She \u2063and her kids were \u2063maskless because it\u2019s\u2064 2023 and,\u2064 well, really that\u2019s the only explanation needed. Yet\u200c she was told her children would not only be \u2063denied treatment\u2062 without \u2062the wearing \u200dof face coverings, but the\u200c doctor\u2019s office also threatened to\u2063 call Child Protective Services on the\u200c mother.<\/p>\n<p>You\u2019ve likely heard the rumors and seen some social\u2064 media pronouncements\u2063 by a\u2063 few universities, school districts, and businesses. Maybe even reports in the corporate \u2064press sourced to friendly reporters. \u2063Mask mandates are coming back \u2014 with the cooperation \u200dof <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dems-lost-all-credibility-on-social-distancing-after-biden-celebrations\/\" title=\"Dems Lost All Credibility On Social Distancing After Biden Celebrations\">public health officials<\/a>, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/orange-county-board-of-supervisors-goes-democrat\/\" title=\"Orange County Board of Supervisors Goes Democrat\">local government bureaucrats<\/a>, and suspiciously eager HR \u2064departments.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-410835911\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-e33f102147ee54018a3c3c2d34b15923 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-e33f102147ee54018a3c3c2d34b15923\"><\/div>\n<p>Hopefully, you\u2019ve also heard the\u2062 refrain \u201cDo Not Comply.\u201d \u2062This\u200c independent impulse toward civil disobedience is \u2063deeply American and a part \u200cof our national story. But we can\u2019t let it become \u2064our only strategy. We need to fight fearmongering with federal legislation.<\/p>\n<p>After the declared end of \u2063the \u200bpandemic, \u2063even by President \u200cJoe Biden <a href=\"https:\/\/www.nytimes.com\/2022\/09\/19\/us\/politics\/biden-covid-pandemic-over.html\" target=\"_blank\" rel=\"noreferrer noopener\">himself<\/a>, we saw a national shift in\u2064 public opinion against the government\u2019s abuse of power, but we left the legal door cracked too \u2062far open.<\/p>\n<p>The \u201cDo Not Comply\u201d outrage is correct and righteous. If these mandates come back in full force, no, you \u200cshould not comply. But when Republican members of Congress like \u2063Marjorie Taylor\u200b Greene and Thomas Massie \u2063insist that\u200b <a href=\"https:\/\/twitter.com\/RepMTG\/status\/1692879621027418504\" target=\"_blank\" rel=\"noreferrer noopener\">Americans\u200b engage in\u200d civil disobedience<\/a> as a\u2064 first step\u2062 to\u200b <a href=\"https:\/\/twitter.com\/RepThomasMassie\/status\/1695003807472665039\" target=\"_blank\" rel=\"noreferrer noopener\">fighting a new Covid tyranny<\/a>, they are retreating\u2062 to the last resort too early.<\/p>\n<p>Far \u2063less than we\u200c need\u2062 their tweets, we \u200dneed them to write laws that match\u200c the expressed will of the American people. We need them\u200b to invest their political capital and \u200draise legislative \u200dbarriers to\u2063 government overreach.<\/p>\n<div class=\"fdrlst__b89e9-e3da12c35675ba3aa6a1955c9098001e fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-e3da12c35675ba3aa6a1955c9098001e\"><\/div>\n<p>It\u2019s understandable\u200b from\u2062 a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/kinzinger-if-trump-is-2024-nominee-republicans-will-fail\/\" title=\"Kinzinger: If Trump Is 2024 Nominee Republicans Will Fail\">raw political perspective<\/a> why reforming public\u200b health law has \u200bfallen off the radar. Covid is over, and pushing legislation on an issue that\u2064 has\u200c generally dropped far \u2063down the public radar is thankless, maybe even \u2063politically na\u00efve. But now it\u2019s time.<\/p>\n<p>Those\u2064 who \u2063exercised such autarchic \u200bpower grow accustomed to it and \u2064will seek to exercise it again. Let\u2019s recall how dramatically and\u200b explicitly the majority of states suspended\u200b the \u200cFirst Amendment in\u200b 2020. We closed churches and prevented peaceable assembly, with restrictions remaining in place long after public opinion\u200d had turned. Does anyone think polls and \u200dsurveys will\u200c stand in the way of \u200bthe next lockdown push?<\/p>\n<p>The vigor\u200d and as-of-yet unresolved \u2062anger of the \u201cDo Not Comply\u201d crowd is because we know we lost the first round. What was a tripartite and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/refusing-to-comply-with-future-mask-mandates-isnt-enough-we-need-a-federal-ban\/\" title=\"Federal ban needed for future mask mandates.\">complex societal crisis \u2014 public health<\/a>, economic turmoil, and civil liberty \u2062\u2014 was \u2062handled by lab coat-wearing specialists \u2062at \u2063times openly disdainful of our civil liberties \u2064and wholly unqualified to assess the economic carnage their\u200b mandates wrought. We\u2019re angry and apprehensive because\u2063 we \u200dfinally \u2064halted \u200cthem, but we \u2063never fully closed\u2064 the door\u2062 to their return.<\/p>\n<p>Recognizing \u200bthat and \u2064channeling that anger into action is our charge. We\u2062 need more than anger and vague calls to civil disobedience. We need legislative\u2062 action at the\u200d federal level.<\/p>\n<div class=\"fdrlst__b89e9-fd8cf3511b5ee579803c615511b4d3e4 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-fd8cf3511b5ee579803c615511b4d3e4\"><\/div>\n<p>Much credit \u2062is\u2063 due \u200cto freshman Sen. J.D. Vance\u2019s action this week\u200c to <a href=\"https:\/\/www.foxnews.com\/politics\/vance-introduce-measure-preventing-federal-officials-imposing-mask-mandates-schools-airplanes\" target=\"_blank\" rel=\"noreferrer noopener\">force a \u2064vote on a ban of mask \u200bmandates \u200bon \u2063airplanes and in public schools<\/a>. \u200dDemocrats predictably shot it down and were explicit that\u2063 they wish to preserve this power for \u2062the \u2062bureaucrat-princes of public health. \u2063While Democrats will \u2062shoot\u200c down such legislation again, Republican leaders must not only push legislation forward but make it a priority. Tie \u200bit \u2063to other critical \u2063budget items that the Biden administration \u200bneeds to pass.<\/p>\n<p>Put more\u200d simply, make\u2063 this a \u200cpriority, not the unfinished\u2063 business we pass onto\u2062 another generation.\u2063 Here\u2019s a look at \u200dhow we\u2062 can do that.<\/p>\n<h2 class=\"wp-block-heading\">A Playbook Against Medical Tyranny<\/h2>\n<p>Many\u200d Americans \u200bdon\u2019t realize that the federal government exercised\u200d its emergency power in 2020 primarily through longstanding federal\u2063 laws. The <a href=\"https:\/\/www.law.georgetown.edu\/salpal\/the-right-to-travel-and-national-quarantines-coronavirus-tests-the-limits\/\" target=\"_blank\" rel=\"noreferrer noopener\">Public Health Services Act (PHSA) of\u2063 1948 and\u200b the Stafford Act<\/a>, as well as the \u2064National Emergencies\u200c Act, gave the federal government all the power\u2063 it needed to enforce restrictions across a number of industries and venues.<\/p>\n<p>The PHSA \u200bis the law that both the Department of Health \u2063and Human Services (HHS) and its\u200c implementing agency, the Centers \u200cfor Disease \u200dControl and Prevention (CDC), rely upon to claim federal authority over matters of isolation and quarantine. We know this because <a href=\"https:\/\/www.cdc.gov\/quarantine\/aboutlawsregulationsquarantineisolation.html#:~:text=The%20federal%20government%20derives%20its,Clause%20of%20the%20U.S.%20Constitution.\" target=\"_blank\" rel=\"noreferrer noopener\">both \u200csay\u2062 it publicly<\/a> <a href=\"https:\/\/www.hhs.gov\/answers\/public-health-and-safety\/who-has-the-authority-to-enforce-isolation-and-quarantine\/index.html#:~:text=Under%20section%20361%20of%20the,United%20States%20and%20between%20states.\" target=\"_blank\" rel=\"noreferrer noopener\">on their sites<\/a> right now.<\/p>\n<p>The\u2064 quarantine power, exercised through CDC, was traditionally a temporary detainment power over \u2063an individual suspected of a dangerous and contagious illness, usually upon arriving back into the United States. Then, on the very last day of the Obama administration, \u200cCDC <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2017-01-19\/pdf\/FR-2017-01-19.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">promulgated into the \u200dfederal register a major expansion of that\u200d power<\/a>. They claimed that their detainment authority applied <em>en masse<\/em> to groups of people reasonably\u2062 suspected of being \u2064in the qualifying stages of having \u2064a communicable\u200b disease. They also\u2062 expanded the definition\u200c of \u201cqualifying stages\u201d to include those who appeared healthy or \u200casymptomatic, among other expanded latitude for action.<\/p>\n<p>That\u2019s how \u2063we\u200b got\u2062 to President Biden\u2019s American Travel Ban, incorrectly called by \u200cmany a mask mandate. Biden asserted that\u2063 authority historically granted \u2062over \u2063individuals in very specific\u200d circumstances could be construed\u200d to apply <em>to the American populace as a whole<\/em>, and hence our travel could be limited barring we meet their preferred conditions. Put more simply, that authority was applied not only <em>en\u2062 masse<\/em> but without regard for individual \u2063symptoms or other\u200c signifiers of \u2063disease: We\u2063 were all considered potential disease vectors.<\/p>\n<p>It was a brazen \u2064assumption of\u2064 federal authority based on an already novel interpretation of the original law.<\/p>\n<p>It was also one of the \u2062worst infringements of civil liberty \u2062in\u200c our country\u2019s history and one that\u200c carried virtually no <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nba-players-are-brushing-off-leagues-request-to-promote-covid-19-vaccine-report\/\" title=\"NBA Players Are Brushing Off League\u2019s Request To Promote COVID-19 Vaccine: Report\">public health benefit<\/a>. All that\u2063 Biden\u2019s American Travel Ban\u2062 succeeded in doing\u2064 was setting a terrible \u2064precedent.<\/p>\n<p>If we want to \u2062push back effectively against medical tyranny,\u200b let\u2019s \u200cstart\u200b by passing \u2064a\u200b law that specifically\u200c identifies and supersedes those Obama-era rules in the Federal Register (and\u2063 any related following rules), declaring them null and void.<\/p>\n<p>Then let\u2019s amend\u200c <a href=\"https:\/\/uscode.house.gov\/statviewer.htm?volume=58&#038;page=703\">Section\u200d 361 of the Public Health Services Act<\/a> to further limit the \u2063scope of any detention authority. <\/p>\n<p>With those two mistakes\u2064 corrected, the legislature should then remove\u2064 the ability for the \u2062HHS director \u2063to declare public health\u2063 emergencies\u2062 and instead require that the director present \u200dthat \u2062recommendation to the president.<\/p>\n<p>Americans have rejected \u200bthe post-Covid half-life \u200bsome wished for, \u200ba \u2062land with permanent masking and\u2063 without handshakes. Nearly\u2063 <a href=\"https:\/\/ajph.aphapublications.org\/doi\/10.2105\/AJPH.2022.307158\" target=\"_blank\" rel=\"noreferrer noopener\">200\u2062 laws at the state and local \u2062level<\/a> have \u200cbeen adopted curtailing the\u200b emergency powers of governors and public health officials. But we \u200dstill have work to do\u2063 because we opened that \u2064Pandora\u2019s box of power to federal bureaucrats.<\/p>\n<p>So, to Republican legislators: It\u2019s your turn. Don\u2019t begin by asking the citizens you represent to simply not\u2062 comply with \u200dthe law.\u200c Change the laws, \u200cand make the bureaucrats comply with \u2063their new orders.\u200c We self-govern. This\u200b is a chance to have a shining\u2064 example of \u2062what popular sovereignty looks like.<\/p>\n<p>Make it so they can\u200b never do\u2064 this to us again.<\/p>\n<div class=\"fdrlst__b89e9-f0d46b4166011676f504de26928ed8a0 fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-f0d46b4166011676f504de26928ed8a0\"><\/div>\n<hr class=\"wp-block-separator\">    \t\t\t\t\t   \t\t\t\t\t\t\t\t\t<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Recently in Texas, a woman and her children visited a pediatrician without masks, assuming it was unnecessary in 2023.
