The proposals now head to Democratic governor Gavin \u2062Newsom&#8217;s desk.<\/p>\n<p>The bill, which the Assembly\u2062 approved Friday by a 57-16 vote, \u200corders \u2063judges to favor parents who \u200c&#8221;affirm&#8221; their children in the context \u200cof custody disputes.<\/p>\n<p>It intersects with another piece of legislation, which the \u200bSenate\u200b approved\u2062 Thursday 40-0, <a href=\"https:\/\/freebeacon.com\/california\/california-dems-could-remove-visitation-rights-for-non-affirming-parents\/\" target=\"_blank\" rel=\"noopener\">instructs<\/a> judges to consider parents&#8217; affirmation of their child&#8217;s preferred identity when <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-dems-pass-bill-to-allow-custody-judges-to-consider-gender-affirmation\/\" title=\"California Democrats have approved a bill granting custody judges the ability to consider 'gender affirmation' in their decisions.\">deciding visitation rights\u2014including<\/a>\u2062 if the \u2064visits need to\u2064 be supervised. The bill&#8217;s original intent was to protect children from\u200c parents or guardians already flagged as dangerous.<\/p>\n<p>Newsom would need to sign both bills\u2062 for the new definition of a child&#8217;s\u200d health, safety, and \u2064welfare \u200dto be\u2063 enshrined in \u200dstate family\u2062 law. Neither proposal defines what &#8220;affirmation&#8221; means, making the judges responsible for \u2064deciding if \u2062it \u2062includes medical transition.<\/p>\n<p>The custody\u2063 bill, which prompted hundreds of parents from\u2063 around the state to testify and \u2063rally in opposition, showcases California Democrats&#8217; commitment to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-activists-file-ballot-initiatives-to-counter-states-transgender-policies\/\" title=\"California activists have submitted ballot initiatives to challenge the state's transgender policies.\">enshrining gender ideology<\/a> into law, even if it divides \u200cfamilies. Supporters insist it \u200bis a \u2062narrow \u2064provision that won&#8217;t \u200cremove custody\u2063 from parents but only ensure \u2062that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gone-too-far-transgender-psychologist-admits-spike-in-trans-kids-alarming-become-trendy\/\" title=\"\u2018Gone Too Far\u2019: Transgender Psychologist Admits Spike In \u2018Trans\u2019 Kids Alarming, Become \u2018Trendy\u2019\">gender-confused kids<\/a> are supported during a divorce or separation dispute\u2014an argument that opponents don&#8217;t buy.<\/p>\n<p>&#8220;The floodgates are open,&#8221; said Erin Friday, a \u2064San Francisco attorney and co-lead of Our Duty, a coalition of parents of gender-confused children. &#8220;For them to say this is limited to custody is just a lie.&#8221;<\/p>\n<p>Friday, whose daughter was once gender-confused, said defining &#8220;gender affirmation&#8221; as \u200bpart of a child&#8217;s health, safety, and welfare\u2062 could\u2063 open the door \u200bto outsiders suing for guardianship of kids should their parents oppose or \u200dquestion\u2062 their desire to transition to a new identity. \u200bThey \u2062could do so by \u200dclaiming &#8220;probate guardianship&#8221;\u2014the process whereby grandparents or even strangers can petition for custody of a \u200bchild whose parent can&#8217;t \u200btake care of him or her.<\/p>\n<p>Ted Hudacko, a Bay Area man <a href=\"https:\/\/www.city-journal.org\/article\/child-custodys-gender-gauntlet\" target=\"_blank\" rel=\"noopener\">who lost custody<\/a> of\u200d his son\u200c to\u200b his ex-wife for refusing to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/leading-gender-affirming-psychiatrists-popular-article-updated-after-fact-check-reveals-misleading-claims\/\" title=\"Leading \u2018Gender Affirming\u2019 Psychiatrist\u2019s Popular Article Updated After Fact-Check Reveals Misleading Claims\">support medically transitioning<\/a> him \u200cto a\u2063 girl, expressed \u2062shock that the\u200c proposals passed and \u2063said Democrats \u2063are ignoring evidence of the physical and mental \u2064harms\u2062 of\u200b transitioning children.<\/p>\n<p>&#8220;I&#8217;m disheartened,&#8221;\u200b Hudacko said. &#8220;This is just going to bring terrible misery to so many families.&#8221;<\/p>\n<p>Assemblywoman\u2064 Lori Wilson (D.), who coauthored the \u200bcustody bill with Sen. Scott Wiener (D.), said that a child&#8217;s welfare depends on &#8220;family acceptance and social support.&#8221;<\/p>\n<p>&#8220;We are part of that social\u200b support,&#8221; she said before the floor vote on Friday.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>desk for approval.
