9\/8\/2023<\/li>\n<\/ul>\n<\/blockquote>\n<p>Ms. Powell isn\u2019t alleged to have partaken in those activities, but rather of getting a\u2062 data forensic company to access and copy \u200bdata from election \u200dmachines \u2064and computers in Coffee County, Georgia,\u2063 without authorization on Jan. 7,\u2064 2021.<\/p>\n<p>Based on those allegations, Ms. Powell faces charges of a racketeering conspiracy, conspiracy to\u200c commit election fraud, conspiracy to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-surrenders-released-on-100000-bond-in-georgia-trump-case\/\" title=\"Sidney Powell surrenders, granted 0,000 bond in Georgia Trump case.\">commit computer theft<\/a>, conspiracy to commit computer trespass, conspiracy to commit computer invasion of privacy, and conspiracy to defraud the state.<\/p>\n<p>Ms. Powell\u2019s lawyer, Brian Rafferty, vehemently denied the allegations.<\/p>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/div>\n<p>\u201cNo \u200ddata was \u2062stolen, there was\u2064 no fraud, and \u2064nothing \u200bwas done without authorization,\u201d the <a href=\"https:\/\/www.documentcloud.org\/documents\/23976577-091323-powell-general-demurrer\" target=\"_blank\" rel=\"noopener\">Sept. 13 motion\u2063 says<\/a>.<\/p>\n<p>\u201cBecause the\u200b State cannot prove an essential element of each \u2062offense, these\u200c Acts and Counts of the Indictment must be\u2063 dismissed.\u201d<\/p>\n<p>The motion says that \u201cboth the Election Supervisor for the \u200bcounty \u2062and the Board\u2064 authorized the review\u201d and that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-asks-judge-to-dissmiss-her-from-trump-georgia-suit\/\" title=\"Sidney Powell seeks dismissal from Trump's Georgia lawsuit.\">state regulations entrust county election officials<\/a> with election equipment\u200c maintenance.<\/p>\n<p>\u201cOne only needs common sense to know that\u200b when permission is given to engage in the conduct being prosecuted, there can be no crime,\u201d it says.<\/p>\n<p>The indictment alleged that Ms. Powell paid the forensic firm, SullivanStrickler, \u2062and &#8220;caused&#8221; it to perform the work in Coffee County. But Mr. Rafferty\u2063 suggested\u2064 that\u2062 she\u2064 didn\u2019t specifically authorize the firm to \u2064do it.<\/p>\n<p>\u201cNo one actually involved or present \u200dfor the Coffee County review had spoken\u2062 to Ms. Powell about any of it,\u201d he argued.<\/p>\n<p>\u201cMs. Powell\u2019s counsel also believes\u2063 there are text messages and other documents, including grand \u2063jury testimony \u2026 that not only show authority was given, but also demonstrate that Ms. Powell did not agree with anyone to access the \u200cCoffee County machines.\u201d<\/p>\n<p>Because all the alleged offenses require some form of criminal intent, such as willfulness or \u2062lack of \u200dauthorization, they cannot stand when the people involved believed they had \u2063the requisite permissions, according to Mr.\u2064 Rafferty.<\/p>\n<p>\u201cThe \u200cState has not pled facts to show\u2062 and cannot prove an \u2063essential element of each \u2064of these offenses: that Ms. Powell knew they were done without authority, that anything was\u200c stolen, or there was any \u2018fraud,\u2019\u201d he said.<\/p>\n<p>Last week, Mr. Rafferty asked the court\u2063 to try \u2063Ms. Powell separately to avoid evidence presented against other co-defendants to prejudice the jury against her.<\/p>\n<p>\u201cMs. Powell\u2019s name appears maybe a\u200d dozen times in this indictment. She has nothing to do \u200dwith \u2063the electoral college aspects of\u200d this which is going to involve all sorts of complex testimony about constitutional issues and things of that nature. Her only\u200d involvement, as alleged by the government, is what happened in Coffee County and even that they have wrong,\u201d he said.<\/p>\n<p>Ms. Powell and\u2063 another defendant, Kenneth Chesebro, \u2063have asked for a speedy trial, while President Trump has\u200d waived his right to a speedy trial, setting the stage for \u2063Ms. Powell and \u2063Mr. \u2063Chesebro\u2063 to be tried separately, coming Oct.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Sidney Powell, the ex-prosecutor who contested the 2020 election, seeks dismissal of her involvement in the Georgia case against Donald Trump.
