Giuliani&#8217;s Strategy<\/h2>\n<p>On\u2062 Monday, attorneys for former President Donald Trump filed a number of motions to dismiss charges he faces in Georgia over his decision to \u2064challenge the \u200dstate\u2019s 2020 election results.<\/p>\n<p>Fulton County District Attorney \u200d <a href=\"https:\/\/www.westernjournal.com\/fani-willis-lashes-jim-jordan-claims-house-judiciary-investigation-attempt-obstruct-trump-indictment\/\" target=\"_blank\" rel=\"noopener\">Fani Willis<\/a> has accused Trump and 18\u200c codefendants of election interference.<\/p>\n<p>Trump himself faces 13 counts, including an alleged violation of the state\u2019s racketeering\u2064 laws.<\/p>\n<p>In a pair of legal motions,\u200d Trump\u2019s legal \u200dteam used \u2062an argument \u2064made by \u200blegal representatives for attorney <a href=\"https:\/\/www.westernjournal.com\/trump-attorney-puts-judge-notice-new-court-filing-considering-bold-move\/\" target=\"_blank\" rel=\"noopener\">Kenneth Chesebro<\/a>, according to <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-files-motions-dismiss-charges-georgia-case-rcna104538\" target=\"_blank\" rel=\"noopener\">NBC News<\/a>.<\/p>\n<p>Chesebro helped architect Trump\u2019s strategy as\u200b it pertained to attempting \u2062to delay the certification of Georgia\u2019s electoral votes.<\/p>\n<blockquote>\n<h3>Supremacy Clause Argument<\/h3>\n<p>Attorneys for Chesebro asked Fulton County \u2063Superior Court \u200cJudge Scott McAfee last \u2063week to dismiss his case, citing\u2062 the\u200d Supremacy Clause in \u2063the Constitution that prevents states\u2062 from stepping into areas of the \u200claw that are \u201centirely\u2064 within \u200dthe ambit of federal authority.\u201d<\/p>\n<p>According to <a href=\"https:\/\/www.law.cornell.edu\/wex\/supremacy_clause\" target=\"_blank\" rel=\"noopener\">Cornell Law School<\/a>, the Supremacy Clause \u201cestablishes that the federal constitution, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/levin-takes-counterview-trump-would-have-power-as-potus-to-pardon-himself-from-state-charges-too\/\" title=\"Levin disagrees: Trump can pardon himself from state charges as POTUS.\">federal law generally<\/a>, take precedence over state laws, \u200dand even state constitutions.\u201d<\/p>\n<p>The clause further \u201cprohibits states from interfering with the federal government\u2019s exercise of its constitutional powers, and from assuming any functions that are exclusively entrusted to the federal \u200dgovernment.\u201d<\/p>\n<\/blockquote>\n<p><a href=\"https:\/\/www.westernjournal.com\/ap-trump-moves-judge-chutkan-seeks-off-case-good\/\" target=\"_blank\" rel=\"noopener\">Trump\u2019s<\/a> legal team\u2064 made \u2064the same jurisdictional argument as Chesebro and said the Supremacy Clause\u2064 also applies to a RICO charge and charges of conspiracy he faces in Georgia.<\/p>\n<blockquote>\n<h3>Giuliani&#8217;s Motion<\/h3>\n<p>In another maneuver, Trump\u2019s\u2064 attorneys filed a \u2063<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/blackrock-should-lose-permission-to-invest-in-utilities-because-of-esg-pushes-republican-ags-say\/\" title=\"Republican AGs argue BlackRock should be banned from investing in utilities due to ESG initiatives.\">similar motion filed<\/a> by attorneys for Rudy Giuliani.<\/p>\n<p>NBC News did not specify what the motion was,\u2064 but <a href=\"https:\/\/www.cnn.com\/2023\/09\/08\/politics\/giuliani-georgia-election-interference-case-challenge\/index.html#:~:text=Rudy%20Giuliani%20has%20filed%20a,a%20hearing%20on%20the%20matter.\" target=\"_blank\" rel=\"noopener\">CNN<\/a> reported last week Giuliani\u2019s legal\u2062 team asked Judge McAfee to dismiss his charges or at the very least to \u200bconsider a hearing on the matter.<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/rudy-giulianis-aide-allegedly-key-rico-communications-vanished\/\" target=\"_blank\" rel=\"noopener\">Giuliani<\/a> \u2064argued the charges he faces in Fulton County unfairly attributed the practicing of his First Amendment to \u2063part of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-attorneys-file-to-dismiss-georgia-charges-adopt-rudy-giulianis-strategy\/\" title=\"Trump lawyers seek dismissal of Georgia charges, adopt Giuliani's strategy.\">broad criminal enterprise<\/a>.<\/p>\n<p>According\u2062 to CNN, the\u200d former New York City mayor\u2019s attorneys called \u2063Willis\u2019 indictment \u201ca\u2063 conspiratorial bouillabaisse consisting of purported criminal acts, daily activities, and constitutionally protected speech\u201d in the motion.<\/p>\n<\/blockquote>\n<p>McAfee, who is\u200b only 34-years-old, has been assigned to preside \u2064over the cases of Trump and those Willis\u200d has charged alongside him in the case<\/p>\n<p>The judge has not commented on the motions.<\/p>\n<p>He was <a href=\"https:\/\/www.ajc.com\/news\/meet-the-34-year-old-judge-who-will-oversee-trump-prosecution\/BSRME6N2DJFYDGZ3OGBOJUFUKA\/\" target=\"_blank\" rel=\"noopener\">appointed<\/a> to the bench in February by Republican\u2063 Georgia Gov. <a href=\"https:\/\/www.westernjournal.com\/gop-governor-shuts-plan-helped-trump-legal-battles\/\" target=\"_blank\" rel=\"noopener\">Brian Kemp<\/a>.<\/p>\n<p>\u201cHis experience as a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/who-is-scott-mcafee-judge-overseeing-trumps-georgia-election-probe\/\" title=\"Scott McAfee is the judge overseeing Trump's Georgia election investigation.\">tough prosecutor equips<\/a> him to search out fraud, \u2062waste,\u2062 abuse, and corruption, and bring those to\u2062 justice who break\u200c the\u200c law,\u201d Kemp said in <a href=\"https:\/\/gov.georgia.gov\/press-releases\/2021-03-30\/gov-kemp-names-mcafee-office-inspector-general\" target=\"_blank\" rel=\"noopener\">a statement<\/a> when he appointed McAfee
