Trump from\u200b the\u200d ballot in various states on 14th Amendment grounds\u2013one of <a href=\"https:\/\/www.theepochtimes.com\/us\/attempts-to-block-trump-from-ballot-denounced-as-dangerous-as-legality-is-debated-legal-scholar-5485068\" target=\"_blank\" rel=\"noopener\">many efforts<\/a> that rest on the claim that he\u2063 led an &#8220;insurrection or rebellion&#8221; against the Constitution on Jan.\u200b 6, 2021.<\/p>\n<\/div>\n<p>&#8220;Politicized groups are attempting \u200cto\u2062 make\u200b Trump ineligible to run for president, arguing he fomented and, in fact, engaged in insurrection on \u2063January\u2064 6. \u2062This is \u2062a\u2064 perversion of the\u200b 14th Amendment,&#8221; Mr. Ramaswamy \u2062said in a statement released on Sept. 7.<\/p>\n<div class=\"my-5\">\n<p>A Sept. 6\u2064 petition \u200cfrom the liberal organization Citizens \u2064for Responsibility and Ethics in Washington aims to \u2064keep President Trump \u2063off the primary and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/company-leading-arizona-recount-asks-court-that-procedures-be-kept-secret\/\" title=\"Company Leading Arizona Recount Asks Court That Procedures Be Kept Secret\">general election ballots<\/a> in Colorado. It comes just days\u2063 after a Florida judge appointed by former President \u200cBarack \u2063Obama \u2062on \u2064Aug. 31 <a href=\"https:\/\/www.theepochtimes.com\/us\/obama-appointed-judge-throws-out-attempt-to-keep-trump-off-of-florida-ballot-5484926\" target=\"_blank\" rel=\"noopener\">tossed out\u200d a similar lawsuit<\/a> targeting Florida&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/you-have-a-rendezvous-with-destiny-mr-vice-president-on-january-6th-vice-president-pence-will-choose-the-direction-of-the-world-for-years-to-come-like-thomas-je\/\" title=\"\u201cYou Have a Rendezvous with Destiny, Mr. Vice President\u201d \u2013 On January 6th Vice President Pence Will Choose the Direction of the World for Years to Come \u2013 Like Thomas Jefferson Did Centuries Ago\">presidential ballots<\/a>.<\/p>\n<\/div>\n<blockquote>\n<h3>In her \u2062dismissal of that case, Judge Robin L. Rosenberg wrote:<\/h3>\n<p>&#8220;An individual \u2064citizen does not have standing to challenge whether \u200canother individual is qualified to hold\u200c public office.&#8221;<\/p>\n<\/blockquote>\n<p>Mr. Ramaswamy\u200d recommended that the judge assigned to the Colorado case\u200d &#8220;immediately toss it out,&#8221; too.<\/p>\n<div class=\"my-5\">\n<p>John Anthony Castro, another 2024 Republican\u2062 presidential hopeful, \u2062filed similar \u200dlawsuits against Mr. Trump \u2064in Maine and Nevada, <a href=\"https:\/\/twitter.com\/realJohnACastro\/status\/1697660605425963137?s=20\" target=\"_blank\" rel=\"noopener\">stating on Twitter\/X<\/a> \u200bthat he would drop them if the previous commander-in-chief would &#8220;agree\u2063 to a one-on-one\u2064 debate \u2062hosted by [Tucker Carlson].&#8221;<\/p>\n<\/div>\n<p>In New Hampshire, meanwhile, a Republican who once garnered the former president&#8217;s\u200c endorsement in\u2064 his unsuccessful Senate bid \u2063is\u2062 spearheading a parallel attempt to keep Mr. Trump off the ballot in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ramaswamy-condemns-push-to-remove-trump-from-ballot-on-14th-amendment-grounds\/\" title=\"Ramaswamy opposes removing Trump from ballot based on 14th Amendment.\">crucial early primary \u2062state<\/a>.<\/p>\n<div class=\"my-5\">\n<p>&#8220;I believe in the\u200d Constitution, and \u2064I think someone needs to step up to make \u200csure that the Constitution is, in fact, enforced,&#8221; <a href=\"https:\/\/www.theepochtimes.com\/article\/republican-who-was-endorsed-by-trump-seeks-to-have-him-disqualified-from-2024-election-5480805\" target=\"_blank\" rel=\"noopener\">said<\/a> Bryant &#8220;Corky&#8221; Messner, who lost \u200cto incumbent Sen. Jeanne \u200bShaheen (D-N.H.) in the\u200c 2020 election.<\/p>\n<\/div>\n<p>&#8220;Yesterday\u2019s filing is just the latest in a \u2063string \u2064of baseless \u200blawsuits \u200ddesigned to silence\u2064 political opponents and swing the election for Joe Biden, this time by depriving Americans of the right to vote for their\u2062 candidate of choice,&#8221; Mr.\u200c Ramaswamy wrote in\u200c his response to the Colorado filing.<\/p>\n<p>Mr. Ramaswamy\u200b rejected the notion that \u2064the language in \u2063the 14th Amendment, designed\u2063 after the\u2063 Civil\u200c War to prevent U.S.\u200b officials \u200bwho defected to the \u2063Confederacy from \u2064becoming \u200cpublic officials under the \u2064postbellum regime, could be construed\u2063 to bar those involved \u200din the\u200b demonstrations\u2063 on Jan. 6, 2021, let \u2062alone Mr. Trump.<\/p>\n<p>&#8220;These men\u2062 had clearly \u2062taken part \u2062in\u2063 a rebellion against the United States: \u2063the Civil War. Participants \u200din the events of\u200d January \u20646 did not. And Trump, of course, was not even among them,&#8221; Mr. Ramaswamy wrote in his\u2063 statement.<\/p>\n<div class=\"my-5\">\n<p>The \u200bColorado <a href=\"https:\/\/www.citizensforethics.org\/wp-content\/uploads\/2023\/09\/2023-09-06-08-43-07-Anderson-v-Griswold-Verified-Petition-2023.09.06.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">petition<\/a> \u2062claims\u200d that the former president led a mob \u200dthat &#8220;violently storm[ed] and seize[d] the United States Capitol, a \u2063feat even the Confederacy never achieved during the Civil War.&#8221;<\/p>\n<\/div>\n<p>Mr. Ramaswamy also argued that Section 3 of\u200b the 14th Amendment does not apply\u200d to President \u2062Trump, citing a \u200d2010 Supreme Court Decision\u2062 and Article II of \u200dthe Constitution to point out\u2062 that he was not and is not \u200can &#8220;officer of the United States.&#8221;<\/p>\n<p>&#8220;The term does not apply to \u2064elected\u200d officials, and \u200bcertainly not to the \u2062president himself. The \u2062Framers of \u2064the 14th Amendment would be shocked and appalled to see their narrow \u2064provision\u2014intended \u2062to bar former U.S officials who switched to the Confederacy from\u200d seeking\u200b public office\u2014being weaponized by a sitting president and\u200d his\u2063 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/next-target-freedom-of-the-press-ocasio-cortez-says-congress-will-look-into-initiatives-to-rein-in-media-and-unapproved-press-reports\/\" title=\"Next Target \u2014 Freedom of the Press: Ocasio-Cortez Says Congress Will Look into Initiatives to \u201cRein In Media\u201d and Unapproved Press Reports\">political allies<\/a> to prevent\u200d a former president \u2063from seeking reelection,&#8221; Mr. Ramaswamy wrote.<\/p>\n<p>Former Vice President Mike \u2064Pence also questioned the \u200bappropriateness of litigation that aims to disqualify President Trump \u200bfrom various ballots using the 14th Amendment.<\/p>\n<div class=\"my-5\">\n<p>&#8220;I always think these questions should be left\u2062 to voters,&#8221; he \u200csaid on \u2063Sept.\u2064 5, <a href=\"https:\/\/www.foxnews.com\/politics\/on-push-boot-trump-primary-ballot-pence-says-such-questions-should-be-left-voters\" target=\"_blank\" rel=\"noopener\">as reported\u200b by<\/a> \u2063 Fox News.<\/p>\n<\/div>\n<p>Mr. Pence has \u2063repeatedly\u2064 said \u2062that his \u2062own actions on Jan.\u2062 6,\u200b 2021,\u200b fulfilled his duty to the Constitution.<\/p>\n<div class=\"my-5\">\n<p>&#8220;I truly believe,\u200d I truly do\u200c believe, people deserve to know that the former president asked me to choose him over my oath to the\u200b Constitution. I chose the Constitution,&#8221; Mr. Pence <a href=\"https:\/\/www.theepochtimes.com\/us\/pence-says-trump-gave-him-a-choice-on-jan-6-and-he-chose-the-constitution-5458701\" target=\"_blank\" rel=\"noopener\">told an Iowa crowd<\/a> in August.<\/p>\n<\/div>\n<p>&#8220;Not only \u200ddo I \u200cexpect him\u200d to be on the ballot, \u2063but\u2063 I hope he&#8217;s on the debate stage really \u200dsoon,&#8221; Mr. \u200bPence \u200dsaid in his \u200cSept. 5 comments to \u2064Fox News Digital.<\/p>\n<p>The frontrunner for the Republican presidential nomination is not expected to appear at the second debate, which will \u2064occur later\u200c this month at the \u200bRonald Reagan Presidential Library in Simi \u2062Valley, California.<\/p>\n<div class=\"my-5\">\n<p>In an August CNN\u200b interview, former\u2064 Arkansas Gov. Asa Hutchinson <a href=\"https:\/\/www.cnn.com\/videos\/politics\/2023\/08\/20\/sotu-asa-full.cnn\" target=\"_blank\" rel=\"noopener\">said<\/a> that &#8220;a number\u2063 of legal\u200d scholars said that he \u2062 [Mr. Trump] is disqualified because of \u2063his actions \u2064on January 6,&#8221; citing the 14th\u2063 Amendment.<\/p>\n<\/div>\n<p>Northwestern University law professor\u200d Steve Calabresi, writing\u200b for The Volokh Conspiracy, argued that President Trump is \u200cdisqualified\u200c under\u2062 the 14th Amendment. He suggested \u200dthat former New\u200c Jersey Gov. Chris Christie\u2064 should \u2064take action against the former president.<\/p>\n<div class=\"my-5\">\n<p>&#8220;Chris Christie is legally \u2064injured by\u200c Donald Trump&#8217;s name being on the ballot.
