He added that once the \u2063candidate applies according to the proper procedures, their name &#8220;will appear on the ballot.&#8221;<\/p>\n<p>He further expressed concerns \u2063about \u2063the potential chaos and confusion if some states disqualify a candidate while others allow \u2064their name on the \u200cballot, \u200cstating, \u200d&#8221;there\u2019s going to be chaos, confusion, \u2063anger, and frustration.&#8221;<\/p>\n<p>Mr.\u200b Scanlan clarified that the U.S. Supreme Court is the only\u200b authority that can make a determination on this matter, and any constitutional disqualification would have to apply &#8220;across the board&#8221; \u2064in\u2063 all 50 states or not \u2064at all.<\/p>\n<p>&#8220;At a time\u200d when\u2064 we need U.S.\u2064 election officials to\u200d ensure transparency and build confidence among voters around \u200bthe country, the delegate selection process should not be the battleground to test \u2063this constitutional question,&#8221; he added.<\/p>\n<p>New Hampshire GOP Chairman \u2063Chris Ager\u200c told Fox News that \u200che considered the \u206314th Amendment arguments &#8220;a complete waste of time&#8221;\u2062 and that the party would \u200chave intervened in any \u2064legal action\u2062 brought \u200cforth in the \u200bstate.<\/p>\n<div class=\"my-5\">&#8220;I&#8217;m \u200cglad that we&#8217;ve put it to bed here in\u2064 New Hampshire,&#8221;\u200c he \u200d <a href=\"https:\/\/twitter.com\/steinhauserNH1\/status\/1701980542307041699?s=20\" target=\"_blank\" rel=\"noopener\">said<\/a>.<\/div>\n<div class=\"my-5\">Liberal groups have been trying to drum up \u2064support for the idea of \u200b <a href=\"https:\/\/www.theepochtimes.com\/us\/pulling-out-every-stop-activists-looking-to-disqualify-trump-under-14th-amendment-5382397\" target=\"_blank\" rel=\"noopener\">barring<\/a> President Trump from reelection,\u2062 arguing that his actions on\u2064 Jan.\u200c 6, 2021, constituted an insurrection \u2063or rebellion, which \u2062under the post-Civil\u2063 War amendment would disqualify someone from holding office.<\/div>\n<p>But secretaries \u200dof state have not warmed to the idea, arguing this\u2062 is not within their \u2063jurisdiction.<\/p>\n<div class=\"my-5\">Late August, Arizona Secretary of State Adrian Fontes said he could not remove \u2063President Trump&#8217;s name \u200cfrom the \u2063ballot under state law, while also calling the law &#8220;<a href=\"https:\/\/www.theepochtimes.com\/us\/arizona-election-chief-on-14th-amendment-in-trump-eligibility-debate-you-cant-enforce-it-5483649\" target=\"_blank\" rel=\"noopener\">stupid<\/a>&#8221; because of its broad coverage.<\/div>\n<div class=\"my-5\">Last week, Minnesota\u200c Secretary\u200b of State Steve Simon similarly said on\u200d NPR that\u200c this\u2063 was also not\u2062 something he had the \u200cauthority to do, saying the \u2062state\u2063 law\u2062 instead allows \u2063&#8221;<a href=\"https:\/\/www.theepochtimes.com\/us\/minnesota-joins-states-trying-to-keep-trump-off-the-ballot-5490122\" target=\"_blank\" rel=\"noopener\">any individual<\/a>&#8221; to bring \u2062forth a petition, after which \u2062a judge could rule \u200dto strike a candidate from the ballot. Four days\u200d later, a\u2062 liberal group filed such a suit.<\/div>\n<div class=\"my-5\">Earlier, such a petition was thrown out in Florida after an\u2063 Obama-appointed judge said she l<a href=\"https:\/\/www.theepochtimes.com\/us\/obama-appointed-judge-throws-out-attempt-to-keep-trump-off-of-florida-ballot-5484926\" target=\"_blank\" rel=\"noopener\">acked jurisdiction<\/a>.<\/div>\n<div class=\"my-5\">In <a href=\"https:\/\/www.theepochtimes.com\/us\/group-files-suit-to-keep-trump-off-the-colorado-ballot-5487272\" target=\"_blank\" rel=\"noopener\">Colorado<\/a>, a petition is still pending. Meanwhile, legal experts are arguing for both sides\u200b of \u200cthe issue.<\/div>\n<h2>Debate in New Hampshire<\/h2>\n<p>In recent days,\u200b arguments over disqualifying President Trump \u200bin the early \u200cprimary state reached new heights.<\/p>\n<p>A\u200c New Hampshire attorney, Bryant Messner, had\u2063 brought the idea \u200cto Mr. Scanlan last \u200bmonth, leading to politicians voicing their\u200b support for or against \u200dthe \u2062idea. \u2064Mr. Scanlan maintained that it was a decision for the courts, \u2062but\u200b by\u200b Tuesday, Sept. 12, the Trump Campaign sent a letter \u2064to his office signed by 81 New Hampshire state officials and former U.S. Senator Bob Smith.<\/p>\n<div class=\"my-5\">&#8220;There is no legal \u200cbasis for these claims to hold \u200bup in any \u2062legitimate court of law,&#8221; they <a href=\"https:\/\/www.donaldjtrump.com\/news\/bd27c003-0584-41be-96db-35825a9bcdde\" target=\"_blank\" rel=\"noopener\">wrote<\/a>. &#8220;The opinions of those perpetuating this fraud against the will of\u2062 the people are nothing more than a \u2064blatant attempt to affront democracy and disenfranchise\u2062 all voters and\u2063 the former President.&#8221;<\/div>\n<div class=\"my-5\">They dismissed the 14th Amendment strategy as a political attack and &#8220;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nyt-pretends-to-debunk-poll-worker-conspiracy-one-day-later-the-election-deniers-were-vindicated\/\" title=\"NYT Pretends To Debunk Poll Worker \u2018Conspiracy.\u2019 One Day Later, The \u2018Election Deniers\u2019 Were Vindicated\">absurd conspiracy theory<\/a>,&#8221; urging New Hampshire to live \u2064up to\u200b its historic\u200d patriotism by invoking the \u20631776 revolution.<\/div>\n<h2>&#8216;Dangerous&#8217; Precedent<\/h2>\n<p>The groups arguing that President Trump\u200d participated in an &#8220;insurrection&#8221; point<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>New Hampshire Secretary of State, David Scanlan, stated that the 14th Amendment does not provide a legal foundation to exclude former President Donald Trump from the 2024 primary ballot.
