The drug is used in the first\u2064 10 weeks of\u2064 pregnancies as part of a chemical abortion procedure to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-is-a-free-and-independent-state-texas-rep-introduces-bill-to-ban-abortion\/\" title=\"\u2018Texas Is A Free And Independent State\u2019: Texas Rep Introduces Bill To Ban Abortion\">kill unborn children<\/a>. It is often used in conjunction with\u200d another drug, misoprostol,\u200c that helps \u2064to \u2062induce \u200dlabor to expel the remains. Danco is\u200c challenging whether courts have the authority to &#8220;disregard constitutional and statutory limits \u200don judicial\u200c review of executive action\u2064 in \u200corder to overrule an agency\u2064 decision they dislike.&#8221;<\/p>\n<p>In this instance, the\u200d Fifth Circuit Court\u200d of Appeals, \u2062based \u2062in New Orleans, issued a decision \u200bthat\u200c impacted the regulations established by the FDA for Mifeprex, the brand name for mifepristone.<\/p>\n<p>Lawyers for Danco \u2062assert that the\u200c appellate\u200c court&#8217;s ruling\u200d was at the behest of plaintiffs\u2064 who, in\u2064 their view, neither &#8220;prescribe or use the \u2062drug and whose real disagreement with FDA is that they oppose all forms\u2062 of\u2063 abortion.&#8221;<\/p>\n<p>The federal appellate court&#8217;s August ruling would revoke approval for mailing the drug \u200band reduce \u200cthe window during which mifepristone could be \u200dused in pregnancy from 10 weeks to seven weeks.<\/p>\n<p>As a result \u200bof this decision, the FDA&#8217;s initial 2000 approval of mifepristone remained intact. However, regulatory \u200bchanges made by the agency\u2062 in\u2063 2016 and 2021,\u2064 which expanded access to the drug, were reversed.<\/p>\n<p>In April, the Supreme Court \u2062intervened in \u200bthat \u2064case, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/abortion-pill-manufacturer-asks-supreme-court-to-review-mifepristone-limits\/\" title=\"Abortion pill maker seeks Supreme Court review on Mifepristone restrictions.\">keeping\u200d mifepristone broadly accessible<\/a>, but\u200d with more restrictions, while the case \u200cplays out. (Robyn Beck\/AFP\/Getty Images)<\/figcaption><\/figure>\n<p>Justices\u200d Clarence Thomas and Samuel Alito, \u2064both conservative, publicly dissented from this decision, with Justice Alito writing \u2062in \u2063a\u200d brief opinion \u200dthat\u200c the administration and Danco &#8220;are not entitled to a stay because they have not shown that they are likely to suffer irreparable harm \u2063in the interim.&#8221; No other justices \u200ccommented.<\/p>\n<p>In\u2062 their recent\u2062 filing, Danco&#8217;s legal team \u200dimplored the \u2063Supreme Court to review the appellate court&#8217;s ruling on\u200d the \u2063grounds that the case is &#8220;of indisputable importance&#8221; for\u2063 women\u2063 and \u200bthe drug\u200c industry.<\/p>\n<div class=\"my-5\">\u201cFor the women and teenage girls, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/colorado-offers-free-community-college-in-hope-to-ease-workforce-shortage-in-high-demand-jobs\/\" title=\"Colorado provides free community college to address workforce shortage in high-demand jobs.\">health\u200b care providers<\/a>, and States that \u2063depend on FDA\u2019s actions to ensure \u2064safe and effective \u200creproductive health care\u2064 is available, this case\u200b matters tremendously,&#8221; the court filing\u2062 reads (<a href=\"https:\/\/www.documentcloud.org\/documents\/23945160-danco-cert-petition\" target=\"_blank\" rel=\"noopener\">pdf<\/a>). \u200c&#8221;And\u200b for \u2062the pharmaceutical and \u2063biotechnology industry, permitting judicial second-guessing of FDA\u2019s scientific evaluations of \u2062data will have a wildly destabilizing\u2062 effect.&#8221;<\/div>\n<p>The case is the\u2064 latest development \u2063in a legal battle launched in November 2022 \u200bchallenging the FDA&#8217;s approval of mifepristone back in \u200c2000.
