A New York state judge ruled\u2063 last week that\u2063 they must be reinstated with back pay.<\/p>\n<blockquote>\n<p>\u201cThis\u2062 Court \u200csees no\u200c rational basis for\u2063 not <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/teachers-who-refused-covid-shots-must-be-reinstated-with-back-pay-rules-state-supreme-court-judge\/\" title=\"State Supreme Court Judge rules teachers who declined COVID shots must be reinstated with back pay.\">allowing unvaccinated classroom \u200bteachers<\/a> in amongst an admitted population of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nyc-teachers-reinstated-with-backpay-after-refusing-covid-19-vaccinations\/\" title=\"NYC teachers get backpay after refusing COVID-19 shots.\">primarily unvaccinated students<\/a>,\u201d wrote Judge Ralph J. Porzio \u200bin his ruling.<\/p>\n<p>\u201cAs such, the decision to summarily deny the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-administration-expected-to-bring-back-obama-era-school-discipline-rules-which-led-to-racial-quotas\/\" title=\"Biden Administration Expected To Bring Back Obama-Era School Discipline Rules, Which Led To Racial Quotas\">classroom teachers<\/a> amongst the Panel Petitioners \u200bbased \u2062on an undue \u200dhardship,\u200b without any \u200cfurther evidence of individualized analysis, is arbitrary, capricious, and unreasonable,\u201d he added.<\/p>\n<\/blockquote>\n<p>The\u2064 case, known as DiCapua v. City of New York, involved a \u200bgroup of educators who sued after their requests for a religious exemption were denied.<\/p>\n<p>This is not the first time Judge Porzio has ruled in favor of employees affected by vaccine mandates. Last \u200cyear, he \u2062ordered 16 Sanitation\u200d Department workers to be reinstated because the vaccine\u200b mandate was put in place illegally.<\/p>\n<p>Sujata Gibson, the lawyer representing the teachers, called the ruling a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/san-francisco-school-officials-unions-reach-tentative-deal-after-city-files-lawsuit\/\" title=\"San Francisco School Officials, Unions, Reach Tentative Deal After City Files Lawsuit\">major step forward<\/a>. She stated, \u201cWe\u2019ve been fighting\u200c for this since August of 2021 for these 10 people specifically. \u2062And we won and we won big for them. They were reinstated with back\u2062 pay, with no break in service, and attorneys\u2019 fees. That\u2019s\u2063 huge.\u201d<\/p>\n<p>However, the victory has its \u2063limitations. Only\u2062 those who sought a religious accommodation were granted \u2064their jobs \u200dback.\u200c Additionally, a request to file a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/elon-musk-slams-woke-esg-initiatives-its-communism-rebranded\/\" title=\"Elon Musk criticizes woke ESG initiatives as 'rebranded communism'.\">class action \u200clawsuit<\/a> was denied. Nevertheless,\u2064 Gibson remains hopeful, saying, \u201cThe court\u2019s ruling in\u2062 the class certification still leaves the door open to future relief for thousands\u200d of teachers negatively affected by the vaccine requirement.
