The company argues that the law puts undue \u2064pressure \u200don <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-facebook-files-the-effort-to-censor-vaccine-information\/\" title=\"Facebook's Vaccine Information Censorship Effort: The Facebook Files\">social media \u2064platforms<\/a> to censor discourse that state officials deem problematic.<\/p>\n<\/blockquote>\n<p>X, formerly known as Twitter, has filed a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.caed.433955\/gov.uscourts.caed.433955.1.0.pdf\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> in the United States District Court for\u2062 the Eastern District of California against the new law AB 587. This law requires social media companies to publicly disclose their moderation \u2063practices \u2064in categories\u2063 that the \u200cstate may label as misinformation\/disinformation, extremism\/radicalization, and hate speech. Failure to comply could result in fines imposed by the \u200dstate.<\/p>\n<p>However,\u2062 with Musk&#8217;s commitment to restoring a marketplace of ideas on \u2064his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/elon-musks-x-corp-sues-california-over-social-media-content-moderation-law\/\" title=\"Elon Musk's X Corp sues California over <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-asks-scotus-to-strike-down-texas-and-florida-content-moderation-laws\/\" title=\"White House urges SCOTUS to invalidate Texas and Florida content moderation laws.\">content moderation law<\/a>.&#8221;>newly \u200crebranded  billion social media\u2064 company<\/a>, X Corp. argues that California&#8217;s new law infringes upon the First Amendment rights protected by the U.S. and California constitutions.<\/p>\n<blockquote>\n<p>&#8220;Because X Corp. must\u2064 take such positions \u2063on \u2063these topics as \u2063they are formulated by \u200bthe State, X Corp. is \u2062being \u200bforced to adopt\u200b the State&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/elon-musks-x-files-39-page-lawsuit-after-problematic-censorship-bill-passes\/\" title=\"Elon Musk sues over 'problematic' censorship bill passing, files 39-page lawsuit.\">politically-charged terms<\/a>, which is a form \u200bof compelled speech in and of itself,&#8221;\u200d the lawsuit alleges.<\/p>\n<p>&#8220;AB 587\u2062 thus mandates X Corp. to speak about sensitive, \u2062controversial topics about which it \u2063does not wish to speak \u200cin the hopes of pressuring X Corp. to limit constitutionally-protected content on its platform that the state apparently finds objectionable or undesirable,&#8221; the \u2063suit says.<\/p>\n<\/blockquote>\n<p>Lawmakers argue that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/progressive-policies-need-to-be-fought-off-by-states-rep-steube\/\" title=\"Progressive Policies Need to Be Fought Off by States: Rep. Steube\">content moderation practice<\/a> is simply a &#8220;transparency \u200bmeasure&#8221;\u2063 that requires\u2062 social media companies to make their moderation \u2063policies and statistics publicly available.<\/p>\n<p>Assemblymember Jesse Gabriel\u200b (D-Encino), the bill&#8217;s author, responded to the lawsuit by stating that AB 587 is &#8220;a pure transparency measure that simply requires companies to be upfront \u200babout if and how they are moderating content.&#8221;<\/p>\n<p>&#8220;It in no way requires any specific content moderation policies,&#8221; he added. &#8220;If Twitter has nothing to hide,\u200d then they should have no \u200dobjection to this bill.&#8221;<\/p>\n<p>This lawsuit by X Corp. follows a \u200dseparate litigation brought forward by satire news website Babylon Bee, podcaster Tim Pool, and Minds, Inc. against California&#8217;s attorney general to prevent the enforcement\u2062 of\u200d the content moderation law.<\/p>\n<blockquote>\n<p>&#8220;If Big Tech is tasked \u2062by the state with eliminating hateful\u2064 or misinformative content, they&#8217;ll stuff \u2063everything they\u200d don&#8217;t like into those categories, including opinions, jokes, and\u200d even factual statements,&#8221; said Babylon Bee CEO Seth Dillon. &#8220;We&#8217;ve \u2062already experienced it first hand.&#8221;<\/p>\n<\/blockquote>\n<p>California Democratic Governor Gavin Newsom, upon signing the bill into law, emphasized the need to combat\u2064 the spread of hate and disinformation on social media. However, \u2062critics like Dillon argue that the law is too vague and amounts to censorship.<\/p>\n<p>&#8220;We need\u2062 laws that prohibit viewpoint discrimination, not laws that compel it under threat of penalties (and under the guise of good-faith content moderation),&#8221; Dillon said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>California court.
