She confirmed that the September 13 hearing is still listed as a pretrial conference.<\/p>\n<blockquote>\n<p>Mr. McAbee was arrested in\u2062 Nashville on August 17,\u2064 2021. Although United States Magistrate Judge\u2063 Jeffery \u200bFrensley in the Middle \u200dDistrict of Tennessee initially ordered his release pending trial, the U.S. Department of Justice filed an emergency motion to overturn the order. This motion was granted by U.S. District\u200d Judge\u2062 Emmet \u200cSullivan.<\/p>\n<\/blockquote>\n<p>During a\u200c detention hearing on September 22, 2021, in Washington,\u200b Judge Sullivan referred to Mr. McAbee and other protesters as &#8220;terrorists.&#8221; The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-sheriffs-deputy-ronald-mcabee-considering-jan-6-plea-deal-just-before-trial\/\" title=\"Ex-Sheriff's Deputy Ronald McAbee mulls plea deal ahead of Jan. 6 trial.\">judge \u200bspecifically mentioned<\/a> a video that appeared to show Mr. McAbee pulling a\u2063 police officer into the crowd, stating, &#8220;So it \u200cappears clearly to this court that the defendant is pulling the\u200d officer back into the crowd of other terrorists.&#8221;<\/p>\n<p>Prosecutors argued that Mr. McAbee \u200bhad\u2062 assaulted Metropolitan\u200c Police Department Officer Andrew Wyatt. They claimed that, despite having a broken shoulder from a car\u200b accident\u200d nine days prior, Mr. \u2064McAbee pulled the officer down the concrete stairs into a hostile crowd after he fell at the tunnel entrance.<\/p>\n<blockquote>\n<p>At the initial hearings, the bodycam video presented as evidence\u2064 did not include audio. However, on the audio, Mr. McAbee can be heard identifying himself as a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/georgia-secretary-of-state-investigating-voter-registration-group-run-by-democrat-raphael-warnock\/\" title=\"Georgia Secretary Of State Investigating Voter Registration Group Run By Democrat Raphael Warnock\">law enforcement officer<\/a> and offering to help Officer Wyatt. This contradicts the allegations made against him.<\/p>\n<\/blockquote>\n<p>Despite this evidence, Judge Sullivan refused to reconsider\u2062 his decision \u200cto\u200c keep Mr. McAbee in jail until\u2063 his trial. Eventually, Judge Sullivan was removed from the case, and it was reassigned to Judge Contreras.<\/p>\n<p>In September 2022, Mr. McAbee was maced and knocked to the ground by\u200d jail staff at\u200b the District of Columbia jail for not wearing a face mask while walking to obtain his medication.
