But now there is more evidence \u2014 or rather a lack of evidence \u2014 indicating the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-blocks-biden-administration-cdc-on-eviction-moratorium\/\" title=\"SCOTUS Blocks Biden Administration, CDC On Eviction Moratorium\">claimed authority<\/a> was\u200b always a charade.<\/p>\n<blockquote>\n<p>&#8220;The DOJ lives on paper.&#8221; Anything as important as granting Weiss ultimate authority over an investigation or\u200c promising to give him authority to bring charges in \u2063another venue, if necessary, &#8220;would have been written down,&#8221; \u200cHowell explained. To Howell, this last \u2064batch\u200b of documents constitutes an admission by Garland that &#8220;there was nothing written down at the DOJ \u200cand sent to Weiss, indicating Weiss had any of the authority that Garland claimed he did.&#8221;<\/p>\n<\/blockquote>\n<p>While the DOJ withheld some documents from the production, claiming \u2064various\u2064 exemptions from FOIA, it is difficult to fathom what FOIA exemption would permit the DOJ to withhold a communication granting Weiss the authority Garland publicly discussed on multiple occasions. When asked why Garland \u200bhad not memorialized his supposed grant of ultimate authority to Weiss, the DOJ did not respond to The Federalist\u2019s inquiry.<\/p>\n<p>The lack \u200cof any materials \u2064documenting such\u200c authority \u200draises more questions \u2064about \u200bthe\u2064 statements both Garland and Weiss made to\u2064 Congress. As far back as April 26, 2022,\u2064 the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-ag-barr-authorizes-federal-prosecutors-to-pursue-substantial-allegations-of-voting-irregularities-before-2020-election-is-certified\/\" title=\"BREAKING: AG Barr Authorizes Federal Prosecutors to Pursue \"Substantial Allegations\" of Voting Irregularities Before 2020 Election is Certified\">attorney general<\/a> \u2063 <a href=\"https:\/\/thefederalist.com\/2023\/06\/26\/irs-whistleblower-emails-suggest-david-weiss-misled-congress-in-letter-claiming-charging-authority\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> Tennessee Sen. Bill Hagerty that the &#8220;Hunter Biden\u2019s investigation \u2026 is being run by and supervised by the United States attorney\u2062 for the District of \u200bDelaware,&#8221; and that Weiss &#8220;is in charge of that investigation.&#8221;<\/p>\n<p>Then on March 1, 2023, Garland unequivocally\u2062 <a href=\"https:\/\/www.c-span.org\/video\/?526249-1\/justice-department-oversight-hearing\" target=\"_blank\" rel=\"noreferrer noopener\">testified<\/a> before the Senate Judiciary Committee, in response to questioning by Iowa \u200dSen. Chuck Grassley, \u200bthat &#8220;the U.S. attorney in Delaware has been advised that he has full authority\u2063 \u2026 to bring cases in other jurisdictions if he feels it\u2019s\u200c necessary.&#8221;<\/p>\n<p>Garland <a href=\"https:\/\/thefederalist.com\/2023\/06\/26\/irs-whistleblower-emails-suggest-david-weiss-misled-congress-in-letter-claiming-charging-authority\/\">maintained<\/a> that position even \u2064after IRS whistleblower Gary Shapley \u2064testified that during an Oct. 7, 2022, meeting, &#8220;Weiss stated that he is not the deciding person on whether charges are filed.&#8221; Specifically, after news broke of\u2062 the whistleblower\u2019s testimony, Garland <a href=\"https:\/\/nypost.com\/2023\/06\/23\/garland-denies-the-doj-is-corrupt-nothing-could-be-further-from-the-truth\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> during a press conference that Weiss was assured he could &#8220;make a decision to prosecute any way in which he wanted to \u200cand in any district in which he wanted to.&#8221;<\/p>\n<blockquote>\n<p>&#8220;I want to make clear that, as the Attorney General has stated, I have been <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/irs-whistleblower-emails-suggest-david-weiss-misled-congress-in-letter-claiming-charging-authority\/\" title=\"IRS whistleblower emails indicate that David Weiss may have deceived Congress in a letter where he asserted his charging authority.\">granted ultimate authority<\/a> over this matter, \u2064including responsibility for deciding where, when, and whether to file charges \u200cand\u200c for making decisions necessary to preserve the integrity of the prosecution, consistent with federal law, the Principles of\u2063 Federal Prosecution, and Departmental regulations.&#8221;<\/p>\n<\/blockquote>\n<p>After the transcript of Shapley\u2019s testimony was released, however, Weiss would walk back his claims by clarifying that \u200cwhat he\u200d meant was that Garland had promised \u2064him that\u2062 he <em>would <\/em>be granted ultimate authority to\u200d make charging decisions \u2014 not quite the same thing as <em>having<\/em> that ultimate authority.<\/p>\n<p>Either way, one\u200b would presume that if Garland had granted Weiss full authority over the Hunter Biden investigation and promised to authorize him to file charges in other venues, there\u2019d\u2064 be some documentation to back up the claim. But there was\u2064 none in the\u2063 FOIA production.<\/p>\n<p>Of course, \u200bafter the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-foia-turns-up-zilch-on-the-full-authority-garland-claims-he-gave-weiss-over-hunter-biden\/\" title=\"No Evidence Found: Garland's 'Full Authority' Claim Over Hunter Biden Disproved by FOIA.\">sweetheart plea deal \u2014 footsied<\/a> out between\u2063 one of Weiss\u2019s top assistant U.S. attorneys, Lesley Wolf, and Hunter\u2019s attorneys\u200b \u2014 imploded, Garland <a href=\"https:\/\/thefederalist.com\/2023\/08\/15\/6-takeaways-from-the-hunter-biden-special-counsel-appointment-you-wont-hear-from-big-media\/\" target=\"_blank\" rel=\"noreferrer noopener\">named<\/a> \u200b Weiss special counsel. So the federal prosecutor now has the \u200brequisite authority to\u200d charge the president\u2019s son in whatever district he\u2064 wants.<\/p>\n<p>But that belated appointment isn\u2019t a grant of absolution for misleading Congress, which is precisely what appears to have happened.
