Joe Biggs, a\u2064 <a href=\"https:\/\/www.military.com\/daily-news\/2022\/06\/07\/veterans-make-most-of-proud-boys-members-indicted-sedition-jan-6-violence.html\" target=\"_blank\" rel=\"noopener\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/opinion-bidens-catastrophic-withdrawal-is-empowering-another-enemy-china\/\" title=\"OPINION: Biden\u2019s Catastrophic Withdrawal Is Empowering Another Enemy \u2013 China\">purple heart recipient<\/a>,<\/a> was handed down a 17-year\u200b sentence, and\u2062 Zachary Rehl, a U.S. Marine\u200c veteran, was hit with a 15-year sentence.<\/p>\n<p>All four of the men \u2014 not a single one even accused\u2064 of assault \u2014\u2063 were convicted\u200d of seditious conspiracy. Judge Timothy Kelly,\u200d a Trump appointee who sentenced \u2063each young man, agreed\u200b with the government \u200dthat all\u200b four of them be hit with a \u201cterrorism sentencing \u200cenhancement.\u201d \u2064Meaning \u2063each sentence will be over\u2064 ten years at a\u2064 minimum.<\/p>\n<h3>The Significance of \u200bthe Conviction<\/h3>\n<p>First, let\u2019s look at what they were convicted of (among other lesser\u2063 charges): \u2064seditious conspiracy. This is significant. \u2064The seditious conspiracy law \u200dwas\u2062 enacted after the Civil War to arrest Southerners who might try to keep fighting\u200d the \u2064U.S. government. It\u2019s extremely rare \u200cin its\u200c application, and hard to prove \u2063\u2013 but it\u2019s been used by the Biden\u200b DOJ about a dozen\u200b times now in connection \u2062to \u200cthe Capitol\u2063 breach, and so \u200bfar, rather successfully.<\/p>\n<p>Save Tarrio, who was not at the Capitol, the other three \u200dyoung men\u2062 were\u2062 accused of trespassing\u2064 and damage \u2064to government property. In Biggs\u2019 case, for example, he helped remove a fence outside the Capitol.<\/p>\n<p>These\u200d are \u2062minor \u2063infractions, so the DOJ took on that rare \u200dseditious conspiracy charge,\u2062 which\u200d they had to try\u2064 to prove\u200b with speech, and mostly private\u2063 speech. The government sifted through tens\u2063 of thousands of private \u200band\u2062 some public\u200b messages\u2062 from\u200b the \u2064men to build their flimsy, yet successful, cases.<\/p>\n<p>In one message used by the \u200cprosecution, Tarrio said after the breach, \u201cMake no mistake\u2063 \u2026 we did \u200cthis.\u201d \u200bThe government also highlighted \u200ca document outlining\u2064 a Capital takeover that was sent to Tarrio \u200bon\u2063 social media platform \u2062Telegram called \u201c1776 Returns.\u201d Tarrio did not directly respond \u200dto the \u2063sent document and\u2063 claims he never even saw it, let\u2063 alone open it.<\/p>\n<p>The government told the court Tarrio, who is the son of \u2062Cuban immigrants, was \u2062\u201cintelligent, \u2062charming, creative,\u200b and articulate\u201d \u2063and \u2062argued that he used those talents to \u201cinflame and radicalize an untold \u2062number \u2063of followers.\u201d<\/p>\n<p>Defense lawyers maintained throughout the trail\u200d that there was not a single shred of written evidence to show\u2064 that the \u200cmen conspired to stop the certification of the 2020 election, though they might have boasted and talked \u201cs***\u201d to each other, privately.<\/p>\n<p>Tarrio himself\u2062 actually \u200cspoke\u2063 about this glaring speech issue during the trial, from \u200binside a jail cell.\u200b He \u200csuggested \u2063the\u2062 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-doj-throws-the-book-at-proud-boys-over-j6-racking-up-huge-sentences\/\" title=\"Biden's DOJ imposes hefty sentences on Proud Boys for J6.\">trial concerned\u2062 free speech<\/a>, and said that \u200bthe government\u2063 is trying to \u201cmanipulate\u201d how people speak to each other privately. Here\u2019s what\u2063 Tarrio said in a Twitter Spaces event, \u2062which\u2062 was\u2062 hosted on April\u2062 25th:<\/p>\n<blockquote>\n<p><em>\u201cWhat they\u2019re\u2062 trying to do, what people\u2063 are trying to \u200ddo \u2013 \u200cand this is in general, I\u2019m speaking \u200cin general \u2013 is manipulate how we talk \u200bto each other in the locker \u2063room,\u201d<\/em> Tarrio \u2063said. <em>\u201cAnd it\u2019s not \u200bfair \u2026 It\u2019s just not right. It\u2019s not the \u2063Justice system that \u2064you grew up\u2062 in civics\u200b class learning about.\u201d<\/em><\/p>\n<\/blockquote>\n<p>Notably, the \u2063DOJ has had near-perfect\u200b success \u200din prosecuting J6 defendants before D.C.\u200d juries \u2013 this\u2063 is a very liberal city, where, in 2020, Biden secured a stunning 93% of the vote. That likely emboldened the government to\u200d go forward with these extreme charges, knowing they could win.<\/p>\n<p>It\u2062 also\u2062 seems Donald Trump is a \u200ckey factor in the DOJ \u200dgoing\u2062 so hard after the Proud Boys: it could help their pursuit of the former president. Trump \u200dnotably said on television\u200c in September\u200b of 2020, \u201cProud Boys, \u200bstand back and stand by.\u201d This \u2062was breathlessly\u2062 reported\u200b by those in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/project-veritas-strips-cnn-naked\/\" title=\"Project Veritas Strips CNN Naked\">legacy media<\/a>, the clip was shown by\u2062 prosecution in \u2063this Proud Boys trial, and \u2063you can \u200cbet it will be a focus \u2063at Trump\u2019s coming J6 trial.<\/p>\n<p>Reporter Julie Kelly,\u2063 who\u2019s been\u200c covering these J6 cases from the very beginning, \u200bbelieves \u200bjust\u2063 that.<\/p>\n<blockquote>\n<p><em>\u201cThere\u200b is no\u200b case for seditious conspiracy \u2013 certainly they\u2064 could be\u2063 charged with trespassing,\u2063 or, ya know, \u2064vandalizing property \u2013 no one is \u2064accused of assaulting a police officer,\u201d<\/em> Kelly said months ago on\u2064 Real America\u2019s Voice. <em>\u201cThe reason why the outcome of this trial matters, is because \u2064the government is going to use this \u2013 any convictions \u2013\u2063 special counsel Jack \u200dSmith \u2013 to indict Donald Trump \u2062on the very same \u200doffenses.\u201d<\/em><\/p>\n<\/blockquote>\n<p>Trump has since\u2063 been \u200dcharged\u200d with\u200c conspiracy to \u200c<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republican-ags-tell-nations-top-law-firms-to-stop-racial-preference-hiring-or-face-accountability\/\" title=\"Republican AGs warn top law firms: End racial preference hiring or face consequences.\">violate\u200b civil rights<\/a>, conspiracy to defraud the \u200cgovernment,\u200d the corrupt obstruction of an official proceeding, and conspiracy to carry out such obstruction.<\/p>\n<p>While the\u2062 DOJ has continued this harsh pursuit,\u2063 the American people have taken notice.\u200b Polling by Rasmussen from about 10 months after\u2062 January 6 showed that nearly half of all Americans thought J6 defendants were \u201cpolitical prisoners.\u201d And polling\u2062 from this year by Quinnipiac showed that about half \u2064the\u200d country is ready to move on from\u200c J6, finding it \u200cless significant an event than it\u2019s being portrayed.<\/p>\n<p>Some \u2063GOP lawmakers have\u2064 weighed in on this,\u2064 too, saying these defendants \u200care being treated poorly\u2064 and far more\u200d harshly than \u200bany\u200d BLM\u200d protester or\u2064 rioter has been treated. Missouri Sen. \u2062Josh\u2063 Hawley (R),\u200d for \u200dexample, has \u2063called out the DOJ for this disparity.<\/p>\n<p>In a\u200b letter to\u200c Attorney General Merrick Garland last year,\u2064 Hawley wrote:<\/p>\n<blockquote>\n<p><em>\u201cWhile you treat persons\u2062 charged with petty \u2062offenses\u200b from the\u2064 January 6 riot as hardened criminals, now even \u200cthe most heinous offenses can be treated \u200bleniently, as \u2064long as the perpetrator is of the correct \u200drace and the \u200ccrime can be connected to some progressive cause.\u201d<\/em><\/p>\n<\/blockquote>\n<p>One case highlighted was over a BLM protester named Montez Terriel Lee, Jr. who was convicted of arson to a\u200c pawn \u2062shop that resulted in the death of\u200b a 30-year-old man. The \u2063DOJ, citing Dr. \u2062Martin Luther King Jr. to \u200bdefend Lee, argued for a lighter \u200bsentence for the\u200b man.\u2063 Lee was \u2062sentenced to ten years \u2013\u200b that\u2019s less than\u2063 half of Tarrio\u2019s sentence \u2013 and, again, Tarrio wasn\u2019t \u200dpresent \u200dat the riot.<\/p>\n<p>Lawmakers\u200d have also\u200d raised objections about how long some of these defendants have been\u200b held \u200din\u2062 jail without\u2064 bond awaiting\u200b their trials, arguing that their due\u2064 process rights have been violated. Tarrio, for example, was locked up\u200c since March 2022 \u2013 long before his trial even started.<\/p>\n<p>To date, more than 1,100 Americans have been charged in connection to the \u2064Capitol\u2063 breach, and more than 300 people have already been \u200dsentenced\u200b to prison\u2062 time.
