Roberts, Senate Judiciary Chairman Dick Durbin (D-Ill.), along with others, asked him to take\u2064 \u201cappropriate steps to ensure\u201d that Justice Alito \u200cwill recuse \u200cfrom the Moore v. United\u2063 States case. Because this case\u200b is scheduled to be heard soon, and because\u200d of \u2064the attention my planned participation in \u2063this case has already received, I \u2063respond to these \u200bconcerns \u2064now,\u201d he wrote.<\/p>\n<p>When\u2063 Mr. Rivkin participated in the interviews, he did \u200d\u201cas a journalist, \u2062not an advocate,\u201d \u2064Justice Alito said. He pointed out that many justices have, over the years, \u2062taken part in interviews with representatives of media outlets that have \u201cfrequently \u2064been\u200b parties in cases before the Court.\u201d<\/p>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>\u201cMany of\u200d my colleagues have \u2063been interviewed by\u200c attorneys who have \u200dalso practiced in this Court, and\u2062 some have co-authored books with\u200b such\u200c attorneys. Those interviews did\u200b not result in or require\u2062 recusal.\u201d<\/p>\n<p>Justice\u200c Alito wrote that Senator Durbin\u2019s request for recusal is based on a theory that his vote in the Moore\u200d v. United States \u2063case would be\u2064 affected \u201cin \u2063some way\u201d due to interviews with Mr. Rivkin.<\/p>\n<p>\u201cThat\u200d theory fundamentally misunderstands the circumstances \u2064under which Supreme Court Justices must work.\u201d<\/p>\n<p>Supreme Court \u2062Justices often have to preside over cases \u2062in which one of the attorneys have\u200c spoken favorably\u200b or unfavorably about their work. The justices also receive briefs\u2063 from Members of Congress who have supported or opposed their Supreme Court confirmations \u200cor \u200bhave made positive or\u200d negative comments about them, he said.<\/p>\n<p>If the justices were to recuse themselves from such \u2063cases, the Supreme Court would \u200c\u201cregularly have \u200cless\u2063 than a \u200cfull bench.\u201d<\/p>\n<p>\u201cIn all the instances \u2062mentioned above, we are required to put\u200b favorable or unfavorable \u2062comments and any personal connections \u2063with \u2062an attorney out of our minds and judge\u2062 the cases\u2064 based solely on the law and the facts,\u201d Justice Alito \u200dwrote.<\/p>\n<p>\u201cAnd that is what we do. For these reasons, there is \u200cno sound reason for my\u200c recusal \u200cin\u200c this case, and \u200bin accordance with the\u2064 duty to sit, I decline to recuse.\u201d<\/p>\n<div class=\"my-5\">\n<p>Justice Alito usually recuses himself from lawsuits where he has financial investments with any of the involved parties. But there has been a recent rise in requests that he stay away from\u2062 certain cases. This has seen the Justice pushing back \u2063against\u200d such persistent demands.<\/p>\n<h2>Congress Versus \u2062Supreme Court<\/h2>\n<p>Justice Alito\u2019s interviews with\u200b Mr. Rivkin had <a href=\"https:\/\/www.theepochtimes.com\/us\/democrats-target-justice-after-he-says-congress-has-no-authority-over-supreme-court-5432501\" target=\"_blank\" rel=\"noopener\">irked<\/a> several Democrats. In\u200c a July \u200d28\u200d interview, Justice Alito \u200cpointed out that \u2062\u201cCongress did \u2064not create \u200bthe Supreme Court\u201d\u2014the Constitution did. \u201cI know this\u2064 is\u200d a controversial view, but\u200b I\u2019m willing to \u2062say it \u2026 No provision in the Constitution gives them \u2062the\u2062 authority to regulate the Supreme Court\u2014period.\u201d<\/p>\n<p>\u201cI don\u2019t know that any of my\u2063 colleagues have spoken about \u200cit\u200b publicly, so I don\u2019t think I should say. But I think it is something\u2063 we have\u2063 all thought\u200d about.\u201d<\/p>\n<\/p><\/div>\n<div class=\"my-5\">\n<p>His \u200ccomments came as Democrats have put <a href=\"https:\/\/www.theepochtimes.com\/us\/democrats-target-justice-after-he-says-congress-has-no-authority-over-supreme-court-5432501\" target=\"_blank\" rel=\"noopener\">conservative<\/a>-leaning Supreme\u200d Court justices under scrutiny. Justice Alito was <a href=\"https:\/\/www.theepochtimes.com\/us\/democrats-target-justice-after-he-says-congress-has-no-authority-over-supreme-court-5432501\" target=\"_blank\" rel=\"noopener\">appointed<\/a> by a Republican \u2063President and had written the landmark decision \u2063overturning Roe. v. \u200cWade last year.<\/p>\n<\/p><\/div>\n<div class=\"my-5\">\n<p>According to the Congress <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artIII-S2-C2-6\/ALDE_00013618\/\" target=\"_blank\" rel=\"noopener\">website<\/a>, \u201cthe Constitution provides for the\u200c existence\u2062 of a Supreme Court, but \u200bleaves to Congress the decision whether to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-alito-dismisses-calls-for-recusal-following-interviews\/\" title=\"Justice Alito rejects recusal requests after interviews.\">establish inferior federal\u200d courts<\/a>.\u201d<\/p>\n<\/p><\/div>\n<div class=\"my-5\">\n<p>Meanwhile, \u2064Sen. Sheldon Whitehouse (D-R.I.) <a href=\"https:\/\/www.theepochtimes.com\/us\/senator-seeking-to-investigate-justice-alito-for-stating-congress-cannot-regulate-supreme-court-5486726\" target=\"_blank\" rel=\"noopener\">asked<\/a> Justice Roberts to investigate Justice \u2063Alito for \u201cviolating several canons of judicial ethics\u201d following the latter\u2019s comments in the July 28 interview.<\/p>\n<\/p><\/div>\n<div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Sen.
