This ruling reiterates that the Obama-era\u200d federal policy is unlawful and should have originated\u2063 from Congress. However,\u2064 it does not require \u2062immediate action against current DACA beneficiaries.<\/p>\n<p>Texas\u200c and eight\u2063 other states have actively opposed DACA, arguing that the \u2062Obama \u200dadministration exceeded its \u200dauthority by creating the program in 2012 without\u2062 Congress&#8217;s involvement. They also claim that President Joe Biden overstepped his authority by renewing it in 2022, bypassing Congress.<\/p>\n<p>The nine Republican-led states have \u2062requested the court to phase \u2063out the program over two years, asserting that the Biden administration&#8217;s revised version \u200bis &#8220;substantively unlawful&#8221; for the\u200d same reasons\u200b as the original\u200d DACA Memorandum.<\/p>\n<p>&#8220;The Court should declare\u200c it unlawful and unconstitutional, vacate \u200dit in its entirety, and permanently enjoin \u200cits implementation (with a prudent transition for existing DACA recipients),&#8221; their lawsuit stated.<\/p>\n<p>Approximately 800,000 individuals are believed to\u200c be recipients of DACA, with two-thirds of them aged \u200dbetween 21 to 30. These individuals have lived\u200b and worked in \u2064the United States for most of \u200dtheir lives after illegally entering as young children.<\/p>\n<p>The plaintiff states in the case also argue that they bear substantial costs, including hundreds of millions of dollars for healthcare and education, when immigrants are allowed to remain in the country \u200bwithout legal status.<\/p>\n<p>In 2021, \u200bJudge Hanen, an appointee of President \u200dGeorge W. Bush, declared\u200d the program illegal due to its lack of compliance with\u200d required\u2063 public notice and comment periods. This decision \u2064was upheld by the Fifth Circuit Court of Appeals in 2022.<\/p>\n<p>In\u200c an attempt to address the judge&#8217;s concerns, President Biden announced the renewal of the DACA\u200d program in August 2022,\u200b making it a federal \u2062regulation. It came \u2063into effect in October, subject to public comments in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-again-declares-daca-program-unlawful\/\" title=\"DACA Program Ruled Unlawful by Federal Judge Again.\">formal rule-making process<\/a>, replacing former President Barack Obama\u2019s 2012 memo\u2062 that initially established\u200d DACA.<\/p>\n<p>At the time, Secretary of\u200b Homeland Security Alejandro Mayorkas expressed\u2064 the \u2063administration&#8217;s commitment to preserving and\u2063 fortifying DACA, stating that\u2063 the United States has been enriched by\u200b the young people on the program, commonly referred\u2064 to as &#8220;Dreamers,&#8221; who have known\u200c no\u2062 country other than the\u200c United States as \u2063their own.<\/p>\n<p>However, the plaintiff states argued that President\u200b Biden exceeded his constitutional authority\u2064 by renewing DACA without congressional approval.
