The arguments are the beginning of a weekslong trial between the tech giant \u200band the federal agency over allegations that Google \u200bhad created a monopoly through its agreements with web browsers \u200band phone makers to have Google as the\u2063 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/inside-the-privacy-battle-raging-between-apple-and-facebook\/\" title=\"Inside The Privacy Battle Raging Between Apple And Facebook\">default search engine<\/a>.<\/p>\n<h3>DOJ Alleges Monopolistic Practices<\/h3>\n<p>The DOJ\u2019s case is \u201cbuilt on \u2062documents that \u200ccapture exactly\u201d what Google did to close off the ability of competitors like Apple to innovate and compete, DOJ prosecutor Kenneth Dintzer \u2064said in\u200c his opening\u200b remarks. For example, he posted a 2007 internal presentation in which a Google\u2062 employee said that \u2063it would not share revenue with Apple if it did not place Google as the default search engine.<\/p>\n<p>Dintzer also noted that, when Apple had its digital assistant Siri divert search inquiries for direct results,\u2062 Google restricted it in order to ensure that its search engine was used. &#8220;Your honor, this is a monopolist \u200bflexing,\u201d he \u2063said.<\/p>\n<p>He also alleged that Google\u2019s leadership, including CEO Sundar\u200b Pichai, explicitly attempted to hide internal communications by asking employees to allow their DMs\u200c to be deleted after\u2063 24 hours. \u201cThey turned history off, your honor, so they could rewrite it here in this courtroom,\u201d Dintzer argued.<\/p>\n<p>Google is not competing with Amazon, TikTok, and other tech \u2064giants, Dintzer argued, because TikTok, for example, can\u200b only <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-rejects-gop-request-for-information-on-mar-a-lago-raid-for-classified-documents\/\" title=\"DOJ denies GOP's request for classified Mar-a-Lago raid info.\">provide limited information<\/a> from within its websites.\u200c Google has access \u2062to the entirety of the\u200d internet and provides general outcomes, the prosecutor \u200dargued.<\/p>\n<h3>Google&#8217;s Defense<\/h3>\n<p>William Cavanaugh, who is the lawyer representing\u200d a group of states who also sued \u200bGoogle in 2020, argued\u200c that Google\u2019s control of the advertising market allows it extensive control of advertising\u200c pricing. Cavanaugh \u2062argued that Google harmed Microsoft by temporarily withholding certain features from its advertising.<\/p>\n<p>Finally, Google\u2019s representative, John Schmidtlein,\u2062 made \u200cthe\u2062 final set\u2064 of\u2064 opening remarks \u200din an effort to challenge the\u200c DOJ. Schmidtlein argued\u200d that Microsoft installed Bing as the default search engine on the\u200b majority of its\u2064 operating systems, but that users rely \u200bon Google because they \u200bprefer the product. \u2063That swap is evidence that Google&#8217;s market control\u200c is not due to the \u200cdefault agreements but due to user preference, he argued.<\/p>\n<p>\u201cUsers today have more search options\u200c and more ways to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/im-launching-an-investigation-into-big-tech-censorship-heres-why\/\" title=\"I\u2019m Launching An Investigation Into Big Tech Censorship. He also kept his focus on Microsoft, noting how Google was able to beat the software giant in search dominance through product quality. Mehta seemed to push back on Schmidtlein about \u200cwhether he could\u2063 prove that \u200cusers \u200busually swap browsers by default. Google&#8217;s lawyer was\u2062 unable to present any substantial data due to the ability of\u2064 users to easily swap back and forth.<\/p>\n<p>Schmidtlein also argued that Google was competing in search\u2063 not just with other search engines, but with other websites, such as Yelp and\u200c Amazon. He also noted that Google&#8217;s digital\u200b advertising tool did not oust \u2064others,\u2062 but rather was competitive and \u200cempowered other companies where necessary.<\/p>\n<p>\u201cPlaintiffs\u2019 claims seek to distort search\u2064 competition by\u2062 hindering Google \u200dand its \u2064ability to compete,\u201d Schmidtlein concluded. \u201cAll in the hopes that forcing people to use inferior products in the short run will somehow be\u200c good for competition in the \u200clong run.\u201d<\/p>\n<p>The DOJ&#8217;s suit was initially filed in partnership with 35 states\u2062 in 2020, alleging that Google&#8217;s market dominance was hurting competitors.
