State Supreme Court Judge Ralph Porzio ruled that their termination was unlawful, arbitrary, and capricious,\u200d ordering that they be reinstated with back pay.<\/p>\n<blockquote>\n<p>\u201cThis Court sees no rational basis for not \u200ballowing\u2064 unvaccinated classroom teachers in amongst an admitted population of\u2063 primarily \u2063unvaccinated students,\u201d Porzio wrote in his 22-page opinion. \u201cAs such, the decision to summarily deny the classroom teachers \u200camongst the Panel Petitioners \u2062based on an undue hardship, without any further \u2063evidence\u2062 of individualized analysis, is \u2062arbitrary, capricious, and unreasonable. As \u200csuch, each classroom teacher amongst\u2062 the \u2063Panel Petitioners is entitled to a religious exemption from the Vaccine\u200c Mandate,\u201d \u200bthe judge wrote.<\/p>\n<\/blockquote>\n<p>The group, \u2064which includes school principals, teachers,\u200d and\u200d other educators, \u2062took legal action \u2062against the city after their\u2063 dismissal. The court&#8217;s ruling not only guarantees their reinstatement but\u2063 also entitles them\u200c to back pay \u200cin salaries, \u2064benefits, pensions, and seniority.<\/p>\n<p>While the\u200b judge&#8217;s decision only \u200bapplies to \u2064the 10 educators who filed the lawsuit, it highlights the broader \u2064issue of thousands of \u2063education workers who lost their jobs due \u2062to\u2062 the vaccine mandate.<\/p>\n<h3>Challenges and Denials<\/h3>\n<p>The petitioners had\u2064 hoped to turn their lawsuit into a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/president-trump-i-want-to-restore-free-speech-for-every-american\/\" title=\"President Trump: I want to restore free speech for every American\">class action suit<\/a>, but the judge denied that request. Additionally, seven other petitioners\u200b who sought exemptions and reinstatement \u2063with\u200d back pay were also denied. Among them was a group called Teachers\u2063 for Choice, which <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/what-a-joke-one-of-the-greatest-active-tennis-players-is-barred-from-playing-in-u-s-for-not-taking-covid-vaccine\/\" title=\"What A Joke? One Of The Greatest Active Tennis Players Is Barred From Playing In U.S. For Not Taking COVID Vaccine\">opposes forced vaccination<\/a>.<\/p>\n<p>\u201cAlthough the petitioners\u2019 overall position is\u200b that the citywide \u2063panel did not \u2064provide\u200b relief to the vast majority of initial DOE applicants, and specifically that these petitioners did seek that\u200b review, the record before this court is \u200cinsufficient to make any determination as to those claims,\u201d Porzio wrote in\u200b his ruling.<\/p>\n<p>The city had argued that granting reasonable accommodation to unvaccinated teachers would pose a risk to the vulnerable and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nyc-teachers-who-refused-covid-vaccine-must-get-jobs-back-with-back-pay-judge-rules\/\" title=\"Judge rules NYC teachers who declined COVID vaccine must be reinstated with back pay.\">primarily unvaccinated student population<\/a>. However, the\u2064 judge \u200bcited \u200bNew York City Mayor Eric Adams&#8217;\u2063 decision to scrap the vaccine mandate for athletes \u2062and \u2063entertainers\u200b as evidence\u2062 that the mandate for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/chicago-mayor-orders-teachers-back-into-classrooms-union-vows-to-call-a-strike\/\" title=\"Chicago Mayor Orders Teachers Back Into Classrooms, Union Vows To Call A Strike\">public school teachers<\/a> \u2062was arbitrary\u200b and unreasonable.<\/p>\n<p>This is not the first time\u200d Judge Porzio has ruled \u2063in favor \u200bof individuals refusing the COVID vaccine. Last year, he\u200c sided with a\u200d Staten Island firefighter who was fired for the\u2063 same reason, stating that\u200b being vaccinated does not guarantee immunity from contracting or transmitting the \u2062virus.<\/p>\n<h3>A Broader \u2064Context<\/h3>\n<p>The\u2064 New York \u200dCity \u200cvaccine mandate for public school workers ended on February 10, following its implementation on October \u20641, 2021. However, the issue of vaccine\u2063 mandates has been a contentious one across the country.
