Tom Umberg (D-Santa Ana) \u200cprovided the final vote \u200cDemocrats needed to pass <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billVotesClient.xhtml?bill_id=202320240AB28\" target=\"_blank\" rel=\"noopener\">Assembly Bill 28<\/a>\u2014the Gun Violence Prevention and Schools Act\u2014which \u2064passed with the\u2063 required two-thirds margin. The bill\u200b now awaits Gov. Gavin Newsom\u2019s \u2064signature before becoming law.<\/p>\n<\/div>\n<p>The final\u2062 tally was 27\u20139 after Sen. Marie Alvarado-Gil\u200b (D-Jackson) joined with Senate Republicans to vote against it. Seven additional members\u2014six\u2064 Democrats and one Republican\u2014did not vote.<\/p>\n<div class=\"my-5\">\n<p>\u201cIt\u2019s shameful that gun manufacturers \u2063are\u200b reaping record profits at the same time that\u200d gun violence has\u2062 become the leading cause \u2063of death for kids \u200din the United States,\u201d \u200dMr. Gabriel \u200csaid in a <a href=\"https:\/\/a46.asmdc.org\/press-releases\/20230712-new-excise-tax-guns-clears-final-policy-committee-california-legislature\" target=\"_blank\" rel=\"noopener\">July statement<\/a>. \u201cThis bill will\u2062 fund critical school safety measures\u200c and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/three-high-profile-bills-the-california-legislature-will-hear-before-session-ends\/\" title=\"Three important bills awaiting consideration by the California legislature before session concludes.\">proven violence prevention programs<\/a> that\u2064 will save lives and protect communities across California.\u201d<\/p>\n<\/div>\n<div class=\"my-5\">\n<p>The bill now awaits Gov. Gavin Newsom\u2019s \u200dsignature before becoming law. If \u2062signed, California would become the first state \u2062to impose such\u200b a tax, though some municipalities\u2014such as <a href=\"https:\/\/www.seattle.gov\/city-finance\/business-taxes-and-licenses\/seattle-taxes\/firearms-and-ammunition-tax#:~:text=The%20tax%20is%20imposed%20on,in%20business%20in%20the%20city.\" target=\"_blank\" rel=\"noopener\">Seattle<\/a> and Pennsylvania\u2014collect fees on gun sales and ammunition.<\/p>\n<\/div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>The California state capitol building \u200bin Sacramento, Calif., on\u2063 March 11, 2023. The \u200bUnited States began taxing guns and ammunition over 100 years \u200cago and now <a href=\"https:\/\/sgp.fas.org\/crs\/misc\/IF12173.pdf\" target=\"_blank\" rel=\"noopener\">charges<\/a> 10 percent on the wholesale price of\u200c handguns\u200d and an 11 percent tax\u2064 on long guns and ammunition \u2063to\u200d pay for\u2062 wildlife restoration \u2064projects.<\/p>\n<\/div>\n<p>California already charges fees \u200cof $31 on gun sales to cover background checks.<\/p>\n<p>The\u200c state\u2019s\u2063 tax and fee department estimates the new\u2062 tax would generate $159 \u2063million from July 2024\u200b to\u200c July 2025. If dealers pass the tax onto customers, it would generate another $14 million\u200b in state and local sales and tax revenue\u2014$6.3 million\u200b of which would go to the state\u2019s\u200c General Fund, according to a legislative analysis.<\/p>\n<p>The\u2062 bill would\u200d also establish \u200ba fund to pay for\u2064 school\u2063 safety and\u200d gun-violence reduction programs, counseling and support \u200dprograms\u2063 for victims, firearm violence research, and \u2064a court-based program to seize firearms from subjects named in domestic violence protective\u200c orders.<\/p>\n<p>Former Democratic Arizona Congresswoman Gabrielle Giffords, who survived an assassination attempt in 2011, applauded the measure\u2019s passage.<\/p>\n<div class=\"my-5\">\n<p>\u201cCalifornia just made history \u2013 again,\u201d \u200cGiffords said\u2062 in \u2062a <a href=\"https:\/\/giffords.org\/press-release\/2023\/09\/california-senate-passes-landmark-fund-for-gun-violence-prevention-programs\/\" target=\"_blank\" rel=\"noopener\">statement<\/a> posted on her\u200c website Giffords: Courage\u200b to Fight \u2063Gun Violence. \u201cThe state continues \u200cto take on the gun lobby and \u2062pave \u2063the way for effective methods\u2063 to reduce \u2064gun violence.\u201d<\/p>\n<\/div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Gabrielle Giffords\u200c and Mark Kelly \u2063attend the 2018 Glamour Women Of The Year Awards: Women Rise in New York City on Nov. 12, 2018. \u200d(Photo \u2064by Bryan Bedder\/Getty Images for Glamour)<\/figcaption><\/figure>\n<p>Additionally, \u200bthe gun-control activist organization Moms Demand Action was grateful to legislators who approved the measure.<\/p>\n<div class=\"my-5\">\n<p>\u201cThis bill is an\u2062 innovative approach to tackling gun violence and\u200d a crucial step to improve the safety\u2063 of all California \u200dfamilies,\u201d Cassandra Whetstone,\u2062 a volunteer with the\u2062 group\u2019s\u2063 California chapter, said\u200c in a <a href=\"https:\/\/momsdemandaction.org\/victory-for-gun-safety-following-tireless-advocacy-from-moms-demand-action-students-demand-action-volunteers-california-senate-passes-the-gun-violence-prevention-and-school-safety-act\/\" target=\"_blank\" rel=\"noopener\">Sept. 7 statement<\/a>. \u201cWe are grateful to \u200cgun sense champions in the [Legislature] and community partners who\u2062 worked so hard to pass this\u2062 comprehensive bill that seeks to\u2063 make our communities safer \u200band \u2063target the\u200b root causes of \u200dgun violence.\u201d<\/p>\n<\/div>\n<p>However, the National Rifle Association (NRA) opposed the new tax, saying it was \u2064not fair.<\/p>\n<div class=\"my-5\">\n<p>\u201cIt is unjust to saddle law-abiding\u2062 gun owners with special taxes,\u201d the NRA\u2064 said on its<a href=\"https:\/\/www.nraila.org\/articles\/20230905\/california-anti-gun-bills-eligible-for-floor-votes-as-the-legislature-enters-the-final-two-weeks-of-session\" target=\"_blank\" rel=\"noopener\"> website<\/a>. \u201cSuch\u2064 a \u2062measure makes it\u2064 more expensive\u2064 for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-sheriffs-tell-newsom-they-wont-enforce-covid-curfew\/\" title=\"California Sheriffs Tell Newsom They Won't Enforce COVID Curfew\">law-abiding citizens<\/a> to exercise a constitutional right and discourages them from practicing to be safe and proficient with their \u2062firearms for purposes\u2063 such as self-defense, competition,\u2063 and hunting.\u201d<\/p>\n<\/div>\n<p>Sales to active \u2062or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-passes-assault-weapons-ban-along-party-lines-likely-doomed-in-the-senate\/\" title=\"House Passes \u2018Assault Weapons\u2019 Ban Along Party Lines, Likely Doomed in the Senate\">retired law enforcement officers<\/a> or any law enforcement \u2064agency would be \u200bexempt\u200b from\u200d the tax.<\/p>\n<p>Among the lawmakers who \u2062opposed the \u2062measure, Ms. Alvarado-Gil told \u200dcolleagues on the Senate floor Thursday\u2063 she researched gun violence statistics, and her\u200b findings didn&#8217;t match data \u200dincluded in the bill. She said her data showed drug overdose deaths far outnumbered firearm \u2063deaths in \u200bthe state.<\/p>\n<p>She \u200bsaid she also \u200cdiscovered that California had the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-becomes-first-state-to-pass-11-percent-tax-on-guns-and-ammunition-now-awaiting-governors-signature\/\" title=\"California passes 11% tax on guns and ammo, awaiting governor's approval.\">lowest\u2064 mass-shooting victimization rate<\/a> among \u2064the most populous\u200d states.<\/p>\n<p>\u201cFor me, I tend to analyze\u200d the legislation before us,\u201d Ms. Alvarado-Gil said. \u201cWhen I look at\u200b this very sensitive issue, I feel that we have \u200ba duty to legislate through facts, and not fear.\u201d<\/p>\n<p>Sen. Brian Dahle\u2063 (R-Bieber) also highlighted drug overdose deaths compared to those\u2062 from gun violence when arguing against the\u2064 bill.<\/p>\n<p>According to Mr. Newsom\u2019s office, California\u2019s gun death rate is 43 percent lower than\u2064 the\u2064 rest \u2062of the nation\u2019s and the state is \u200branked No. 1 for gun safety\u2064 by the gun-control advocacy organization Giffords \u200bLaw Center, also associated with the former Arizona congresswoman.<\/p>\n<div class=\"my-5\">\n<p>The state\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/good-riddance-country-music-fans-trash-cmt-for-touting-gun-control-campaign-promise-boycott\/\" title=\"\u2018Good Riddance\u2019: Country Music Fans Trash CMT For Touting Gun Control Campaign, Promise Boycott\">gun homicide rate<\/a>\u2063 is also 33\u200c percent lower than the \u200dnational average, the governor\u2019s office\u2063 said in a press <a href=\"https:\/\/www.gov.ca.gov\/2023\/08\/29\/fact-sheet-new-findings-continue-to-show-californias-gun-safety-laws-work\/\" target=\"_blank\" rel=\"noopener\">release<\/a> Aug.\u2063 29.<\/p>\n<\/div>\n<div class=\"my-5\">\n<p>Meanwhile, California saw nearly\u2062 6,000 <a href=\"https:\/\/www.cdph.ca.gov\/Programs\/OPA\/Pages\/Communications-Toolkits\/Fentanyl-Overdose-Prevention.aspx\" target=\"_blank\" rel=\"noopener\">deaths<\/a> from fentanyl\u200b in 2021, according to the California Department of Public Health.<\/p>\n<\/div>\n<p>\u201cYou want to do something about\u200b deaths in California, why\u200c don\u2019t we focus on \u200bfentanyl?\u201d Mr. Dahle asked senators. \u2063\u201cWhy don\u2019t we focus on\u200c fentanyl more than we focus on taxing young folks and people who \u200cenjoy their Second Amendment\u200c rights?\u201d<\/p>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>California state\u2064 Sen. Kelly Seyarto (R-Murrieta)\u2063 additionally called the bill \u201cineffective.\u201d \u2063He also noted that some initiatives, such \u2062as gun buyback programs, can backfire\u2063 and allow people to turn firearms into\u200d being destroyed after the guns are used in crimes.<\/p>\n<p>\u201cThat gun gets destroyed \u2064and there goes the evidence,\u201d Mr.\u2064 Seyarto said. \u201cUntil we start going after \u200bwhere\u200d those illegal guns are coming from, and holding the\u200b people who have\u200b those illegal guns accountable, you\u2063 are not going to do anything.\u201d<\/p>\n<p>Democrat Sen. Bill Dodd, of Napa,\u2063 also\u2064 opposed the bill, he said, \u2064because duck hunters were left \u2063out \u2064of the process.<\/p>\n<p>\u201cI \u200dthink there is a way to\u200d exclude these\u2064 70,000 duck hunters [from paying the tax],\u201d \u200cMr. Dodd said. \u201cFrankly, I look \u2063at this as something, when you add another 11 \u2063percent [tax], all it\u2019s going to do is decrease the number of young hunters \u2063and sooner.\u201d<\/p>\n<p>Sen. Anna Caballero (D-Merced) agreed, saying duck hunters have contributed greatly to a \u200dlarge wetland conservation area in her district,\u2064 and placing another \u200bfee on that kind of \u200cactivity \u200cwas an unfair burden.<\/p>\n<p>Sen. Dave Cortese (D-San Jose) also refrained \u2064from voting because he did not \u200cagree with passing \u2064the tax onto consumers.
