S 1442 \u200d&#038; \u20631445. His written waiver of arraignment was filed\u200d on \u200bAugust 31, 2013. \u2064To be \u200ctimely, his notice \u2064of removal must\u200b be filed within 30-days of \u200dhis arraignment,&#8221; wrote Steven Sadow,\u200b lead\u2064 counsel for President Trump in the Georgia case, in a \u200bSept. 7 filing.<\/p>\n<p>Fulton County District Attorney Fani Willis had brought the case \u2062against the \u206219 \u2064defendants, claiming\u2063 their \u200cchallenge\u2063 of the 2020 election results constituted a &#8220;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-denies-meadows-clark-motion-to-avoid-arrest-in-georgia-election-case\/\" title=\"Meadows and Clark's request to evade arrest in Georgia election case denied by judge.\">criminal racketeering \u2064enterprise<\/a>.&#8221; Jeffrey Clark, former Justice Department\u2064 official\u200c under the Trump administration; and\u200d David Shafer and Shawn\u2063 Still, \u200bboth alternate electors who argue \u2064their roles, legitimized by Congress, can be\u200b considered federal\u2063 office, but \u200cthat at a minimum they were acting\u200c at the direction of federal officers.\n  <\/div>\n<p>The\u2064 U.S. Constitution states that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-says-he-may-seek-to-move-georgia-case-to-federal-court\/\" title=\"Trump considers transferring Georgia case to federal court.\">federal law precedes \u200bstate law<\/a> and courts,\u2062 and in court rulings this \u200bhas meant that federal officers are not\u200b subject to state law before \u200bacting and cannot be\u2064 tried in state court.<\/p>\n<div class=\"my-5\">\n<p>    There may be <a href=\"https:\/\/www.theepochtimes.com\/us\/numerous-arguments-filed-to-remove-georgia-trump-case-from-state-court-5478537\" target=\"_blank\" rel=\"noopener\">several<\/a> \u200creasons for removing the\u2062 case, including having the case dismissed \u200centirely, as some\u2064 of the\u200c defendants&#8217; lawyers have\u2063 argued.<br \/>\n \u200d  \u2063<\/p>\n<h2>First Hearing<\/h2>\n<p>    On Aug. 28, Judge Jones\u2062 held a hearing on Mr. Meadows&#8217;s \u2064removal.\n  <\/p><\/div>\n<div class=\"shortcode post-related-videos\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<div class=\"my-5\">\n<p>    \u2062The\u2063 prosecution had also \u2062 <a href=\"https:\/\/www.theepochtimes.com\/us\/brad-raffensperger-subpoenaed-to-testify-in-hearing-on-georgia-election-case-removal-to-federal-court-5479977\" target=\"_blank\" rel=\"noopener\">subpoenaed\u2063 several witnesses<\/a> to testify at \u2064the hearing in arguing\u2062 that the \u200bcase should not be moved out of state jurisdiction, expanding the initial hearing into a mini-trial.\n  <\/div>\n<p>This was\u2064 the first time legal arguments were made in court regarding the challenge\u200c of the 2020 elections, which\u2062 President \u200bTrump has been indicted for in federal\u200c court in Washington as\u200d well.<\/p>\n<p>Mr. \u200bMeadows\u200b argued that he\u200c was immune to these state charges,\u200d while the prosecution argued\u200c that his \u200cactions in the indictment were not that of a \u2062federal \u200dofficer.<\/p>\n<p>The all-day hearing ended without a ruling; Judge Jones asked both sides to submit additional arguments to clarify a few points. If only one of the actions Mr. Meadows is charged with was carried out\u2064 as a federal officer, would that be\u200c enough to remove the case? Both \u200cparties \u200cfiled their arguments by the end of Aug. 31, with the defense\u200c arguing that precedents have \u2062shown it \u200cis more than enough, and \u200cthe prosecution\u2062 arguing against \u2064it.<\/p>\n<div class=\"my-5\">\n<p>    \u2064The judge has yet to rule on Mr. Meadows&#8217;s case, but has scheduled \u200ca <a href=\"https:\/\/www.theepochtimes.com\/us\/federal-judge-orders-2nd-hearing-removing-georgia-election-case-5480826\" target=\"_blank\" rel=\"noopener\">second evidentiary hearing<\/a> \u200c regarding Mr. \u200bClark&#8217;s case removal for Sept. 18.\n  <\/div>\n<p>Ms. Willis&#8217;s office has until Sept.\u200d 8 to file a response to Mr.\u200d Clark&#8217;s case, after being given an extension \u2063from Sept. 5.<\/p>\n<p>Mr. \u2063Clark&#8217;s case\u2064 may prove to be more straightforward than Mr. Meadows&#8217;s; the indictment only references\u200c one act of Mr. Clark&#8217;s throughout the various acts and charges.<\/p>\n<p>While in office, Mr. Clark issued a\u200d Department \u200dof Justice statement that said\u200d the agency has &#8220;identified signifiant concerns that may \u2064have impacted the \u200doutcome of the election\u200c in multiple States, including the State of Georgia.&#8221;\u2064 He had other DOJ officials \u2062sign the statement, and\u200c had it \u2064delivered\u2062 to election\u2063 officials\u2063 in Georgia.<\/p>\n<p>All defendants were charged with racketeering under the state&#8217;s RICO, or Racketeer Influenced and Corrupt Organizations Act. \u200cMr. Clark was additionally charged with one count of criminal attempt to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-white-house-lawyer-warns-trump-should-not-hold-election-fraud-press-conference\/\" title=\"Ex-White House Lawyer Advises Against Trump's Election Fraud Press Conference.\">commit false \u2064statements<\/a> and writings, referencing that statement. Mr. Meadows \u2063was additionally charged\u200d with solicitation of violation of\u200c oath by public officer, referencing his arranging\u2063 a\u2062 call between President\u2063 Trump and Georgia Secretary of State Brad \u200cRaffensperger.<\/p>\n<div class=\"my-5\">\n<p>    The indictment also cites several of Mr. Meadows&#8217;s actions such as arranging and\u200d attending\u2062 meetings\u200c with or on \u200bbehalf of the president. The \u2064federal \u2062court is now in the\u200c process \u200dof ruling\u2063 these actions\u200c were taken by Mr. \u2063Meadows acting in his official capacity, and if \u200cthis \u2064is so in\u2063 only some\n  <\/p><\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>President Trump is seeking to transfer his case and that of 18 co-defendants from Fulton County to federal court.
