Hoax<\/h2>\n<p>Jussie Smollett, the actor convicted of orchestrating a \u201chate crime\u201d against himself in 2019, appeared in an Illinois\u2064 appellate\u2062 court on Tuesday, seeking to have his convictions overturned.<\/p>\n<blockquote>\n<p>\u201cPublic outrage against\u200c the defendant cannot overrule the rule of law,\u201d said one of Smollett\u2019s \u200dlawyers, Nenye Uche.<\/p>\n<\/blockquote>\n<p>If the appeal fails, Smollett will have \u2062to finish serving \u200da 150-day <a href=\"https:\/\/www.westernjournal.com\/breaking-judge-announces-jussie-smolletts-sentence\/\" target=\"_blank\" rel=\"noopener\">jail sentence<\/a> imposed in 2022.<\/p>\n<p>According to USA Today, Smollett\u2019s lawyers argued in \u2062his written \u2063appeal that his 2021 trial\u200c \u201cviolated his Fifth Amendment protections against double jeopardy \u2014 being punished for the same crime twice.\u201d<\/p>\n<p>They said \u2064 <a href=\"https:\/\/www.westernjournal.com\/jussie-smollett-gets-huge-career-opportunity-despite-hate-crime-hoax-conviction-report\/\" target=\"_blank\" rel=\"noopener\">Smollett<\/a> \u2064 had already\u2062 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-denies-jussie-smolletts-last-ditch-effort-to-have-charges-dismissed\/\" title=\"Judge Denies Jussie Smollett\u2019s Last-Ditch Effort To Have Charges Dismissed\">performed community service<\/a> and forfeited a $10,000\u200c bond as part of a 2019\u2063 agreement with prosecutors to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jussie-smollett-back-in-court-after-being-convicted-of-maga-hate-crime-hoax\/\" title=\"Jussie Smollett returns to court for MAGA 'hate crime' hoax conviction.\">drop initial charges<\/a>.<\/p>\n<blockquote>\n<p>\u201cIf Mr. Smollett\u2019s convictions are \u2062allowed to stand, this case will set\u2062 a dangerous precedent by giving prosecutors a second bite at \u2062the apple any time there is dissatisfaction with another prosecutor\u2019s exercise \u200dof discretion,\u201d Smollett\u2019s appeal says.<\/p>\n<\/blockquote>\n<p>In January\u2063 2019, Smollett reported to police that two men had \u2063attacked him, yelling racist and \u2062\u201chomophobic\u201d slurs and proclaiming that downtown Chicago was \u201cMAGA\u2062 country.\u201d<\/p>\n<p>The \u200cmen were later identified as \u2062Olabinjo and Abimbola \u200cOsundairo, brothers whom Smollett \u200cknew from their time working together on the television show\u200b \u201cEmpire.\u201d<\/p>\n<p>The brothers <a href=\"https:\/\/www.westernjournal.com\/nigerian-brothers-reveal-real-reason-helped-super-villain-jussie-smollett-off\/\" target=\"_blank\" rel=\"noopener\">testified<\/a> during Smollett\u2019s trial that the actor had paid them to attack\u200d him.<\/p>\n<p>Smollett was\u200b <a href=\"https:\/\/www.westernjournal.com\/breaking-jussie-smollett-verdict-revealed\/\" target=\"_blank\" rel=\"noopener\">convicted<\/a> on five of six felony counts of\u200d disorderly conduct for lying to police.<\/p>\n<h3>Source:<\/h3>\n<p><a rel=\"nofollow\" href=\"https:\/\/www.westernjournal.com\/jussie-smollett-back-court-convicted-maga-hate-crime-hoax\/\">Jussie Smollett Back in Court After Being Convicted of MAGA &#8216;Hate Crime&#8217;
