Michelle Lujan Grisham\u2019s emergency order\u200b suspending the \u2064right to carry firearms in public in and around Albuquerque drew an immediate court challenge and also calls for her impeachment by Republicans in the legislature<\/p>\n<div class=\"my-5\">\n<p>New Mexico \u200cstate Reps. Stefani Lord and John Block, both Republicans, called for her\u200c impeachment after\u2063 she <a href=\"https:\/\/twitter.com\/GovMLG\/status\/1700304261383405883?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1700304261383405883%7Ctwgr%5Ef6fc97e7affd1220837b3f29ede4b67c84021514%7Ctwcon%5Es1_&#038;ref_url=https%3A%2F%2Fwww.zerohedge.com%2Fpolitical%2Ffull-authoritarian-new-mexico-governor-restricts-constitutional-gun-rights-law-abiding\" target=\"_blank\" rel=\"noopener\">issued<\/a> the order days ago, which prohibits citizens to carry guns in public around Albuquerque.<\/p>\n<\/p><\/div>\n<div class=\"my-5\">\n<p>&#8220;This is an abhorrent attempt at imposing a radical, progressive agenda on an unwilling populous. Rather than addressing crime at its core, Governor \u2063Grisham is restricting the rights \u2063of \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utah-axes-gun-permit-requirement\/\" title=\"Utah Axes Gun-Permit Requirement\u00a0\">law-abiding gun owners<\/a>,&#8221; Ms. Lord <a href=\"https:\/\/twitter.com\/Lord4NM\/status\/1700586411852734578?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1700586411852734578%7Ctwgr%5Ef6fc97e7affd1220837b3f29ede4b67c84021514%7Ctwcon%5Es1_&#038;ref_url=https%3A%2F%2Fwww.zerohedge.com%2Fpolitical%2Ffull-authoritarian-new-mexico-governor-restricts-constitutional-gun-rights-law-abiding\" target=\"_blank\" rel=\"noopener\">wrote<\/a> in a press release \u2064on X, formerly known as Twitter.<\/p>\n<\/p><\/div>\n<div class=\"shortcode\">\n<div class=\"border-comp-divider mb-4 mr-4 w-full max-w-[500px] border px-5 py-4 text-[16px] leading-[20px] text-[#262626] md:float-left\" id=\"in_article_related_stories\">\n<div class=\"mb-3 font-sans text-[16px] font-semibold uppercase leading-[19px] text-[#2F2F2F]\">Related Stories<\/div>\n<div class=\"mb-4 flex gap-2\">\n<div class=\"grow\">\n<div class=\"mb-1 line-clamp-2\"><a href=\"http:\/\/www.theepochtimes.com\/us\/new-mexico-governor-bans-carrying-guns-says-constitution-not-absolute-5489001\">New Mexico Governor Bans Carrying Guns, \u2062Says Constitution Not &#8216;Absolute&#8217;<\/a><\/div>\n<div class=\"text-comp-caption text-[14px] leading-[18px]\">9\/9\/2023<\/div>\n<\/p><\/div>\n<div class=\"shrink-0 basis-[120px]\"><a href=\"http:\/\/www.theepochtimes.com\/us\/new-mexico-governor-bans-carrying-guns-says-constitution-not-absolute-5489001\"><\/a><\/div>\n<\/p><\/div>\n<div class=\"mb-4 flex gap-2\">\n<div class=\"grow\">\n<div class=\"mb-1 line-clamp-2\"><a href=\"http:\/\/www.theepochtimes.com\/us\/california-becomes-first-state-to-pass-11-percent-tax-on-guns-and-ammunition-now-awaiting-governors-signature-5488751\">California Becomes First State \u2063to Pass 11 Percent Tax on Guns and Ammunition, Now Awaiting Governor\u2019s Signature<\/a><\/div>\n<div class=\"text-comp-caption text-[14px] leading-[18px]\">9\/8\/2023<\/div>\n<\/p><\/div>\n<div class=\"shrink-0 basis-[120px]\"><a href=\"http:\/\/www.theepochtimes.com\/us\/california-becomes-first-state-to-pass-11-percent-tax-on-guns-and-ammunition-now-awaiting-governors-signature-5488751\"><\/a><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>Mr. Block claimed that the governor has &#8220;called for open season on law-abiding citizens&#8221; by misinterpreting the Constitution and laws of the state. &#8220;That\u2019s something that needs to\u200c be remedied immediately,\u201d the lawmaker said.<\/p>\n<div class=\"my-5\">\n<p>In response to the impeachment threat, Mrs.\u200c Lujan Grisham&#8217;s office <a href=\"https:\/\/www.krqe.com\/news\/new-mexico\/two-lawmakers-call-for-impeachment-of-governor-lujan-grisham-after-public-health-order\/\" target=\"_blank\" rel=\"noopener\">said<\/a> the governor\u200c is &#8220;prepared \u200cto fight challenges to\u2063 her decision and recognizes not everyone\u2062 supports the public\u200b health order,&#8221; adding that it&#8217;s\u2062 a \u200d&#8221;public health emergency, and extraordinary measures are required to prevent more innocent New Mexicans from being killed by guns.&#8221;<\/p>\n<h2>Lawsuit Filed<\/h2>\n<p>The National Association for Gun Rights and Foster Haines, a member who lives \u200din Albuquerque, filed documents (<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nmd.492592\/gov.uscourts.nmd.492592.2.0.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) in U.S. District\u200c Court in New Mexico suing Lujan Grisham and seeking an immediate block to the implementation of her order.<\/p>\n<\/p><\/div>\n<p>\u201cThe State must justify the Carry Prohibition by demonstrating\u200d that it \u2063is consistent with the Nation\u2019s\u200d historical tradition \u200cof firearm regulation,\u201d the lawsuit said. \u201cBut it is impossible for the State \u200bto meet this burden, because there is no such historical tradition\u2064 of\u200c firearms regulation in this Nation.\u201d<\/p>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>The president of the pro-gun group, Dudley Brown, said that Mrs. Lujan Grisham\u2019s order is essentially a &#8220;middle finger&#8221; to the\u2064 U.S. Constitution and the Supreme Court, according to a statement.<\/p>\n<p>\u201cHer executive order is in\u2064 blatant disregard for \u2064Bruen. She\u200d needs to be \u200dheld accountable for stripping the God-given rights of millions away with the stroke of a pen,\u201d Mr. Brown said, referring to a previous Supreme Court order on gun rights.<\/p>\n<p>The governor, a Democrat, said the 30-day suspension, enacted as an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/baltimore-county-blames-unvaccinated-for-mask-mandate-people-selfishly-choose-not-to-get-the-shot\/\" title=\"Baltimore County Blames Unvaccinated for Mask Mandate: People 'Selfishly' Choose Not to Get the Shot\">emergency public health measure<\/a>, would apply in most public places, from city sidewalks to \u2064parks. Mrs. Lujan Grisham \u2062said that the \u200cstate police would be responsible for \u200cenforcing what amount to civil violations and carry a fine of up to $5,000. In<\/p>\n<p>Lujan Graham argued that the order was designed to help reduce the number \u2063of shootings in New Mexico, while calling on the federal government&#8217;s help.<\/p>\n<p>\u201cThese are disgusting acts of violence \u2063that have no place in our communities,\u201d Mrs. Lujan Grisham\u200b said Thursday, saying that Bernalillo County needed a \u201ccooling off period\u201d amid a rise in shootings. She also said her state should use the &#8221; power of a public health [order] in a state\u200c of emergency to access different\u2063 levels, different\u200c resources,\u2063 and different opportunities to\u200d keep\u2062 New Mexicans\u2062 safe.&#8221;<\/p>\n<p>The order stipulated that gun owners still would be able to transport guns to private locations \u200bsuch as a gun\u200d range or gun \u200bstore if the firearm is in a container or has a trigger lock or mechanism making \u200bit impossible to discharge.<\/p>\n<p>In issuing the\u200b order, she said she was compelled to act after an 11-year-old boy \u200bwas shot and killed outside a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lawmakers-call-for-new-mexico-governors-impeachment-after-emergency-gun-order\/\" title=\"Lawmakers demand New Mexico Governor's impeachment over gun order.\">minor league baseball\u2064 game stadium<\/a> as well as gunfire that left a 5-year-old girl dead.<\/p>\n<div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Firearms in Houston, Texas, on February 18, 2023. (Mark Felix\/AFP via Getty Images)<\/figcaption><\/figure>\n<\/p><\/div>\n<div class=\"my-5\">\n<h2>Reactions<\/h2>\n<p>But some Democratic officials, sheriffs, and even district attorneys said they cannot enforce her order.<\/p>\n<\/p><\/div>\n<p>Bernalillo County\u2064 District Attorney Sam Bregman, who\u2062 once served as a Democratic party leader and was appointed by Lujan \u2064Grisham, on Saturday joined Albuquerque Mayor Tim Keller\u2062 and Police Chief Harold Medina saying they wouldn\u2019t enforce the order.<\/p>\n<p>Mr.\u2064 Medina noted that\u200d Albuquerque police made more than 200 arrests of\u200b suspects in killings in the last two years. Police spokesman Gilbert Gallegos said\u2064 enforcing the order also could \u2063put Albuquerque police in a difficult position with a \u2064U.S. Department of Justice police\u200d reform settlement.<\/p>\n<p>\u201cAs an officer of the court, I cannot and will not enforce \u200bsomething that is \u2064clearly unconstitutional,\u201d said Mr.\u200c Bregman, the top prosecutor in the Albuquerque area. \u201cThis office\u200c will continue to focus \u2064on criminals of\u2062 any age that use guns in\u2064 the commission \u2063of a crime.\u201d<\/p>\n<p>Similarly, Bernalillo County Sheriff John\u2063 Allen said he was uneasy about how gun owners might respond. \u201cI am wary of placing my deputies in positions that could lead to civil liability conflicts,\u201d he said, \u201cas well as the potential risks posed by <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrat-governor-facing-calls-of-impeachment-from-musk-after-attack-on-2a\/\" title=\"Democrat Governor faces impeachment calls from Musk over 2A attack.\">prohibiting law-abiding citizens<\/a> from \u200dtheir constitutional rights.\u201d<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>New Mexico Gov.
