Meanwhile, Hunter \u2064Biden\u2019s attorney told the same federal court his client continues to abide by the\u200c terms of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-department-charges-hunter-biden\/\" title=\"Justice Department charges Hunter Biden\">pretrial diversion agreement<\/a>, representing that agreement as a done deal and the gun case over.<\/p>\n<p>The dueling status reports filed late Wednesday follow presiding \u200bJudge Maryellen Noreika\u2019s order last week directing the parties\u200c to provide her with an update on the case following the\u2064 implosion of the plea agreement.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1441417896\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-1dfd14445ccea685ce2694b4865e6e91 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-1dfd14445ccea685ce2694b4865e6e91\"><\/div>\n<h3>Impasse and Venue Concerns<\/h3>\n<p>The plea deal between Delaware U.S. Attorney Weiss and \u2063Hunter Biden collapsed soon after the July 26, 2023, hearing at which Noreika questioned the parties on the \u2062interaction between the plea agreement\u200b on the two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-bidens-attorney-defends-plea-deal-says-investigation-was-thorough\/\" title=\"Hunter Biden's lawyer defends plea deal, claims investigation was comprehensive.\">misdemeanor tax counts<\/a> \u200dand a separate \u200dpretrial\u200b diversion agreement designed to resolve a\u2064 separate felony gun offense. The judge was \u200bparticularly concerned that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/6-takeaways-from-the-hunter-biden-special-counsel-appointment-you-wont-hear-from-big-media\/\" title=\"6 Key Points About Hunter Biden Special Counsel Appointment Ignored by Mainstream Media\">pretrial diversion agreement included<\/a> a \u2063<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/while-weiss-pinky-swears-hell-indict-soon-hunter-biden-claims-cushy-gun-deal-still-grants-immunity\/\" title=\"Weiss promises indictment soon, while Hunter Biden asserts immunity from cushy gun deal.\">provision\u2062 granting\u200b wide-ranging immunity<\/a> to Hunter Biden, far\u2062 beyond the \u2062gun charge, and ordered the parties to provide supplemental briefing on a variety of issues.<\/p>\n<p>After Noreika continued the hearing, according to documents filed by Weiss in federal court, the parties \u201creached an impasse,\u201d leaving the government to believe the case\u200d could not be resolved\u200d short of\u200d trial. Because \u201cvenue,\u201d meaning the proper location for \u200ca trial, for the tax cases did not lie in Delaware but\u2063 rather Washington, D.C., or\u2063 the central district of California, Weiss moved to dismiss those charges against Hunter Biden \u201cwithout prejudice,\u201d\u200d so he could\u2064 refile\u2063 them later in the \u200bproper jurisdiction. Weiss also \u2064sought and obtained special counsel status from Attorney General Merrick Garland \u2063and permission to file charges in other jurisdictions.<\/p>\n<p>Conversely, because Delaware was the proper venue for the gun charge, Weiss did not dismiss that charge. It remains pending before \u2062Judge Noreika, albeit on \u201cinformation\u201d \u200band not an indictment.<\/p>\n<p>While the federal government can charge a crime\u2064 by information with a defendant\u2019s consent, Hunter\u200b Biden\u2019s agreement to waive\u2064 his constitutional right to indictment by a grand \u200bjury was contained in the pretrial diversion agreement, and the government maintains that\u200c agreement is not valid. So if it\u2064 is not valid, as the government maintains, then neither\u2063 was Hunter\u2019s waiver. Accordingly, to prosecute Hunter Biden on the gun felony, Special Counsel Weiss\u200b must obtain a grand jury \u2063indictment\u200d against the president\u2019s \u200cson.<\/p>\n<div class=\"fdrlst__b89e9-d3fd9c6cc0cf804801e4c8bac26ffff4 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-d3fd9c6cc0cf804801e4c8bac26ffff4\"><\/div>\n<h3>Promise of Indictment<\/h3>\n<p>Late Wednesday, Weiss promised to do just that, writing in \u2062a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/us-judge-orders-that-dakota-access-oil-pipeline-can-remain-open\/\" title=\"US Judge Orders That Dakota Access Oil Pipeline Can Remain Open\">status report<\/a> to the court that \u201c[t]he Government intends\u200b to seek the \u2064return of an indictment\u201d by Sept. 29, 2023, which is when the indictment\u2063 must be returned to abide by\u2064 the Speedy Trial Act, a federal statute that requires\u200c the government to meet certain deadlines in prosecuting\u2064 a crime.<\/p>\n<p>In response to Noreika\u2019s order,\u2063 counsel for Hunter Biden also filed \u200da status report late Wednesday. The one-page status report filed on behalf of the president\u2019s son merely reiterated the defense\u2019s position that \u2064the \u2062parties had executed a diversion agreement to resolve the felony gun charge and that the agreement remains in effect.<\/p>\n<p>Whether\u200b the pretrial diversion agreement is valid and enforceable will be the ultimate issue in \u200cthis case \u2014 and possibly in other criminal cases Weiss seeks\u200b to bring against Hunter Biden \u200bgiven the breadth of the immunity provided.<\/p>\n<p>The government\u2064 maintains that because\u200d the\u2064 probation office \u201cdeclined\u200c to approve the proposed division agreement,\u201d the agreement was never executed. Conversely, \u200bHunter \u2064Biden maintains the agreement was executed when he and a representative for the Delaware U.S. attorney\u2019s office signed the diversion agreement.<\/p>\n<div class=\"fdrlst__b89e9-e7018516a3979224bc53fbb61190ee60 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-e7018516a3979224bc53fbb61190ee60\"><\/div>\n<h3>Judge&#8217;s Decision and Future Actions<\/h3>\n<p>There is no case law addressing\u2063 this scenario, however, because the federal\u200c government has never entered into an agreement remotely resembling the\u200b deal offered to Hunter Biden.\u200c Thus it will be for Judge Noreika to decide the\u200d question as an\u200c issue of first impression.<\/p>\n<p>But before she does, Special Counsel\u200d Weiss will need to obtain a grand jury indictment against\u200c Hunter \u200cBiden on the gun\u2064 charge.
