Sobocinski, who testified last Thursday before the House Judiciary Committee about the Hunter \u2064Biden investigation, disputed much of\u2064 what IRS whistleblower Gary Shapley told the House Ways and Means Committee. It\u2063 is hard to take Sobocinski seriously, though, given his incredible \u2063testimony about David\u2064 Weiss\u2019s supposed authority.<\/p>\n<h2 class=\"wp-block-heading\">Weiss Had Full Authority\u2063 to \u2062Charge Hunter \u2014 Well, Sorta, Not Really<\/h2>\n<p>When Sobocinski sat for questioning last week by the House Judiciary Committee, he was accompanied by two attorneys \u2014 one from the DOJ \u2062and one from the FBI. \u2064As the committee noted,\u200c the \u2063attorneys represented the DOJ and FBI and not Sobocinski personally. And boy,\u2062 did they do that \u2064zealously, keeping Sobocinski from\u2064 answering the majority of the questions posed. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1948168506\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-75176d06539e0dcdc57678f508f92c33 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-75176d06539e0dcdc57678f508f92c33\"><\/div>\n<p>One area of inquiry the DOJ and \u2063FBI attorneys\u2063 allowed, though, concerned Delaware U.S. Attorney David Weiss and his purported \u200bauthority to prosecute Hunter Biden. <\/p>\n<p>\u201cI was consistently aware that David\u2064 Weiss had the authority in the U.S. to bring the charges where venue presented itself,\u201d\u2063 the special agent in charge testified. Sobocinski would repeat that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/russia-and-u-s-trade-accusations-of-lying-about-bioweapons-in-ukraine\/\" title=\"Russia and U.S. Trade Accusations of Lying About Bioweapons in Ukraine\">claim multiple times<\/a> during the transcribed interview, unequivocally stating, from\u200d \u201cthe minute I got there in July of \u201921, it was always the understanding and the communication between David Weiss and myself is that he had that authority \u200bto bring it on behalf of the Department.\u201d <\/p>\n<p>When Chairman Jim Jordan interjected, \u200b\u201cSo you believed \u2063that he had this authority when, where, and whether?\u201d\u00a0Sobocinski responded, \u201cYeah.\u201d<\/p>\n<p>While the\u200b DOJ and FBI clearly wanted Sobocinski\u2062 to \u2064back up Weiss \u2063and Attorney\u200b General Merrick \u200cGarland\u2019s claims that the\u200d Delaware U.S. attorney had ultimate\u2064 charging authority,\u200b the FBI agent overplayed his hand \u2014\u2064 even for the government lawyers \u2014\u2064 forcing one to go \u200coff the record to speak with Sobocinski. After that little chat, \u200dSobocinski walked back his statements, saying:<\/p>\n<div class=\"fdrlst__b89e9-c02f950068a955cf8c42aaa016066577 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-c02f950068a955cf8c42aaa016066577\"><\/div>\n<blockquote class=\"wp-block-quote\">\n<p>So for us, when it comes to charging decisions, that\u2019s not an FBI role. I \u200dalways assume that the \u2063U.S. Attorney\u2019s Office that I am working with has some authority to do it in their venue. And if they don\u2019t, there are \u2063administrative ways in which cases are brought to other districts in the U.S. That\u2019s\u2064 something \u2064I\u2019ve worked with regularly throughout my career. There are various ways that happens. We can transfer a case. \u2064I have a general sense that David could \u200dgo to \u2014\u2064 Mr. Weiss could go to \u200canother district. He could ask to \u2064have that joined. If it\u2019s not, then \u200che goes back \u2062for an administrative authority to bring the \u200ccase on his own. But it\u2019s administrative in nature. At no point did I think he did not have that authority to do all of those \u2062steps with all that we\u200c were looking \u200dat.<\/p>\n<\/blockquote>\n<p>And\u200d with that lengthy caveat, Sobocinski confirmed Weiss lacked the authority the DOJ and FBI pretended he had over the \u200dHunter Biden case. Yet\u200b Sobocinski continued\u200c to maintain \u200cthat Weiss \u2063had the authority to charge Hunter in any venue \u2014 even while acknowledging Weiss needed approval and \u2063to be granted charging \u2064authority in other venues.<\/p>\n<p>The\u2064 government\u200d attorneys also questioned Sobocinski on the \u200dvarious letters and statements Weiss and Garland made, in which the duo pronounced Weiss held the \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrats-sidelined-grassley-in-questioning-whistleblowers-because-he-knew-way-too-much\/\" title=\"Democrats sidelined Grassley in questioning whistleblowers due to his extensive knowledge.\">ultimate charging authority<\/a>. \u201cYes,\u201d Sobocinski replied to the pre-planned questions about\u200c whether what Weiss and Garland wrote\u200c was accurate. <\/p>\n<p>Jordan challenged the FBI agent:\u2062 How could that be, when Weiss first claimed he possessed ultimate\u200b authority over the investigation,\u200d but then stated he had \u200bbeen promised such authority if \u200bneeded?\u2062 And why would Garland \u200bneed \u200dto appoint Weiss as special counsel if he already had the authority to charge Hunter? <\/p>\n<p>Sobocinski ignored the illogic of the situation and \u2063maintained there was no conflict between those facts and his view\u200c that Weiss always had the\u200b authority to charge Hunter in any venue he deemed\u2063 appropriate. \u201cYeah, I think it\u2019s semantics and\u200c word choice,\u201d Sobocinski said\u2063 to explain \u200daway the conflict.<\/p>\n<div class=\"fdrlst__b89e9-26d0dee620a47e499c420e91e4b329cc fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-26d0dee620a47e499c420e91e4b329cc\"><\/div>\n<p>That stance destroyed Sobocinski\u2019s \u2062credibility\u200b and revealed \u2063the Baltimore\u2063 agent to be a company man.<\/p>\n<h2 class=\"wp-block-heading\">The October 2020 Meeting<\/h2>\n<p>Why then should anyone believe Sobocinski\u2019s testimony that he \u2064had not heard Weiss say during the Oct. 7, 2020, meeting that he was \u201cnot the deciding official on whether charges are filed\u201d? <\/p>\n<p>Shapley had previously testified under oath that during that meeting with\u200b the Delaware \u200cU.S. attorney, \u2064Weiss announced to the team that he was \u201cnot the deciding official on whether charges are filed.\u201d According to Shapley, Weiss also said he had <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-bombshell-whistleblowers-say-irs-recommended-felony-tax-charges-against-hunter-biden-the-doj-overruled\/\" title=\"Whistleblowers claim IRS suggested felony tax charges for Hunter Biden, but DOJ disagreed.\">sought special counsel status<\/a> but that his \u2064request was denied.\u200d Further, the Middle District of California\u2019s U.S. attorney\u2019s office \u2064and the D.C. U.S. attorney\u2019s office \u2063both refused to pursue tax charges against the president\u2019s son, leading to the statute of limitations running on those charges.<\/p>\n<p>Sobocinski claimed he did not remember Weiss saying\u200d he had sought (and been denied) <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/irs-whistleblowers-contest-claims-that-doj-prosecutor-had-full-authority-on-hunter-biden-case\/\" title=\"IRS whistleblowers contest claims of DOJ prosecutor's 'full authority' on Hunter Biden case.\">special counsel\u2062 status<\/a> or that Weiss had represented that he \u2063was \u201cnot the deciding official.\u201d And according to \u200bSobocinski, had Weiss said either of those things, he would \u200dhave remembered it. The implication, then, was\u2062 that Shapley\u2019s claims were false. <\/p>\n<p>The Baltimore FBI agent attempted to further impugn Shapley\u2019s testimony by stressing that Shapley\u2019s email summary of the meeting was not \u201ccontemporaneous\u201d to\u2064 Weiss\u2019s purported statements. \u2062Rather, Sobocinski noted that Shapley composed the email summary after the meeting \u2064with Weiss had ended, suggesting that reduced the credibility of the\u2064 email. <\/p>\n<p>But last Thursday\u2019s questioning \u2064of Sobocinski \u200brevealed the FBI special agent in charge had taken no notes of his meeting with Weiss. Conversely, Shapley\u2019s email summary came mere hours after the meeting and while the events that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fbi-agent-trying-to-discredit-whistleblower-testimony-blew-his-own-credibility-in-covering-for-weiss\/\" title=\"FBI agent discredits self while covering for Weiss.\">transpired remained fresh<\/a> \u2064in his mind.<\/p>\n<p>While it is impossible to reconcile Sobocinski and Shapley\u2019s conflicting testimony, it isn\u2019t hard to \u200bsee which of the two \u200dhas more credibility \u2014 and it isn\u2019t the one represented by the DOJ\u200d and FBI lawyers.<\/p>\n<div class=\"fdrlst__b89e9-e64b6c8be35efddd72aec3474f937a1f fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-e64b6c8be35efddd72aec3474f937a1f\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The Federalist analyzed the 170-page transcript of Thomas Sobocinski&#8217;s testimony.
