Michelle Lujan\u2064 Grisham&#8217;s order\u200d to suspend\u200b all forms of gun carry\u200d in and around \u2062the state&#8217;s largest city in the name of a &#8220;public health emergency&#8221; has already drawn multiple\u200d legal challenges.<\/p>\n<p>Citing the recent\u2063 shooting \u2064deaths of three children, including an 11-year-old boy killed outside a\u2062 minor league baseball park\u200b in\u2062 Albuquerque in a suspected road rage incident,\u2062 the\u2062 Democrat governor declared it would be illegal\u200d to open or conceal carry a gun in Albuquerque and \u2064surrounding areas in\u200d Bernalillo County, even for those\u2062 who\u2064 have valid permits.<\/p>\n<p>The order, which\u200d came a day after Ms. Grisham declared &#8220;gun\u200c violence&#8221;\u2062 a statewide public health \u200bemergency, is set to expire \u200bin 30 days but can \u2062be renewed. It applies to &#8220;cities or counties averaging 1,000 or more violent \u2062crimes per 100,000 residents per year\u2062 since 2021,&#8221; a criterion so far met only by Bernalillo County.<\/p>\n<blockquote>\n<h2>Legal Issues Growing<\/h2>\n<p>Ms. \u200cGrisham and several officials of her administration are \u2064facing multiple lawsuits. The latest legal effort to blocked the order was launched on Sept. 12 by the Second Amendment \u2063Foundation (SAF), a\u200d national advocacy group based in Washington state.<\/p>\n<\/blockquote>\n<p>Suing on behalf of a \u2064Bernalillo County \u200cgun owner, \u2064the SAF \u200cthat the &#8220;public health&#8221; order\u2063 runs afoul of the a recent landmark decision by the U.S. Supreme Court, which essentially affirmed that individuals have the right to carry firearms outside\u2064 their homes.<\/p>\n<p>In the \u2064high-profile 2022 case, which has come\u200b to be known as the Bruen\u200c decision, the \u2064high court struck down a New York requirement that concealed carry\u2063 applicants prove\u200b they have good cause\u2062 to carry a firearm, finding that\u2064 gun laws must be consistent with the \u200cUnited States&#8217; historical tradition to be considered \u2062constitutional.<\/p>\n<p>&#8220;The Supreme Court has recognized that, under the Second\u2064 Amendment, &#8216;ordinary law-abiding\u200c citizens have a &#8230; right to carry handguns in public for self-defense,'&#8221; the\u200b complaint read, citing the Bruen ruling.<\/p>\n<p>In addition to Ms. Grisham, the suit named New Mexico\u2064 Health \u200cSecretary \u2064Patrick Allen, \u200bPublic Safety Secretary Jason Bowie,\u200d and State Police Chief Troy\u200c Weisler\u200b as defendants.<\/p>\n<p>&#8220;Despite her clams to the contrary, Gov.\u2064 Grisham \u200bdoes not\u200c have the authority to &#8216;suspend&#8217; the Second Amendment for an alleged public health \u2062emergency or \u2062any other reason. Neither do\u2064 any of the other defendants, nor can they legally enforce such a suspension,&#8221;\u200c Alan Gottlieb, SAF&#8217;s founder and executive vice president, said in a statement to The Epoch Times.<\/p>\n<p>Two\u2062 earlier challenges\u200d were brought separately by the National Association for Gun Rights (NAGR) and \u2064Gun Owners of America\u200d (GOA), just one \u2062day after Ms. Grisham announced the restrictions.<\/p>\n<p>&#8220;The State must\u200c justify the Carry Prohibition by \u2064demonstrating that it is consistent with the Nation&#8217;s historical tradition of\u2064 firearm regulation,&#8221;\u200c the complaint filed by NAGR read. \u2064&#8221;But it is impossible for\u2064 the State to meet this burden, because there is no such historical tradition of firearms regulation in this Nation.&#8221;<\/p>\n<p>Meanwhile, GOA pointed to the\u2062 governor&#8217;s \u200bparadoxical statements at the Sept. 9 press conference. When asked whether she thought the 30-day ban would actually prompt criminals \u2063to stop carrying firearms, she responded, &#8220;No.&#8221; She would later tell \u2064the press that &#8220;responsible gun owners are\u2064 certainly not our problem.&#8221;<\/p>\n<p>&#8220;If law-abiding gun owners are not the problem, and criminals carrying guns will not obey the [public health order], then what\u200c is the purpose of\u2062 the Governor&#8217;s actions?&#8221; \u2064GOA stated in the lawsuit.<\/p>\n<blockquote>\n<p>&#8220;The answer \u200dis evident. The [public health order] serves no \u2063purpose other than to implement \u200ca \u200bradical\u200b political agenda to\u2064 punish law-abiding \u2064gun owners.&#8221;<\/p>\n<\/blockquote>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>New Mexico Gov.
