Porzio found (<a href=\"https:\/\/childrenshealthdefense.org\/wp-content\/uploads\/september-2023-new-york-teachers-decision-order.pdf\">pdf<\/a>) that the city\u2019s denials of religious exemptions to certain city teachers was unconstitutional, capricious, and arbitrary. In the case, principals, teachers, and other school workers filed a \u200dlawsuit sponsored by the anti-mandate Children\u2019s Health Defense against the Department of Education after their attempts to \u2063claim a religious accommodation\u2064 for the mandate were denied.<\/p>\n<p>\u201cThis Court sees no \u2064rational basis for not <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-rules-teachers-can-get-jobs-back-with-back-pay-after-refusing-covid-19-vaccine\/\" title=\"Judge allows teachers to be rehired with back pay after refusing COVID-19 vaccine.\">allowing unvaccinated classroom\u2064 teachers<\/a> in amongst an admitted population of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nyc-teachers-reinstated-with-backpay-after-refusing-covid-19-vaccinations\/\" title=\"NYC teachers get backpay after refusing COVID-19 shots.\">primarily unvaccinated students<\/a>,\u201d Judge Porzio wrote. \u201cAs such, the decision to summarily deny the classroom teachers amongst the Panel Petitioners based on an undue hardship, without \u2062any further evidence \u200dof individualized analysis, is\u200b arbitrary, capricious, and unreasonable. As such, each classroom teacher amongst the Panel Petitioners \u2062is entitled to a religious exemption from the Vaccine Mandate.\u201d<\/p>\n<p>The judge also \u200bcriticized the city\u2019s assertion that allowing classroom teachers to get a religious exemption would place undue hardship on the city, calling the claim \u201carbitrary, capricious, and unreasonable.\u201d<\/p>\n<p>In the order, he granted\u2062 relief to 10 \u200cplaintiffs \u2063who completed the administrative steps to request an exemption. He\u2064 denied relief to\u200c six plaintiffs because they did not complete the administrative process.<\/p>\n<p>As part of his ruling, Judge Porzio made reference\u2064 to Mayor Eric Adams\u2019s <a href=\"https:\/\/www.espn.com\/nba\/story\/_\/id\/33585252\/nyc-mayor-eric-adams-allows-unvaccinated-athletes-play-home-games\">lifting<\/a> of a \u2064vaccine mandate for some private employees in 2022, notably celebrities and athletes. He said the decision was evidence that the \u200bmandate \u2063for public workers was done on an arbitrary \u2063basis.<\/p>\n<p>New York City \u2063imposed a COVID-19 vaccine mandate for all Department of Education workers that started on Oct. 1, 2021, and\u2062 lasted until Feb. 10, 2023. Reports indicated\u200c that thousands of workers, teachers, and other \u200bstaffers lost their jobs for not adhering to the mandate.<\/p>\n<figure id=\"attachment_5295014\" style=\"width: 640px\" class=\"wp-caption alignnone\">\n    <a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2023\/05\/26\/id5295014-Eric-Adams-GettyImages-1493231083-1200x800.jpg\"><figcaption class=\"wp-caption-text\"><noscript><\/noscript><\/figcaption><\/a><br \/>\n  <\/figure>\n<p>Other cities also imposed mandates on their workers throughout the pandemic. In late\u200b 2021, President Joe Biden announced that he would use the federal \u200bOccupational Safety\u2064 and Health Administration to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-biden-to-force-private-companies-to-mandate-vaccinations-weekly-covid-tests-report\/\" title=\"BREAKING: Biden To Force Private Companies To Mandate Vaccinations, Weekly COVID Tests: Report\">force private companies<\/a> with\u200c 100 or more employees to require the vaccine,\u2063 which was struck \u2064down by the U.S. Supreme Court months later. However, mandates were imposed on federal employees and contractors for \u2064years.<\/p>\n<p>An attorney for the New York plaintiffs, Sujata \u2064Gibson, told Children\u2019s Health Defense that they \u2062have \u201cbeen fighting for this since August of 2021 for\u2062 these 10 people specifically. And\u200c we won\u2064 and we won big for them,\u201d adding, \u201cThey were reinstated with back pay,\u2062 with no break in service, and\u2063 attorneys\u2019 fees.\u200c That\u2019s huge.\u201d<\/p>\n<p>\u201cThe\u2062 judge\u2019s ruling yesterday, while not \u2062everything we wanted,\u200c is a precedent-setting victory, and a watershed moment in\u2064 the teachers\u2019 fight,\u201d she added, noting that thousands of unvaccinated workers who were also denied a religious exemption could\u2062 sue based on the new precedent.<\/p>\n<p>The lawyer, meanwhile, suggested that another\u200c class action lawsuit may be filed in the future.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>A New York judge ordered the reinstatement of 10 employees fired by the NYC Department of Education for vaccine refusal.
