(DOJ via\u200c The Epoch Times)<\/figcaption><\/figure>\n<\/p><\/div>\n<div class=\"my-5\">\n<h2>&#8216;Violent Rhetoric, Disinformation About the Election&#8217;<\/h2>\n<p>    CCTV footage captured Mr. Shroyer within the restricted area on both the west and east sides of the Capitol, prosecutors said.<br \/>\n \u2064\n  <\/p><\/div>\n<div class=\"my-5\">\n<p>    \u200c In separate court documents (<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.234903\/gov.uscourts.dcd.234903.46.0.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) prospectors also accused Mr. Shroyer of having &#8220;stoked the fire of hundreds of thousands of his followers&#8221; online and via his show with &#8220;violent rhetoric and disinformation about the\u2064 election leading\u200d up to January 6 and during a march he helped lead to \u200bthe restricted grounds.&#8221;<br \/>\n \u200d\n  <\/div>\n<p>Additionally, they said Mr. Shroyer &#8220;praised\u200c the actions of the rioters \u200bat the Capitol after January 6 on his online streaming \u200dshow&#8221; after the breach.<\/p>\n<p>Prosecutors also noted that Mr. Shroyer \u200chad an active order to stay \u200baway from the Capitol and its grounds as of Jan. 6, 2021 for a pending case \u2062of\u200c disorderly conduct on those grounds.<\/p>\n<div class=\"my-5\">\n<p>    Lawyers for Mr. Shroyer previously <a href=\"https:\/\/www.theepochtimes.com\/us\/infowars-host-owen-shroyer-pleads-guilty-to-entering-restricted-area-on-jan-6-post-5354520\" target=\"_blank\" rel=\"noopener\">argued<\/a> he was attending the Jan. 6 breach in a journalistic capacity to observe the situation and report on\u200b it, stressing that he did not engage \u200cin violence or in any attempt\u2062 to impede or\u2064 obstruct.\n  <\/div>\n<div class=\"post-figure\">\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Owen Shroyer, an InfoWars host, in an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/houston-dea-finds-dramatic-increase-in-drugs-laced-with-fentanyl\/\" title=\"Houston DEA finds dramatic increase in drugs laced with fentanyl\">undated file photo<\/a>. (Drew Angerer\/Getty\u2062 Images)<\/figcaption><\/figure>\n<\/p><\/div>\n<div class=\"my-5\">\n<h2>&#8216;No Justification\u2064 for His Conduct&#8217;<\/h2>\n<p>    Elsewhere, his defense team argued in court filings (<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.234903\/gov.uscourts.dcd.234903.48.0.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) that\u2062 the case had \u2064been &#8220;characterized by \u200ca cooperative spirit between\u2064 the defense and \u2063the \u200dGovernment,&#8221; \u2062noting that\u200c their client had \u2064allowed prosecutors to inspect his cellphones\u2063 without a warrant, had waived his right to \u2062remain silent, and instead spoken to prosecutors.\n  <\/div>\n<p>&#8220;After inspecting the contents of his phone, federal investigators questioned Mr. Shroyer about the messages, what he knew about the planning of events leading\u200d up to and including January 6, 2021, and his\u200c awareness of other participants in illegal activity \u200bthat day,&#8221; his lawyers wrote.<\/p>\n<p>Mr. Shroyer had nothing of value to offer prosecutors in their larger efforts to determine whether the events of January\u200c 6, 2021, were \u2064part of a larger \u200dscheme, or were, rather, as Mr. Shroyer \u2062saw it, nothing\u2063 more than a protest turned into a riot,&#8221; they added.<\/p>\n<p>&#8220;Mr. Shroyer claims no justification for his conduct simply because he believed the\u200c president,&#8221; his lawyers continued. &#8220;But when Mr. Shroyer appeared \u200cat the Capitol \u200don January 6, 2021,\u2062 he wore\u2062 two hats: one was that of an outraged citizen\u2062 who \u200dbelieved that an election had been rigged, the\u200b other as <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/infowars-host-owen-shroyer-gets-60-days-in-prison-in-j6-related-case\/\" title=\"InfoWars host Owen Shroyer sentenced to 60 days in J6-related case.\">full-time journalist<\/a> and commentator who sought a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/how-non-fungible-tokens-and-blockchain-are-changing-the-art-and-music-worlds\/\" title=\"How Non-Fungible Tokens And Blockchain Are Changing The Art And Music Worlds\">front-row seat<\/a> at\u200c a historic event.&#8221;<\/p>\n<p>However, in his ruling\u200b Wednesday, Judge Kelly said Mr. Shroyer &#8220;was not\u2064 merely at the building but he also did play a \u200drole in amping up the crowd on the steps \u2063that day,&#8221; by leading chants through a megaphone.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Infowars host Owen Shroyer, known for &#8220;The War Room With Owen Shroyer,&#8221; received a 60-day prison sentence on Sept. 12 for involvement in the Jan. 6 Capitol breach.
