Dick \u2063Durbin of Illinois wrote\u200b to Chief Justice John Roberts to insist that Justice Samuel Alito recuse\u2062 himself from an impending court case.<\/h2>\n<p>On Friday, Alito\u200c responded with \u2062a refusal\u2063 to recuse and a lesson on how the Supreme Court works.<\/p>\n<p>Mollie Hemingway, editor-in-chief at The Federalist, \u200bhailed Alito\u2019s <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/090823zor_21o2.pdf#page=3\" target=\"_blank\" rel=\"noopener\">answer<\/a> to Durbin as\u2064 \u201csober yet devastating.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Justice Samuel Alito responds to \u200bDemocrat\u2064 Dick Durbin\u2019s demand for his recusal with a sober yet devastating litany of facts. <a href=\"https:\/\/t.co\/l07163UQHb\">https:\/\/t.co\/l07163UQHb<\/a><\/p>\n<p>\u2014 Mollie (@MZHemingway)\u200d <a href=\"https:\/\/twitter.com\/MZHemingway\/status\/1700160712771846526?\">September 8, 2023<\/a><\/p>\n<\/blockquote>\n<h3>In an Aug. 3 <a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/durbin_judiciary_committee_dems_urge_chief_justice_to_address_justice_alitos_wall_street_journal_interview_that_violates_the_courts_statement_on_ethics.pdf\" target=\"_blank\" rel=\"noopener\">letter<\/a> that rates as preposterous even by his standards, Durbin, \u2062chair of the\u200d Senate \u2062Judiciary Committee, complained about Alito\u2019s recent <a href=\"https:\/\/www.wsj.com\/articles\/samuel-alito-the-supreme-courts-plain-spoken-defender-precedent-ethics-originalism-5e3e9a7\" target=\"_blank\" rel=\"noopener\">interview<\/a> with The Wall Street Journal.<\/h3>\n<p>During that interview, Alito chafed at the idea that Congress may impose <a href=\"https:\/\/www.westernjournal.com\/justice-alito-issues-brutal-reminder-woke-lawmakers-congress-tries-mandate-scotus-ethics-code\/\" target=\"_blank\" rel=\"noopener\">ethics\u200d rules<\/a> on justices.<\/p>\n<p>\u201cNo provision in the Constitution gives them the authority to regulate the Supreme \u200bCourt\u200c \u2014 period,\u201d Alito said.<\/p>\n<p>Durbin called this \u201copining\u201d \u200cand labeled it \u201c<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/politico-claims-to-have-obtained-scotus-draft-opinion-overturning-roe-v-wade\/\" title=\"POLITICO Claims To Have Obtained SCOTUS Draft Opinion Overturning Roe v. Wade\">plainly incorrect<\/a>\u201d \u2014 a\u2063 view that \u2064is itself \u200bplainly incorrect.<\/p>\n<p>The Illinois senator also noted that Alito sat \u2064for an \u2063interview with David\u200c Rivkin, \u2062one of the attorneys in the case in which Durbin demanded Alito\u2019s recusal.<\/p>\n<p>\u201cMr. Rivkin\u2019s access to Justice Alito and efforts to help Justice \u200dAlito \u2063air his\u200b <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fbi-says-biggest-domestic-terror-threats-in-2021-are-violent-extremists-motivated-by-race-or-anti-authority-views\/\" title=\"FBI Says Biggest Domestic Terror Threats in 2021 Are Violent Extremists Motivated by Race or Anti-Authority Views\">personal grievances<\/a> could cast doubt on Justice Alito\u2019s \u200bability \u2062to fairly \u200ddischarge his duties in a case in\u2064 which \u200cMr. \u200dRivkin represents one of the parties,\u201d Durbin wrote.<\/p>\n<p>In his response\u2063 Friday, Alito made quick work of\u2064 Durbin\u2019s complaints.<\/p>\n<p>\u201cThere\u2063 is no valid reason for my \u2063recusal in this case,\u201d he wrote.<\/p>\n<p>Indeed, the\u200b Democrat stood on flimsy ground when he cited the \u200bWall Street Journal\u2064 interview. \u200dOn that front, Alito \u2063noted \u200dthat Durbin\u2063 \u201cfundamentally misunderstands the\u200b circumstances under \u200bwhich Supreme Court\u2062 Justices must work.\u201d<\/p>\n<p>In\u200d the footnotes to \u2063his four-page reply, Alito \u200dlisted six \u2063other \u2062recent \u200cinstances in \u2063which current SCOTUS justices gave an interview to a news outlet and then heard a \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrat-senator-raphael-warnock-under-investigation-for-voter-registration-misconduct-reports\/\" title=\"Democrat Senator Raphael Warnock Under Investigation For Voter Registration Misconduct: Reports\">case involving<\/a> said \u2063outlet.<\/p>\n<p>Likewise, <a href=\"https:\/\/www.westernjournal.com\/democrats-think-can-run-clarence-thomas-off-supreme-court-watch-video-1991-confirmation-hearing\/\" target=\"_blank\" rel=\"noopener\">justices<\/a> often \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-alito-replies-to-dem-senators-recusal-demand-with-devastating-lesson-on-how-supreme-court-works\/\" title=\"Justice Alito's response to Dem Senator's recusal demand offers a powerful lesson on Supreme Court operations.\">hear cases involving acquaintances<\/a>, former colleagues and former law clerks.<\/p>\n<p>\u201cIf we \u200brecused in such \u200dcases, we would regularly have\u200b less than a full bench, and the \u2064Court\u2019s work would be substantially disrupted and distorted,\u201d Alito wrote.<\/p>\n<p>Then,\u200d Alito gave Durbin his final answer:\u200b \u201cI decline to recuse.\u201d<\/p>\n<p>Alito\u2019s response to the meddling senator is even more brilliant than it first appears.<\/p>\n<p>Recall that in his \u2064insufferable \u200bletter Durbin \u200ccomplained\u2064 about Alito \u201copining\u201d on a \u200bconstitutional question. Congress,\u200c Alito \u2064had rightly observed, has no authority to\u2064 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breitbart-news-daily-podcast-ep-43-critical-race-theory-explained-with-dr-james-lindsay-taking-on-big-tech-with-j-d-vance\/\" title=\"Breitbart News Daily Podcast Ep. 43: Critical Race Theory Explained with Dr. James Lindsay, Taking on Big Tech with J.D. Vance\">impose rules<\/a> of any \u200bkind on the <a href=\"https:\/\/www.westernjournal.com\/case-involving-critical-election-law-appealed-supreme-court-affect-millions-voters\/\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a>.<\/p>\n<p>In his reply,\u2063 Alito \u2064did not address \u200cthis part of Durbin\u2019s \u2064letter. That spoke volumes.<\/p>\n<p>In \u20621796, \u200bthe House of Representatives \u200csought information \u200bfrom the executive branch pertaining \u200dto the negotiation of \u200da treaty. The Constitution \u200bdoes not entitle\u2064 the \u2063House to such \u200binformation, so President George Washington declined the request.<\/p>\n<p>One hears echoes of Washington\u2019s\u2062 defense of the separation of powers in Alito\u2019s silence.<\/p>\n<p>Congressional intrusions\u2063 into the judicial branch \u200cviolate the Constitution.
