Lindsey\u2063 Graham and former Republican Sens. \u200bDavid\u200c Perdue and \u2062Kelly Loeffler\u200c may \u2064be garnering all the headlines. But three other \u2062names \u200cincluded in the grand jury\u2019s final report released on Friday \u200bmerit the real condemnation of Willis\u2019 outrageous politicization of election contests: Cleta Mitchell, Alex Kaufmann, \u200band Kurt Hilbert.<\/p>\n<p>On Friday, the Fulton County Superior Court entered\u200d an order directing\u2064 the public \u200drelease of the final report compiled by \u2063the\u200c special purpose grand jury that \u2062was empaneled to\u200c purportedly \u2063investigate the \u201ccircumstances relating directly or indirectly to possible attempts \u2062to disrupt the lawful administration of\u200b the\u2062 2020 presidential elections in the State of Georgia.\u201d The \u200dpublic release\u200d of the 25-page unredacted <a href=\"https:\/\/s3.documentcloud.org\/documents\/23944943\/read-georgia-special-grand-jury-report-on-trumps-election-interference.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a> soon followed, revealing that the grand jury \u200dempaneled by Willis recommended the get-Trump prosecutor indict a total of 39 individuals \u2014 not merely the 19 charged\u200d in the sprawling RICO indictment handed \u2063down last month.<\/p>\n<p>While the final report contained few specifics supposedly \u2063supporting the recommended charges, those included \u200cindicate Willis deceived the grand jury while staking\u2063 out \u2064a position as an election-integrity denier. The opening of the report exposed the prosecutor\u2019s charade, with the grand jury noting it \u201cheard extensive \u200ctestimony on the subject\u200d of alleged election fraud from poll workers, investigators,\u2064 technical experts, and \u200dState of \u200cGeorgia employees \u2062and officials,\u2062 as well as\u2063 from persons still\u2063 claiming that such fraud took place.\u201d The grand jury then stressed: \u201cWe find by a unanimous \u200dvote that no widespread fraud took place in the Georgia 2020 presidential election that could result in \u2063overturning that election.\u201d<\/p>\n<h3>Phony Phone Call Narrative<\/h3>\n<p>Then came the recommendation that Willis \u200cseek an indictment against election lawyer \u200bCleta Mitchell, \u201cwith respect\u200c to the January 2, 2021 phone call \u200cfrom President Trump \u2062to Secretary of State Brad Raffensperger\u2026\u201d<\/p>\n<p>While the report did not identify what specifically Mitchell \u2062did during that phone call that supposedly constituted a crime, \u200cthe special purpose grand \u200bjury nonetheless pushed Willis to charge the election lawyer\u200b with\u200b intentionally interfering with the performance of election duties, solicitation to commit election fraud, and making false \u200dstatements.<\/p>\n<p>That the grand\u2063 jury believed Mitchell committed a crime establishes that Willis either \u2064misled them or was willfully blind to violations of the Georgia election code \u2014 or \u2063both. The transcript of the Jan. 2,\u2064 2021, call proves this \u200cpoint.<\/p>\n<p>At the time of that call, \u200dTrump had a still-pending election challenge in Fulton \u200bCounty. Mitchell, who was\u2064 one of Trump\u2019s\u200d lawyers, told \u2062Secretary of State Raffensperger and his staff \u2063that\u200d the court was \u201cnot acting on our petition.\u201d \u201cThey haven\u2019t even assigned a judge,\u201d\u200d Mitchell \u200cstressed,\u200b adding that \u2063\u201cthe people of Georgia\u200c and the people of America have a right \u200bto know the answers.\u201d<\/p>\n<p>Mitchell, along with fellow election law\u2064 attorney Kurt Hilbert, whom the special purpose grand jury also recommended Willis \u2064charge criminally, also highlighted during the conversation several specific violations of Georgia\u2019s election code \u2014 \u200dincluding\u2062 ones that have since been confirmed. For instance, Mitchell stressed they had watched the entire State Farm Arena videotape, and \u201cwhat we saw and what we\u2019ve confirmed in the timing\u200c is that they\u2062 made everybody leave \u2014 \u200dwe have \u200dsworn affidavits\u200d saying that \u2014 and then they began to process ballots.\u201d Mitchell noted Trump\u2019s election team had estimated that roughly 18,000 ballots were \u200bcounted \u2062after the observers were told to leave.<\/p>\n<p>The \u200dGeorgia\u200c election lawsuit argued that\u2063 the\u2062 continued counting of ballots at\u2063 the State Farm Arena constituted a violation \u2062of state \u200belection law and, specifically, Section 21-2-483(b), which required all proceedings at the tabulating center and precincts []be\u200c open to the view of the public.\u201d\u2064 The\u2063 election lawsuit also alleged \u2062a violation of O.C.G.A. \u00a7 21-2-493, \u200dwhich requires \u200bthe superintendent of elections to \u201cpublicly commence\u2064 the computation and canvassing of returns and continue the same from the day\u2064 until completed.\u201d<\/p>\n<p>Mitchell then added that\u200b what she didn\u2019t \u201cunderstand is why wouldn\u2019t \u2063it be in everyone\u2019s best interest to try to get to the \u2063bottom,\u2063 compare the numbers, \u2064you know?\u201d\u200b Here she\u200b asked specifically\u200d what number \u200dof ballots\u2062 the \u2063secretary of state had concluded\u200b were counted at the State Farm Arena after observers were\u2064 sent home. \u200bGeorgia officials provided no answer.<\/p>\n<p>But that was \u201cjust one of like, 25 categories\u201d\u2063 of claimed violations of state election law, Mitchell noted. Hilbert, another of\u2063 Trump\u2019s election \u2062lawyers, interjected that they had \u201chard numbers for 24,149 votes that were \u200bcounted illegally,\u201d which was \u200d\u201cjust based on USPS data and your own secretary of state\u2019s\u200c data,\u201d\u2063 and \u2063that \u201cin and of itself is sufficient to change the results or place the outcome in doubt.\u201d<\/p>\n<p>Hilbert\u2063 stressed that they were asking \u2014 \u201centreat[ing]\u201d \u2014 the secretary of state \u201cto \u200bsit down with us in a \u2063compromise and settlements proceeding and actually go through the registered voter IDs and registrations.\u201d<\/p>\n<p>\u201c[I]f \u2063you can convince us that that 24,149\u200c is inaccurate, then fine,\u201d Hilbert explained, \u201cbut we tend\u200c to believe that is, you know, obviously more than 11,779,\u201d which was the margin of votes separating Joe Biden and\u200b Donald Trump.<\/p>\n<p>While Hilbert, Mitchell, and even \u200dTrump made clear in the call \u2062that they believed they had \u200dconcrete evidence \u200destablishing more than 11,779 illegal votes had been cast and counted in Georgia, Willis has\u200d long misrepresented the \u2064content \u200bof that\u200b conversation, as exemplified in the response brief \u2063she filed in a federal court in seeking to\u2064 enforce \u200ca \u200csubpoena against Graham. Willis told the court \u200cthat \u201ca central focus\u201d of her \u200cinvestigation\u200d into the 2020 election \u201cis former President Donald\u200d Trump\u2019s January 2, 2021, telephone call \u200dto Georgia Secretary of State\u2064 Brad Raffensperger requesting that the Secretary \u2018find 11,780 votes\u2019 in the former President\u2019s \u200cfavor.\u201d<\/p>\n<p>But as the release \u200cof the transcript \u2063of that call\u200b long ago established,\u2062 Trump did\u2063 not request that Raffensperger \u201cfind 11,780 votes.\u201d <a href=\"https:\/\/thefederalist.com\/2022\/08\/09\/georgia-prosecutor-targeting-trump-bases-court-filing-on-fake-news\/\" target=\"_blank\" rel=\"noreferrer noopener\">Period<\/a>. It\u200d never\u2064 happened.<\/p>\n<p>Nor did Mitchell or Hilbert. Rather, both\u2063 of these well-seasoned election lawyers highlighted during the call evidence they had gathered of violations \u200bof state election law. And while the state court never reached the merits of Trump\u2019s election lawsuit, evidence has since confirmed the validity \u2064of at least some of those challenges.<\/p>\n<h2>Legitimate Election Integrity Concerns<\/h2>\n<p>First, as Mitchell stressed during the phone call, the entirety of \u2063the State \u200bFarm Arena video supported the \u2062claimed violation of\u200b election law \u2014 which was further <a href=\"https:\/\/thefederalist.com\/2020\/12\/07\/no-the-georgia-vote-counting-video-was-not-debunked-not-even-close\/\">supported<\/a> by sworn affidavits and contemporaneous reporting by legacy media outlets.<\/p>\n<p>Second, since the election, evidence \u2063strongly suggests that more than 10,000 illegal votes were cast and counted solely from one of the 20-some categories of votes challenged in Georgia\u2063 state court by Trump\u2019s\u200d legal team. Specifically, after the 2020 election, voter registration records \u2062confirmed the move of some 10,300 Georgian voters\u2063 between counties.<\/p>\n<p>Those voters, however, all cast votes in the 2020 election in the county from which they had moved before voting. But \u200dunder Georgia law, \u200cresidents must\u2064 <a href=\"https:\/\/law.justia.com\/codes\/georgia\/2019\/title-21\/chapter-2\/article-6\/section-21-2-218\/\" target=\"_blank\" rel=\"noreferrer noopener\">vote<\/a> in the\u2062 county in which they currently reside, \u200cunless they changed their \u200cresidence within 30 days of the election. None of\u2063 the moves were recent ones, though, making the votes illegal under state law.<\/p>\n<p>Mitchell and her colleagues highlighted these violations of Georgia law during the Jan. 2, 2021, \u2064conversation with Raffensperger, and it \u200bwas these issues they had\u2062 pushed the secretary \u200cof state to investigate. \u200bIn fact, neither Mitchell nor Hilbert\u200c raised the issue of fraud during the call.<\/p>\n<p>Yet according to the special purpose grand jury \u2062report, Willis\u2019 focus was on claims\u2064 of fraud, with the\u200d grand\u200c jury stating it \u201cheard extensive\u2064 testimony on the \u200dsubject of alleged election fraud from poll workers, investigators, technical experts, \u200cand State of Georgia employees\u200c and officials, as well as from persons still claiming that such fraud took place.\u201d\u200c Willis also likely peddled to\u2062 the grand jury the falsehood that \u200bTrump had asked Raffensperger to\u200b \u201cfind\u201d 11,800 votes: That is the <em>only <\/em>way \u2062to reconcile the \u200breport\u2019s recommendation to charge Mitchell with crimes concerning \u201cthe January 2, 2021 phone \u200ccall \u2063from President Trump to Secretary of State \u2064Brad Raffensperger\u2026\u201d<\/p>\n<p>The grand jury also recommended Willis charge Mitchell, Hilbert, and Alex Kaufman \u2014 the latter being a third attorney on the Jan. 2 call with Raffensperger \u2014 \u2063apparently for providing legal guidance related to the selection of an alternative \u2062slate of Trump electors. Such\u2062 legal advice, however, \u2062was\u200d not only\u200c not criminal,\u200b but legally sound, as I\u2019ve previously <a href=\"https:\/\/thefederalist.com\/2023\/05\/15\/the-lefts-2020-fake-electors-narrative-is-fake-news\/\" target=\"_blank\" rel=\"noreferrer noopener\">detailed<\/a> \u200d at length.<\/p>\n<h3>Legitimate\u200c Election Integrity Concerns<\/h3>\n<p>Finally, Friday\u2019s \u2062report revealed the grand jury\u2064 had pushed Willis to charge Mitchell, Hilbert, and Kaufman for\u200b what the report characterized as \u201cthe national effort\u200b to overturn\u2062 the\u2063 2020 presidential election,\u201d including \u201cefforts in Georgia, Arizona, Wisconsin, Michigan, Pennsylvania, and the District of Columbia\u2026\u201d<\/p>\n<p>That the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/georgia-grand-jury-report-exposes-fulton-county-prosecutor-as-an-election-integrity-denier\/\" title=\"Georgia Grand Jury Report: Fulton County Prosecutor Denies Election Integrity\">special purpose grand jury recommended<\/a> such \u200dcharges against these\u200d three lawyers suggests Willis either\u2062 intentionally lied to the grand\u200b jury about the various election challenges occurring in those states or was willfully blind to the numerous irregularities and violations of election\u200d laws.<\/p>\n<p>In the case of Georgia, as detailed above, the \u200bfacts have since \u200cconfirmed the merit of the election\u2063 challenge. Likewise,\u200d in Wisconsin, the state Supreme Court \u2062would later <a href=\"https:\/\/thefederalist.com\/2022\/07\/14\/courts-squash-democrats-most-secure-election-lie-swing-states-didnt-follow-their-own-election-laws-in-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">confirm<\/a> the Midwest state that swung for Biden\u2062 in 2020 had illegally \u2064used drop boxes during that election. Challenges in other states were never \u200c <a href=\"https:\/\/thefederalist.com\/2021\/03\/11\/courts-repeatedly-refused-to-consider-trumps-election-claims-on-the-merits\/\" target=\"_blank\" rel=\"noreferrer noopener\">resolved<\/a>, but that doesn\u2019t make\u2062 the Trump lawyers criminals for contesting the election\u2063 results.<\/p>\n<p>While Willis may not \u200dhave\u2064 indicted Mitchell,\u2062 Hilbert, and Kaufman, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-asks-georgia-court-to-disqualify-district-attorney-from-election-interference-investigation\/\" title=\"Trump seeks disqualification of Georgia DA from election interference probe.\">special purpose grand jury recommending<\/a> the election lawyers be charged suggests the\u2064 Fulton County DA painted all\u2063 of\u2063 the challenges to the 2020 election as frivolous. They weren\u2019t, and anyone claiming otherwise is a denier of election integrity.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The grand jury&#8217;s recent recommendation to indict Sen.
