Donalds Slams Biden Administration For Pressuring Social Media \u2018To Censor Speech\u2019\">pressuring social media companies<\/a> to\u2064 moderate \u200cor remove content they deemed problematic.<\/p>\n<p>The\u200d court panel,\u2062 based in New Orleans, \u2062narrowed\u200b down an injunction issued by \u200ba Louisiana judge that restricted the \u200bBiden administration from \u2062communicating with <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-new-acting-attorney-general-jeff-rosen-recently-wrote-an-essay-on-foreign-influence-in-us-elections-this-tells-us-a-little-about-his-knowledge-of-whats-going-on-today\/\" title=\"The New Acting Attorney General Jeff Rosen Recently Wrote an Essay on Foreign Influence in US Elections \u2013 This Tells Us A Little About His Knowledge of What\u2019s Going On Today\">social media platforms<\/a>. However, they affirmed that the White House, Surgeon \u2063General, Centers for Disease Control and\u200d Prevention (CDC), and the \u2064FBI had &#8220;likely coerced or significantly encouraged social media \u200cplatforms to moderate content&#8221; \u200cin violation of the First Amendment.<\/p>\n<blockquote>\n<p>&#8220;It is true that the officials have an interest \u200din engaging with\u200c <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/newsom-challenges-biden-for-censor-in-chief-title\/\" title=\"Newsom challenges Biden as the Censor-In-Chief.\">social media\u2064 companies<\/a>, including on issues such as misinformation and election \u2064interference,&#8221; the three-judge panel said in a 74-page ruling (<a href=\"https:\/\/ago.mo.gov\/wp-content\/uploads\/Doc.-238-1-Fifth-Circuit-Opinion.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) on Sept. 8.<\/p>\n<p>&#8220;But the government is not\u2064 permitted to advance these interests to the extent\u200c that \u2062it engages in\u2063 viewpoint suppression,&#8221; they \u200dadded.<\/p>\n<\/blockquote>\n<p>The court found \u2062that the officials\u200d made &#8220;express threats&#8221; and &#8220;inflammatory accusations&#8221; by stating that the\u200c platforms were \u2063&#8221;poisoning the \u200bpublic&#8221; and &#8220;killing people.&#8221; They \u2062insisted that the platforms needed to take &#8220;greater responsibility and action.&#8221;<\/p>\n<blockquote>\n<p>&#8220;Then, they followed their statements with\u200b threats of &#8216;fundamental reforms&#8217; like \u200bregulatory \u200dchanges and increased enforcement actions that would ensure the \u200dplatforms were &#8216;held \u200daccountable&#8217;. But, beyond express threats, there was always an\u200d unspoken &#8216;or else,'&#8221; it\u200d added.<\/p>\n<\/blockquote>\n<p>The \u200ccourt also highlighted that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-officials-likely-violated-first-amendment-on-social-media-5th-circuit-court\/\" title=\"5th Circuit Court: Biden Officials May Have Breached First Amendment on Social Media.\">officials actively encouraged social media platforms<\/a>\u200b to moderate content by exerting control over their decisions, particularly regarding moderation policies.\u200d The FBI,\u2062 in \u2063particular, \u2064had regular meetings with the platforms, shared strategic information, alerted them to misinformation, and monitored their content moderation policies.<\/p>\n<blockquote>\n<p>&#8220;But, the FBI went beyond that\u2014they urged the\u2063 platforms to \u200ctake down\u200c content. Turning to the\u200c Second \u200dCircuit&#8217;s four-factor test, we find\u200b that\u2063 those requests \u2064were coercive,&#8221; it added.<\/p>\n<\/blockquote>\n<p>The judges\u2062 emphasized that the government cannot oversee a platform&#8217;s\u200c content moderation decisions or impose legal, regulatory,\u2062 or economic consequences if they refuse to comply with requests. \u2062They firmly stated that social media \u200cplatforms must have sole control over their content moderation decisions.<\/p>\n<p>Last year, \u200cthe attorneys general of Louisiana and Missouri, along with several <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/watch-furious-ca-restaurant-owner-confronts-inspectors-issuing-citation-are-you-gonna-pay-my-rent\/\" title=\"WATCH: Furious CA Restaurant Owner Confronts Inspectors Issuing Citation: \u2018Are You Gonna Pay My Rent?\u2019\">social media users<\/a>, filed a lawsuit\u2064 alleging that Facebook, YouTube, and Twitter engaged in censorship due to pressure from government officials and threats of regulatory enforcement. The censored content included discussions \u200dquestioning COVID-19 measures and allegations of\u2063 election fraud.<\/p>\n<p>The court ruling acknowledged that encouraging the removal of content does not always violate \u200cthe Constitution, and\u200b they removed certain provisions from the broad July 4\u2063 ruling \u200cby U.S.\u200d District Judge Terry \u2064Doughty, deeming them unnecessary and overbroad.<\/p>\n<p>This landmark ruling \u200dsets \u2062an important precedent for \u2062the protection of free speech and the limitations on government interference in social media platforms.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The 5th Circuit Court of Appeals found that Biden officials violated the First Amendment by pressuring social media platforms to remove objectionable content.
