Michelle Lujan Grisham\u2019s emergency\u200d order\u200d suspending the right to carry firearms in public\u2064 in and\u200c around the \u2064state&#8217;s largest city drew\u200d an immediate court challenge\u200d and also calls for\u2063 her impeachment by \u2062Republicans \u200cin the legislature<\/p>\n<div class=\"my-5\">\n<p>New Mexico state Reps. \u2064Stefani Lord and John Block,\u2064 both Republican, called\u2063 for her\u2064 impeachment \u200bafter she <a href=\"https:\/\/twitter.com\/GovMLG\/status\/1700304261383405883?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1700304261383405883%7Ctwgr%5Ef6fc97e7affd1220837b3f29ede4b67c84021514%7Ctwcon%5Es1_&#038;ref_url=https%3A%2F%2Fwww.zerohedge.com%2Fpolitical%2Ffull-authoritarian-new-mexico-governor-restricts-constitutional-gun-rights-law-abiding\" target=\"_blank\" rel=\"noopener\">issued<\/a> the\u200b Sept. 8 order, which prohibits \u200bcitizens from carrying guns in\u200b public in the Albuquerque area.<\/p>\n<\/p><\/div>\n<div class=\"my-5\">\n<p>&#8220;This\u2063 is\u2063 an abhorrent attempt \u200dat imposing\u2062 a \u2063radical, progressive agenda on an\u2062 unwilling populous. Rather than \u2062addressing crime at\u200d its core, \u200cGovernor Grisham is restricting the rights of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utah-axes-gun-permit-requirement\/\" title=\"Utah Axes Gun-Permit Requirement\u00a0\">law-abiding gun owners<\/a>,&#8221; by misinterpreting the Constitution and laws of the\u200b state. &#8220;That\u2019s something that needs to be remedied immediately,\u201d the lawmaker said.<\/p>\n<div class=\"my-5\">\n<p>In \u200dresponse to the impeachment threat, Mrs. Lujan\u200c Grisham&#8217;s office\u2063 <a href=\"https:\/\/www.krqe.com\/news\/new-mexico\/two-lawmakers-call-for-impeachment-of-governor-lujan-grisham-after-public-health-order\/\" target=\"_blank\" rel=\"noopener\">said<\/a> the governor is &#8220;prepared to fight challenges\u2062 to her decision and \u2064recognizes not everyone\u2063 supports the\u2064 public health order,&#8221; adding that it&#8217;s a &#8220;public health emergency, and extraordinary measures\u2064 are\u200c required \u200bto prevent \u2064more innocent New Mexicans from being killed by guns.&#8221;<\/p>\n<h2>Lawsuit \u200cFiled<\/h2>\n<p>The National\u200d Association for Gun Rights and Foster Haines, a member who lives in Albuquerque, filed documents\u2062 (<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nmd.492592\/gov.uscourts.nmd.492592.2.0.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) in U.S. District Court \u2063in New\u2062 Mexico suing Mrs. Lujan Grisham \u2062and seeking an\u2062 immediate block of\u2063 the order&#8217;s implementation.<\/p>\n<\/p><\/div>\n<p>\u201cThe State must justify the Carry \u200dProhibition by demonstrating \u200cthat it is\u200d consistent with the Nation\u2019s historical tradition of firearm \u2063regulation,\u201d the lawsuit states. \u201cBut it is\u200c impossible for\u2064 the State to \u2064meet\u2063 this \u200dburden, because there\u2064 is no such historical tradition of\u200d firearms regulation \u2063in \u2064this Nation.\u201d<\/p>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>The president of the pro-gun\u200d group, Dudley Brown, said that Mrs. Lujan Grisham\u2019s order is essentially\u2063 a &#8220;middle finger&#8221; \u200dto\u200c the U.S. Constitution and the U.S. Supreme Court,\u200d according to\u2064 a statement.<\/p>\n<p>\u201cHer executive order\u200c is in \u2063blatant disregard\u200b for \u2064 [New York State Rifle &#038; Pistol Association, Inc. v. Bruen]. She needs to be held accountable \u2064for stripping \u200dthe God-given rights of millions\u2062 away with the stroke of a\u200b pen,\u201d Mr. \u2062Brown said, referring to the 2022 Supreme Court decision on \u200bgun rights.<\/p>\n<p>The governor, a Democrat, said the 30-day suspension\u2014enacted as an emergency public health\u2064 measure\u2014would apply\u200b in most public \u200bplaces,\u2062 from city sidewalks to parks. Mrs. Lujan Grisham \u2063said that the state police would \u200bbe\u200d responsible \u200bfor enforcing her \u200border, and \u200dthat noncompliance is a civil violation that carries a fine\u2062 of up \u2062to $5,000.<\/p>\n<p>She said that \u2062the order was designed to help reduce the \u2062number of shootings in New Mexico, \u200dwhile calling on the federal government&#8217;s help.<\/p>\n<p>\u201cThese are disgusting acts of\u2062 violence that have no \u200cplace in our communities,\u201d \u200bMrs. Lujan Grisham\u200d said on Sept. 7, adding \u2064that Bernalillo County needed a \u201ccooling off period\u201d amid a rise in \u200bshootings.\u200b She said that her state should use the &#8220;power\u200c of a public health\u200c [order] in a state of emergency to access different levels, different resources, and different opportunities\u200b to keep New Mexicans safe.&#8221;<\/p>\n<p>The order stipulated that gun\u200c owners\u2063 still would be able to \u2063transport guns \u200cto private locations such as\u200d a \u200bgun range or\u200c gun store if the firearm is in a container or \u200bhas a trigger \u200block or mechanism\u200b making\u2064 it \u2062impossible to discharge.<\/p>\n<p>In issuing the order, \u200dMrs.\u200b Lujan Grisham said she was compelled to act after an 11-year-old\u200d boy was \u2063shot and \u2062killed outside \u2064a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lawmakers-call-for-new-mexico-governors-impeachment-after-emergency-gun-order-2\/\" title=\"Lawmakers demand New Mexico Governor's impeachment over gun order.\">minor league baseball game stadium<\/a>, as well as\u2062 gunfire\u200b that left \u2063a 5-year-old\u200b girl dead.<\/p>\n<div style=\"margin-left:0;margin-right:0;max-width:1200px\">\n<figure style=\"width:640px;margin-left:auto;margin-right:auto\" class=\"alignnone\"><figcaption>Firearms are \u200cdisplayed in Houston on February 18, \u200c2023. (Mark \u2064Felix\/AFP \u2063via Getty \u2063Images)<\/figcaption><\/figure>\n<\/p><\/div>\n<div class=\"my-5\">\n<h2>Reactions<\/h2>\n<p>Some\u200b Democratic officials,\u2063 sheriffs, and even district attorneys \u200chave said they can&#8217;t enforce the governor&#8217;s order.<\/p>\n<\/p><\/div>\n<p>Bernalillo County District \u2064Attorney Sam Bregman, \u200bwho \u200conce served as a Democratic party leader and was appointed \u2064by Mrs. Lujan Grisham, on Sept. 9 \u200djoined Albuquerque Mayor Tim \u200cKeller and Police Chief \u2062Harold Medina in saying that they wouldn\u2019t enforce the order.<\/p>\n<p>Chief\u2064 Medina \u2062said that Albuquerque police have made more than 200 arrests \u2062of suspects in killings in the\u200d past two years. \u2063Police spokesman Gilbert Gallegos \u200csaid enforcing the order also could put Albuquerque police in\u200d a difficult position \u200bwith\u200c a U.S. Department of Justice \u2064police reform settlement.<\/p>\n<p>\u201cAs an officer of the court, I\u2062 cannot and\u200d will not enforce something that is clearly unconstitutional,\u201d\u200c Mr. Bregman, the top prosecutor\u2064 in the Albuquerque \u2064area said. \u2064\u201cThis office will continue to focus on criminals\u200c of any age that use guns\u200c in\u2064 the commission of a\u2064 crime.\u201d<\/p>\n<p>Similarly, Bernalillo County Sheriff John Allen said \u200bhe was uneasy\u2064 about how \u2062gun owners\u2063 might \u200brespond. \u201cI am wary of placing my deputies in positions that could lead to \u2063civil liability conflicts,\u201d he said, \u200c\u201cas well as the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lawmakers-to-advance-tiktok-bill-us-house-speaker-says\/\" title=\"Lawmakers To Advance TikTok Bill, US House Speaker Says\">potential risks posed<\/a> by <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrat-governor-facing-calls-of-impeachment-from-musk-after-attack-on-2a\/\" title=\"Democrat Governor faces impeachment calls from Musk over 2A attack.\">prohibiting law-abiding citizens<\/a> \u200cfrom their\u2064 constitutional rights.\u201d<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>New Mexico Gov.
