target=\"_blank\" rel=\"noopener\">U.K. Daily Mail<\/a> reported.<\/p>\n<p>In June 2022, Halifax provincial court Judge Ann Marie Simmons issued a decision\u00a0that has since <a Stacey\u2019 Effort Ahead Of Possible Abrams 2022 Announcement\">gained national attention<\/a> \u200dafter a Nova Scotia <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-court-is-fast-tracking-sidney-powells-request-for-a-forensic-exam-of-dominion-voting-machines\/\" title=\"Federal Court Is Fast-Tracking Sidney Powell\u2019s Request For A Forensic Exam Of Dominion Voting Machines\">appeals court<\/a> ruling was published in late August.<\/p>\n<p>The case revolved around a 59-year-old father, identified as R.B.W. in <a href=\"https:\/\/www.westernjournal.com\/prince-andrew-met-epstein-house-arrest-reveal-court-documents-contradicting-claims\/\" target=\"_blank\" rel=\"noopener\">court documents,<\/a> \u2064who pleaded guilty to engaging in sexual intercourse with \u200dhis biological \u200cdaughter between September 2018 and June 2019.<\/p>\n<p>Both the father and his daughter had been diagnosed\u2064 with having mental disabilities.<\/p>\n<p>This disturbing case remained hidden from the public until\u200b the summer\u2064 of 2019 when the daughter, then 23\u200d years old, gave birth to a\u200c child with severe medical \u2063issues and developmental\u200c delays, according to the outlet.<\/p>\n<p>Concerns raised by a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dad-who-raped-impregnated-special-needs-daughter-sentenced-to-mere-house-arrest-by-woke-judge\/\" title=\"Judge Gives House Arrest to Father Who Raped and Impregnated Special Needs Daughter\">medical geneticist prompted police involvement<\/a>, and the child is now in foster\u2063 care.<\/p>\n<p>During the initial sentencing, Simmons handed down a conditional\u2062 sentencing order, commonly \u200dknown as \u2062 <a href=\"https:\/\/www.westernjournal.com\/prince-andrew-met-epstein-house-arrest-reveal-court-documents-contradicting-claims\/\" target=\"_blank\" rel=\"noopener\">house arrest<\/a>.<\/p>\n<blockquote \u200cthat \u2064it was excessively lenient and legally inappropriate for the crime of incest.<\/p>\n<p>At the sentencing hearing, prosecutors advocated for\u2064 a <a viewed these precedents as mere guidelines.<\/p>\n<p>She highlighted R.B.W.\u2019s remorse \u200cand \u200clow likelihood of reoffending as pivotal\u2063 factors \u200bin her decision, \u200caccording to the \u2063Daily Mail.<\/p>\n<p>Moreover, she emphasized that the father and daughter\u2019s roles in the incestuous act were viewed as \u201cequal\u201d since the \u2064daughter was an adult,\u2062 contending that the father did not employ\u200b grooming, threats, or force to commit the crime.<\/p>\n<p>The \u200dcase took a controversial \u200cturn when Jamie Sarkonak, in a column for the <a href=\"https:\/\/nationalpost.com\/opinion\/jamie-sarkonak-house-arrest-for-impregnating-daughter-a-result-of-race-based-sentencing\" target=\"_blank\" rel=\"noopener\">National Post<\/a> following the appeal ruling,\u200c suggested that race\u200b may have played\u2063 a decisive role in Simmons\u2019 judgment.<\/p>\n<p>Sarkonak pointed out that the judge specifically\u2062 noted that previous offenders in similar cases were not of African Nova Scotian heritage.<\/p>\n<p>\u201cWhen deciding whether offenders of such heritage should serve house arrest or jail, the court \u200dwrote\u2062 that \u2018a more nuanced approach\u2019 was required. In short, a racial \u2063discount\u2062 was to be applied,\u201d\u200b Sarkonak wrote.<\/p>\n<p>Simmons\u2019 decision also took into account a relatively new feature\u200b of the \u200bCanadian legal system known as Impact of Race and Culture Assessments (IRCAs), the \u200cMail reported.<\/p>\n<p>These assessments provide pre-sentencing reports that inform judges about systemic \u2064racism and other disadvantages\u200d faced by \u201cblack or racialized person\u2019s interactions with the justice system,\u201d according to <a href=\"https:\/\/www.legalaid.on.ca\/irca\/#:~:text=IRCAs%20are%20reports%20that%20help,what%20the%20sentence%20should%20be.\" target=\"_blank\" rel=\"noopener\">Legal Aid Ontario<\/a>.<\/p>\n<p>The judge ruled that the\u200b \u201cmoral culpability\u2063 of an African Nova Scotian offender has to be assessed in the context of historic \u2064factors and\u2064 <a href=\"https:\/\/www.westernjournal.com\/researchers-claim-systemic-racism-now-impacting-wildlife\/\" target=\"_blank\" rel=\"noopener\">systemic racism<\/a>, as was done\u200d in this case,\u201d a controversial decision that\u200d influenced the appeals court.<\/p>\n<p>In \u200cher Aug. 23 <a href=\"https:\/\/www.canlii.org\/en\/ns\/nsca\/doc\/2023\/2023nsca58\/2023nsca58.html\" target=\"_blank\" rel=\"noopener\">opinion<\/a>, Appeals Justice Anne S. Derrick endorsed considering systemic \u200bracism in sentencing decisions, stressing that \u200dit wasn\u2019t necessary to establish a \u201ccausal link\u201d between systemic factors and the\u2064 offense to take them into account, particularly for African\u2063 Nova Scotian\u200d offenders, the UK Daily Mail reported.<\/p>\n<p>In \u2064a three-judge appeal panel, \u2064Justice\u200d Joel E. Fichaud \u200csupported Derrick\u2019s analysis, while Justice David P.S.
