer noopener\">not credible<\/a>.\u2064 That \u200cis \u200cprecisely why no one should believe anything Weiss\u2063 and AG Garland say about\u2062 the Hunter Biden investigation either \u2014 because they first deceived Congress and the American public about Weiss\u2019s\u2063 authority and have since doubled down on their misrepresentations. <\/p>\n<p>Garland, for his part, <a href=\"https:\/\/www.c-span.org\/video\/?526249-1\/justice-department-oversight-hearing\">told<\/a> Sen. Chuck Grassley \u2063under oath that \u201cthe U.S. attorney in Delaware has been advised that he <em>has full authority<\/em> \u2026 to bring cases in \u2062other jurisdictions if he feels it\u2019s necessary.\u201d Weiss then covered for Garland, telling the House \u2063Judiciary Committee in a\u2062 letter on June 7, 2023, that \u201cas the Attorney General has stated, I have been <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/irs-whistleblower-emails-suggest-david-weiss-misled-congress-in-letter-claiming-charging-authority\/\" title=\"IRS whistleblower emails indicate that David Weiss may have deceived Congress in a letter where he asserted his charging authority.\">granted ultimate authority<\/a> over this matter, including responsibility for deciding where, when, and whether to file charges and for making decisions necessary\u200c to preserve the integrity of the\u2062 prosecution\u2026\u201d <\/p>\n<div class=\"fdrlst__b89e9-0c529aaaa8499c2846513c43e75e013b fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-0c529aaaa8499c2846513c43e75e013b\"><\/div>\n<p>Then after the \u2062transcript of \u2063Shapley\u2019s congressional closed-door interview\u2064 was released, revealing the whistleblower\u2019s testimony\u2063 that during the \u2063meeting on Oct.\u200d 7, 2022, Weiss \u2062had\u200d said \u2063he was \u200bnot\u200b the ultimate decisionmaker on whether to charge Hunter Biden, \u200dWeiss clarified his statement.\u00a0While saying he stood by\u200b what\u2064 he had written in \u200bhis June \u20627, 2023, letter\u200b to\u200d the House Judiciary Committee, Weiss wrote in an early July follow-up letter\u2063 that he wished to \u2064expand on what he\u200b meant. He acknowledged\u2062 that as the U.S. attorney for the \u200dDistrict\u200d of Delaware, \u200dhe\u2062 lacked the authority to\u200d charge Hunter Biden in other districts. \u2064Yet, not to worry, Weiss assured the House \u200doversight committee: Garland had promised him that, if necessary, the AG <em>would grant<\/em> Weiss special attorney status to allow him to prosecute Hunter Biden in D.C., California, or\u200b any other jurisdiction.<\/p>\n<p>The most revealing fact from Monday\u2019s interview is that it took this long and this ASAC to say openly what the attorney \u200dgeneral, the U.S. attorney, and the special agent in charge of the Baltimore FBI field office \u200bcontinue to obfuscate about: Weiss\u2019s pre-special counsel \u2063authority.\u2063 The only\u200c real reason to hide the reality that \u2064Weiss lacked the authority to charge Hunter Biden in D.C. and California is\u2062 that it means the failure to charge him for felony tax\u200c offenses falls on the U.S. attorneys and attorney general his father appointed. <\/p>\n<p>Thus the ASAC\u2019s\u2063 testimony \u200dalso confirmed that the Biden-appointed U.S.\u200d attorneys in D.C. and California had \u2063refused to bring charges against \u2063Hunter Biden in their districts where they had proper venue for the alleged tax felonies.<\/p>\n<p>On the question \u200cof what,\u2063 precisely, Weiss had said during the Oct.\u200b 7, 2022, meeting,\u2064 the\u2064 ASAC was less helpful, however, not remembering many of the details. But not only didn\u2019t she remember what Shapley \u200cclaimed was said during\u200c the meeting. She \u200calso didn\u2019t remember what her boss, Sobocinski, admitted to saying during the meeting. \u200bHer lack of \u200crecall thus doesn\u2019t carry much of a punch, especially when she hadn\u2019t taken notes during the meeting, as Shapley had.<\/p>\n<p>Of course, during the interview, the DOJ and FBI\u2019s \u2064attorneys \u200ctried to spin Shapley\u2019s email notes as merely a summary of the meeting written later, but the IRS whistleblower has already destroyed that narrative. On Wednesday, his attorneys provided the House Judiciary Committee <a href=\"https:\/\/thefederalist.com\/2023\/09\/13\/irs-whistleblower-gives-congress-more-documents-boosting-his-credibility-and-busting-the-dojs\/\" target=\"_blank\" rel=\"noreferrer noopener\">a copy of the handwritten notes<\/a> he had taken during the meeting. <\/p>\n<p>While those notes\u200d corroborate Shapley\u2019s testimony, we are much beyond the question of what Weiss\u2064 said during the meeting.
