9\/8\/2023<\/li>\n<\/ul>\n<\/blockquote>\n<p>Ms. Powell isn\u2019t alleged to have partaken in those activities, but rather of getting a data forensic company to access and copy data from election \u200dmachines and computers in Coffee County, Georgia, without authorization on Jan. 7, \u20622021.<\/p>\n<p>Based on those\u200c allegations, Ms. Powell faces charges of \u2062a \u2062racketeering conspiracy, conspiracy to commit \u200celection fraud, conspiracy to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-surrenders-released-on-100000-bond-in-georgia-trump-case\/\" title=\"Sidney Powell surrenders, granted 0,000 bond in Georgia Trump case.\">commit computer theft<\/a>, conspiracy to commit computer trespass, conspiracy to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/key-takeaways-from-trump-being-indicted-in-expansive-georgia-rico-case\/\" title=\"Key points from Trump's indictment in Georgia RICO case\">commit computer invasion<\/a> \u2063of privacy, and \u2064conspiracy to defraud the state.<\/p>\n<p>Ms. Powell\u2019s lawyer, Brian Rafferty, vehemently denied the allegations.<\/p>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/div>\n<p>\u201cNo data was stolen, there was no fraud, and nothing was \u2062done without\u200b authorization,\u201d the <a href=\"https:\/\/www.documentcloud.org\/documents\/23976577-091323-powell-general-demurrer\" target=\"_blank\" rel=\"noopener\">Sept. \u206413\u2064 motion \u200dsays<\/a>.<\/p>\n<p>\u201cBecause the \u200dState cannot prove an essential element of each offense, these Acts and Counts of the Indictment must be dismissed.\u201d<\/p>\n<p>The motion says that \u201cboth the Election\u2063 Supervisor \u200dfor \u2063the\u2062 county and the Board authorized the review\u201d and that the\u200c <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-asks-judge-to-dissmiss-her-from-trump-georgia-suit\/\" title=\"Sidney Powell seeks dismissal from Trump's Georgia lawsuit.\">state regulations entrust county election officials<\/a> with election equipment maintenance.<\/p>\n<p>\u201cOne only needs common sense to \u200cknow\u200c that when permission is given to engage in the conduct being prosecuted, \u2064there can be\u200d no crime,\u201d\u200c it says.<\/p>\n<p>The indictment alleged that Ms. Powell paid the forensic firm, SullivanStrickler, and\u2064 &#8220;caused&#8221; it\u200d to\u2063 perform the work in Coffee\u2064 County. But Mr. Rafferty suggested\u200b that she didn\u2019t specifically authorize the firm to do it.<\/p>\n<p>\u201cNo one actually involved or \u2063present for the Coffee \u2063County review had spoken to Ms.\u2064 Powell about any of it,\u201d he argued.<\/p>\n<p>\u201cMs. Powell\u2019s counsel also \u2062believes there are text messages\u200c and other documents, including grand jury \u2064testimony \u2026\u200b that not only show\u2062 authority\u2062 was given, but also demonstrate that Ms. Powell did not agree with anyone to access\u2062 the Coffee County machines.\u201d<\/p>\n<p>Because all the alleged offenses require some form of\u2063 criminal\u2064 intent, such\u2063 as willfulness \u200bor lack of authorization, they cannot stand \u200dwhen the people involved believed they had the requisite permissions, according\u2064 to Mr. \u2063Rafferty.<\/p>\n<p>\u201cThe State has not pled facts to \u200dshow and cannot prove an essential element of\u2063 each of these offenses: that Ms. Powell knew they were done without authority, that anything was stolen, or there was any\u2064 \u2018fraud,\u2019\u201d he said.<\/p>\n<p>Last week, Mr. Rafferty asked the court to try \u2062Ms. Powell separately to avoid evidence \u200bpresented against other co-defendants to \u2063prejudice the jury against her.<\/p>\n<p>\u201cMs.\u2063 Powell\u2019s name appears maybe a dozen times \u2062in this indictment.\u2063 She has nothing\u2062 to do\u200c with \u200cthe electoral college aspects of this \u2064which is going to involve all sorts of complex testimony about constitutional issues and things of that nature.
