9\/11\/2023<\/li>\n<\/ul>\n<p>The judge is the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/father-and-mother-are-dear-but-dearer-still-is-chairman-mao\/\" title=\"\u2018Parents are precious, but Chairman Mao is even more precious.\u2019\">sole decision-maker<\/a> on this motion, and \u2063it\u200c remains unclear \u200bwhether she will \u2064recuse herself.\u2063 If she does, a new\u200d judge will be assigned\u2064 to the Trump case.<\/p>\n<p>If\u2064 Judge Chutkan disagrees and denies the request,\u2062 President\u2064 Trump&#8217;s attorneys have the \u2063option to petition an \u2062appeals court for a writ \u200cof mandamus, which would require the judge to step aside.<\/p>\n<p>In the \u2062court papers filed Monday, President Trump&#8217;s lawyers highlighted remarks made \u200bby Judge Chutkan in October 2022, before \u2063the appointment of special counsel Jack Smith. These \u2063remarks \u200bwere \u2062made during the sentencing phase for\u2063 Jan.\u200d 6 protester Christine Priola, in which \u200bJudge \u200bChutkan referred to the events as\u200d an\u2062 attempt\u2064 to violently \u200doverthrow\u200d the government.<\/p>\n<p>President Trump&#8217;s \u200bteam argued that \u200cthese statements, along \u2062with\u200d others\u200d made by Judge Chutkan,\u2062 suggest a bias against him and a \u200dbelief that he \u200dshould be prosecuted for the Jan. 6 Capitol breach.<\/p>\n<p>&#8220;Public\u2062 statements of this sort create a\u2062 perception of prejudgment \u200bincompatible with our justice system. In a case \u2063this \u200dwidely\u200d watched, of such monumental \u2063significance, the public must have\u2062 the utmost confidence that the Court will administer justice neutrally \u2064and dispassionately,&#8221; his attorneys \u2062wrote\u200b in the filing.<\/p>\n<p>It is\u2064 worth noting that Judge\u2062 Chutkan has handed down some \u2063of the\u200d harshest prison sentences in Jan. 6 cases, often exceeding \u200dthe recommendations of the \u2062Justice \u200bDepartment prosecutors.<\/p>\n<p>This is not the \u200cfirst \u200btime Judge Chutkan\u2064 has \u200bruled against President Trump in\u2064 a Jan. 6 \u200ccase.
