He&#8217;s maintained\u200b a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/poll-despite-floridas-even-split-between-gop-dems-desantis-has-strong-approval-rating-overwhelming-support-on-pandemic\/\" title=\"POLL: Despite Florida\u2019s Even Split Between GOP, Dems, DeSantis Has Strong Approval Rating, Overwhelming Support On Pandemic\">double-digit lead<\/a> since he announced his \u200dcampaign last November, which has only grown as\u200c the candidate\u2063 has been \u200bindicted four times and named in several\u200d more civil suits, most of which \u200chave\u2063 to\u2063 do\u200d with his actions in office \u200bas president.\n  <\/p>\n<div class=\"my-5\">\n<p>    Eight Minnesotan voters, including the\u200c former secretary of state, filed the petition \u2062(<a href=\"https:\/\/freespeechforpeople.org\/wp-content\/uploads\/2023\/09\/2023-09-12-petition.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) on Sept. 12. They\u200d argue that under Section 3 of the \u206414th Amendment, \u2063President Trump is disqualified from holding office. It&#8217;s an eligibility\u2064 argument that he is\u2063 constitutionally ineligible because of the 14th\u200c Amendment language that\u200b you summarized. The\u2063 problem is that \u200bthe \u2063Office of Secretary of State in Minnesota \u2063is not the eligibility police,&#8221; he told host Tom Crann.\n  <\/p>\n<p>    &#8220;A \u200blot of people are surprised to know that, but we are not in a\u200b position legally, we don&#8217;t have the authority legally to make \u2063eligibility determinations of any \u2063kind,\u200b whether that&#8217;s\u200d residents,\u200b whether that&#8217;s age, or \u200dsomething else like this.&#8221;\n  <\/p>\n<p>    \u200c  \u2064 Minnesota law requires a \u200bpetition\u200d to strike someone from the ballot, he added, recounting a\u2062 similar\u2063 challenge in 2016. A \u2063petition was filed \u2064arguing\u200c state Rep. \u200dBob Barrett didn&#8217;t live\u200b in the\u2063 district \u2062he was elected to represent, and the \u200cstate&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bill-barr-did-not-see-fraud-because-he-refused-to-look\/\" title=\"Bill Barr Did Not See Fraud Because He Refused To Look\">supreme court ruled<\/a> \u200bin the \u200bpetitioner&#8217;s \u2064favor, ruling Mr.\u2063 Barrett \u2064ineligible to run for\u2063 reelection 80 days before \u200bthe 2016 election.<br \/>\n  \u2062\n  <\/p>\n<p>    \u2063   Mr. Simon explained that the state law\u2063 allows &#8220;any\u2064 individual&#8221; \u2064to bring forth such a petition.\n  <\/p>\n<p>    &#8220;That&#8217;s as broad an invitation I&#8217;ve ever seen,&#8221; he said.\n  <\/p>\n<div class=\"my-5\">\n<p>    Four days later, liberal\u200c group Free Speech for the\u200c People, \u2063representing the individual petitioners, filed the lawsuit in Minnesota.<\/p>\n<h2>Coordinated Effort<\/h2>\n<p>    \u2063 Free Speech for the People began arguing for\u2062 President Trump&#8217;s ineligibility for office in 2021, sending letters\u200b to secretaries of state \u2062across the country. \u2062This year, it has renewed its\u2062 efforts, joining other \u200dliberal groups \u200bin sending\u2062 notices to election officials in several states and filing petitions.<br \/>\n \u2063\n  <\/p><\/div>\n<p>    \u200c  \u2062 Last year, the group also filed petitions against Rep. Marjorie Taylor Greene (R-Ga.) \u2062and Madison Cawthorn, a former North Carolina Congressman\u200c who did not seek reelection, \u200bultimately \u200drendering the petition moot. A judge had ruled in favor of Mr. Taylor Greene, which meant neither of the 2022 lawsuits were successful.\n  <\/p>\n<div class=\"my-5\">\n<p>    \u200b  \u200d  Now the question of whether \u2064the 14th \u2064Amendment bars President Trump from running for office is being <a href=\"https:\/\/www.theepochtimes.com\/us\/attempts-to-block-trump-from-ballot-denounced-as-dangerous-as-legality-is-debated-legal-scholar-5485068\" target=\"_blank\" rel=\"noopener\">debated<\/a> in several states.\n  <\/div>\n<div class=\"my-5\">\n<p>    In Florida, such a petition has already been <a href=\"https:\/\/www.theepochtimes.com\/us\/obama-appointed-judge-throws-out-attempt-to-keep-trump-off-of-florida-ballot-5484926\" target=\"_blank\" rel=\"noopener\">thrown out<\/a>. Judge Robin Rosenberg, an appointee of Democrat President Barack Obama, stated that \u200dshe lacked jurisdiction.\n  <\/div>\n<div class=\"my-5\">\n<p>    &#8220;An individual citizen does not \u2062have standing to challenge whether another individual \u2062is qualified to hold public office,&#8221; she\u200d wrote.<br \/>\n  \u200d<\/p>\n<h2>14th Amendment<\/h2>\n<p>    The \u200b14th \u2063Amendment was ratified in 1868, in the wake of\u200c the Civil War, and Congress had required the formerly Confederate \u200dstates to ratify it\u2064 in \u2062order to regain federal\u200c representation.\n  <\/p><\/div>\n<p>    \u200d  The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/minnesota-joins-states-trying-to-keep-trump-off-the-ballot\/\" title=\"Minnesota joins states in effort to exclude Trump from ballot.\">amendment granted \u200dcitizenship<\/a> and equal protection under\u2064 the law to all\u2064 persons born or \u200bnaturalized in the \u200bUnited States, including former slaves,\u2062 and allowed the federal government to punish states that infringed on citizens&#8217; right to \u200cvote.\n  <\/p>\n<p>    It also, in\u200b Section\u2063 3, prevented anyone who engaged\u200b in insurrections or \u2062rebellions against the nation from\u200c holding civil, military, or elected \u200boffice without two-thirds approval from both chambers of Congress, targeting\u200c those \u200cwho \u200dhad participated\u2063 in the Civil \u200cWar.<br \/>\n \u200b\n  <\/p>\n<div class=\"my-5\">\n<p>    The Minnesota\u2064 petition, like ones before\u200d it, argues that President Trump&#8217;s actions on Jan. 6,\u2063 2021, \u200dconstituted &#8220;an insurrection \u2063or a rebellion&#8221; that \u200dwould disqualify\u200d him.<br \/>\n   \u200d<\/p>\n<h2>Petition<\/h2>\n<p>    \u2063  The 84-page petition mirrors the structure and arguments of the\u200c Colorado petition, \u200bwhich \u2063was filed by a separate Washington-based group called\u200d Citizens \u2064for Responsibility and Ethics.\n  <\/p><\/div>\n<p>    \u2062They describe\u200b those who rallied at&#8230;<br \/>\n \u200c\n  <\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>A week after a lawsuit in Colorado aimed to exclude Donald Trump from the ballot, a liberal group in Minnesota is pursuing a similar course.
