Fulton County District Attorney \u200bFani Willis, a Democrat who initiated the racketeering prosecution, wants \u2063to try all the \u2062co-defendants together in state court, \u200cbut a state judge \u2062ordered that one of \u2064the co-defendants go to\u200d trial on Oct. 23.<\/p>\n<p>Mr. Meadows and\u2064 all the defendants in the case \u2064are accused of \u200dviolating the \u200cGeorgia \u2064RICO (Racketeer Influenced and Corrupt Organizations) Act from Nov.\u200c 4, 2020, which is the day after the presidential election, to Sept. 15, 2022. In other words, Mr. Meadows claims he cannot be prosecuted in\u2063 state court because whatever he\u200b did, it was done\u200c in \u200bhis official \u2064capacity as a federal\u2064 officer, and he \u200chad federal defenses available to\u200b him.<\/p>\n<p>Several co-defendants have also filed notices of removal with the same federal judge. President Trump himself filed a \u2062notice with the court on Sept. 7 indicating that he too may seek removal to federal court.<\/p>\n<p>The latest ruling by federal Judge\u2062 Steve C. Jones of the Northern District of Georgia\u2062 may suggest he is\u200d not inclined to grant the other removal\u200d motions, either.<\/p>\n<p>The case\u200c has been watched closely because this is the first time that substantive arguments have \u2062been made in court in\u2064 any\u200d of the \u200dfour criminal\u2063 cases that\u2064 have \u200dbeen brought against\u200d President Trump and his fellow defendants this year.<\/p>\n<p>Some liken the motion \u200bfor so-called removal to federal court to \u2064a mini-trial for President Trump and his co-defendants\u200d and speculate\u2064 that\u2064 the treatment Mr. Meadows receives in federal court will\u200b be a bellwether for \u2064how \u2062the various Trump-related\u2063 prosecutions will proceed.<\/p>\n<div class=\"my-5\">\n<p>Mr. Meadows\u2019s new <a href=\"https:\/\/www.courtlistener.com\/docket\/67694389\/71\/the-state-of-georgia-v-meadows\/\" target=\"_blank\" rel=\"noopener\">notice\u2064 of appeal<\/a> directed to the U.S. Court \u200cof Appeals for\u200d the 11th Circuit\u200b was docketed the evening of \u200bSept. 8, just hours after\u2064 Judge Jones \u2062 <a href=\"https:\/\/www.theepochtimes.com\/us\/federal-judge-denies-meadows-request-to-transfer-state-racketeering-case-to-federal-court-5486960\" target=\"_blank\" rel=\"noopener\">sent the case<\/a> back to Fulton County Superior\u2062 Court in Atlanta because\u200d he lacked jurisdiction\u2062 in the matter. Judge Jones was \u2064appointed \u2064in 2011\u2063 by President Barack Obama, a Democrat.<\/p>\n<\/div>\n<p>The notice\u200c does \u200bnot lay\u2063 out Mr. Meadows\u2019s \u200darguments in the appeal.<\/p>\n<p>The 11th Circuit Court of\u200d Appeals has a reputation as a conservative court. Emergency applications\u2062 arising out of the \u2064circuit \u2062court\u2019s decisions \u2062would\u200b be directed to Supreme\u200d Court Justice Clarence Thomas, that court\u2019s leading conservative, who oversees the 11th Circuit.<\/p>\n<div class=\"my-5\">\n<p>In a 49-page <a href=\"https:\/\/www.courtlistener.com\/docket\/67694389\/69\/the-state-of-georgia-v-meadows\/\" target=\"_blank\" rel=\"noopener\">order<\/a>, \u200bJudge Jones wrote that he \u200dwas addressing \u2062the \u201crelatively\u2064 narrow question\u201d of whether Mr. Meadows had \u201ccarried\u2063 his \u2064burden of\u2063 demonstrating that removal of the State of Georgia\u2019s criminal \u200bprosecution against him is proper under the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/donald-trump-indicted-what-is-rico-and-how-might-it-spell-jail-time-for-ex-president\/\" title=\"Donald Trump indicted: RICO explained, potential jail time for ex-president.\">federal officer removal statute<\/a>.\u201d<\/p>\n<\/div>\n<p>\u201cHaving considered the\u200c arguments and evidence, the Court concludes that Meadows \u2064has not met his burden. Therefore, the Court declines to assume \u200cjurisdiction over\u2062 the\u2063 State\u2019s criminal prosecution\u2062 of Meadows \u2026 \u200band remands the case to Fulton County Superior Court.\u201d<\/p>\n<p>The decision came after the\u200c judge asked the defense and state prosecutors to\u200d provide a post-hearing briefing as \u200bto whether he \u200ccould hear the case in federal \u200dcourt if he \u200cfound \u200ca single overt act Mr. Meadows committed was protected by\u200c federal \u200dlaw. Eight \u200bovert acts\u200d were\u200b attributed \u2064to Mr. Meadows in the indictment.<\/p>\n<p>In his \u2062ruling, Judge Jones wrote that\u2063 some of the overt acts\u2062 Mr. Meadows is accused of in the indictment were within \u2063the scope of\u200c his \u200bduties as a federal officer, but other \u2064acts were not.<\/p>\n<p>\u201cBecause \u200bthe\u200b inquiry hinges on whether Meadows\u2019s association with the conspiracy related \u200bto the color of his office, however, jurisdiction is not conferred simply because a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-trump-aide-meadows-appeals-loss-in-court-to-11th-circuit\/\" title=\"Ex-Trump aide Meadows appeals court loss to 11th Circuit.\">single overt act relates<\/a> \u2063to Meadows\u2019s federal \u200boffice.\u2064 After all, the \u2062Indictment \u200balleges a series of associative\u200d acts spanning over a year, and the overt acts \u2062attributed to Meadows span three months,\u201d the\u200c judge wrote.<\/p>\n<p>\u201cUndoubtedly, during that\u2062 time Meadows performed actions \u200dfor or \u2064that related to\u200c the\u200b color of his office. \u200bBut the \u200drelevant inquiry is what activities go \u2063 [to] the heart of \u2064Meadows\u2019s\u2062 participation in the enterprise and whether those\u2062 activities relate \u2062to the scope of his federal office. If they\u200d do not, then Meadows\u2064 cannot satisfy his burden of establishing subject matter\u200c jurisdiction \u200dunder the \u200bfederal officer removal statute,\u201d he wrote.<\/p>\n<p>The court \u200dfound that Mr. Meadows\u2019s \u201cpolitical activities,\u201d such \u2064as \u201cworking with \u2064or working for the Trump \u2064campaign\u201d exceeded \u201cthe outer limits of the Office of the White\u2064 House Chief of Staff.\u201d<\/p>\n<p>Judge Jones also seemed concerned that \u201cwhen questioned about the scope of his authority, Meadows was unable to explain the limits of his authority.\u201d<\/p>\n<p>Because the \u201cprocedures States utilize to conduct elections and ensure results \u200care not\u200d part of the executive branch\u2019s role or power \u2026 Meadows cannot \u2062have acted in his role as a federal officer with respect \u2063to any efforts to influence, interfere\u200c with, disrupt, oversee, or change \u2062state\u200b elections: those activities are expressly delegated to\u2063 the States.\u201d<\/p>\n<p>Prosecutors<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Mark Meadows, ex-chief of staff under Trump, is appealing a federal judge&#8217;s decision to not hear state racketeering charges in federal court.
