Mehalchick, a\u200c magistrate judge in the state, has gained attention for her contentious rulings, with at least 31 decisions being\u200b reversed in less than a decade\u2062 on the bench.<\/p>\n<p>But it was her 2019 decision that\u200c caused\u200d the most controversy. Mehalchick controversially let then-Penn State president Graham Spanier off on a technicality, \u2063despite\u200b a jury\u2062 finding him guilty\u2062 of child endangerment in 2017. However, a spokesman \u2064for Fetterman affirmed the \u200bSenator\u2019s unwavering support\u200c for \u2062Mehalchick.<\/p>\n<h3>A Controversial Ruling Revisited<\/h3>\n<p>An appeals court unanimously reinstated Spanier\u2019s two-month sentence in\u2063 December 2020, but \u2062not before \u200cthe panel of three\u200b judges chastised \u200bMehalchick \u200bfor her decision. \u2064According to their opinion,\u2064 Mehalchick did not &#8220;examine \u2026 [the law] \u2064closely.&#8221;\u2063 The judges also \u200bimplied that she willfully\u2062 left out other\u200c case law that \u200bwould have voided her argument for letting Spanier off.<\/p>\n<p>Then-attorney general Josh Shapiro (D.), who\u200b is now Pennsylvania\u2019s governor, applauded\u2064 the \u2062appellate court\u2019s decision. &#8220;No \u2063one \u2063is\u2063 above the law, especially when it comes to the welfare of \u2063children,&#8221; \u200che said.<\/p>\n<p>&#8220;Spanier turned a blind\u200d eye\u2062 to child abuse by\u200b not reporting his knowledge\u2062 of Jerry Sandusky\u2019s assaults to law enforcement,&#8221; Shapiro continued in\u2062 a <a href=\"https:\/\/www.attorneygeneral.gov\/taking-action\/statement-by-attorney-general-josh-shapiro-on-u-s-third-circuit-court-of-appeals-ruling-reinstating-conviction-of-graham-spanier\/\" target=\"_blank\" rel=\"noopener\">statement<\/a>. &#8220;Let it be known\u2014if you hurt kids or cover up child abuse\u2014my office will\u2063 act and you will be held accountable.&#8221;<\/p>\n<p>Michael Gillum, the psychiatrist for one of Sandusky\u2019s victims, \u200dtold the <em>Washington Free Beacon<\/em> that\u200c his client &#8220;would \u200chave\u2064 never been raped&#8221; had Spanier informed authorities of Sandusky\u2019s crimes in 2001.<\/p>\n<p>&#8220;All \u200dthe Penn State conspirators actively covered up and failed to report horrific\u2062 child abuse,&#8221; Gillum said. &#8220;They are indirectly \u2064responsible for hundreds of counts of the rape of children that\u200c occurred after they had the knowledge of what Sandusky was doing.<\/p>\n<h3>Controversy Surrounding Mehalchick&#8217;s Nomination<\/h3>\n<p>Republicans\u2063 have \u200cstrongly criticized Mehalchick \u200dfor her handling \u200dof the Spanier case during a Senate Judiciary Committee \u2062hearing last month. Sen. Ted Cruz (R., Texas) said Mehalchick\u2019s nomination was part of\u2063 a &#8220;repeated pattern of showing excessive\u2064 leniency to \u200bcriminals.&#8221; Sen.
