But Congress \u200cmay by a\u200c vote of two-thirds of \u2063each House, remove such\u200c disability.&#8221;<\/p>\n<\/blockquote>\n<p>The 14th Amendment, added to the Constitution in 1868, was originally intended to prevent politicians and military officers of the Confederacy from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/left-launches-effort-to-win-midterms-by-disqualifying-republicans-for-insurrection\/\" title=\"Left Launches Effort to Win Midterms by Disqualifying Republicans for 'Insurrection'\">holding federal office<\/a> after the Civil War.<\/p>\n<p>The lawsuit argues that Trump&#8217;s conduct following the 2020 election, particularly the events of January 6, led to the attack on the U.S. Capitol. It was filed on \u200cbehalf of six Republican\u200c and unaffiliated Colorado voters, including former U.S. Rep. Claudine Schneider and former state Senate Majority Leader Norma Anderson.<\/p>\n<p>Noah Bookbinder, the president of CREW, stated in a <a href=\"https:\/\/www.citizensforethics.org\/news\/press-releases\/lawsuit-filed-to-remove-trump-from-ballot-in-co-under-14th-amendment\/\" target=\"_blank\" rel=\"noopener\">press release<\/a> that the lawsuit is crucial to defend the republic and ensure that\u200d those who attacked the democratic system are not put in charge of it.<\/p>\n<blockquote>\n<p>\u201cWhile it is unprecedented to bring this type of\u200d case against a former president,\u201d he said, \u201cJanuary \u200d6th was an unprecedented attack that is exactly the kind of event the framers of the\u200b 14th Amendment wanted to build protections in case of. You don\u2019t break the glass unless there\u2019s \u2064an emergency.\u201d<\/p>\n<\/blockquote>\n<p>Trump and his spokesperson have criticized the attempts to bar him from\u200b the \u2064ballot, calling it &#8220;election interference.&#8221; The lawsuit argues that Trump&#8217;s actions on and around January 6, 2021, violated his oath to uphold the Constitution and therefore disqualify him from holding any office under the United States.<\/p>\n<p>It is worth noting that Trump released a video message on \u200dthat day urging protesters to\u200d remain \u2062peaceful and even telling them to \u200b&#8221;stand down&#8221; and go home, which contradicts the claim of inciting insurrection.<\/p>\n<p>Similar challenges\u200d based \u2063on the 14th Amendment have been dismissed in the past. \u200cJust last \u2063month, a judge in\u2063 Florida <a href=\"https:\/\/www.palmbeachpost.com\/story\/news\/trump\/2023\/08\/31\/judge-dismisses-14th-amendment-lawsuit-against-trump-on-florida-ballot\/70726059007\/\" target=\"_blank\" rel=\"noopener\">dismissed<\/a> a case seeking\u2063 to remove Trump&#8217;s name from\u200b the ballot, and the Democratic Secretary of State in Arizona <a href=\"https:\/\/thehill.com\/homenews\/state-watch\/4179561-trump-cant-be-barred-from-arizonas-2024-ballot-says-democratic-secretary-of-state\/\" target=\"_blank\" rel=\"noopener\">stated<\/a> that he has no \u200cauthority to do so in that \u2063state.<\/p>\n<p>However, CREW has previously succeeded in using the 14th Amendment argument to\u200b remove one\u200d candidate from the ballot.
