Both are seeking the presidential nomination \u200dof their respective parties for 2024.<\/p>\n<p>The expression\u200c \u201cTrump \u200cToo Small\u201d was inspired \u200dby a\u2062 crude joke that Sen. Marco Rubio (R-Fla.) made during the 2016 Republican presidential primary season. Mr. Rubio, then a presidential candidate, mocked\u00a0then-fellow candidate Trump by saying he had \u201csmall \u2063hands.\u201d<\/p>\n<p>\u201cHave\u2062 you seen his hands? And you know what they\u2062 say about men with small hands,\u201d Mr.\u200d Rubio\u2064 said\u2064 at the\u200b time.<\/p>\n<p>The \u201csmall hands\u201d quip was quickly seized upon by \u200dTrump critics and it became a viral meme online.<\/p>\n<p>Trademark officials rejected Mr. Elster\u2019s registration \u2063under the Lanham Act, finding that \u201cthe use of the name \u2018Trump\u2019\u200b in the proposed mark would be construed by \u2064the public as a reference\u2064 to Donald Trump.\u201d The official found\u200d that under\u200b the intellectual property statute, his office couldn\u2019t register trademarks that \u2062include\u2064 the \u2062name of a living person without that person\u2019s written consent.<\/p>\n<div class=\"my-5\">\n<p>Mr. Elster, on the other hand, claims his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/donald-trump-indicted-jack-smith-tests-limits-of-first-amendment-in-jan-6-prosecution\/\" title=\"Donald Trump indicted; First Amendment tested in Jan. 6 case by Jack Smith.\">free speech \u2064rights<\/a> were violated. An appeals court agreed\u200d with him, and the government appealed.<\/p>\n<h2>Federal \u2062Firearm Law<\/h2>\n<p>On \u2062Nov. 7, the court will hear United States v. Rahimi (court file 22-915), which concerns a federal law that\u200c bars \u200cpeople under <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-schedules-7-oral-arguments-including-domestic-abuser-gun-ban\/\" title=\"Supreme Court sets 7 hearings, including domestic abuser firearm ban.\">domestic violence-related restraining orders<\/a> from possessing firearms. The Biden administration supports the ban.<\/p>\n<\/p><\/div>\n<div style=\"margin-left:0;margin-right:0;max-width:1200px\">\n<figure style=\"width:640px;margin-left:auto;margin-right:auto\" class=\"alignnone\"><figcaption>Guns \u200don display in Burbank, Calif., on June 23, 2022. (Jae C.\u2062 Hong\/AP Photo)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>Zackey Rahimi, who previously \u2062entered a guilty plea to violating the statute, was involved\u2064 in five shooting incidents after a restraining\u200b order was entered against him in February 2020.<\/p>\n<p>Then, the Supreme Court handed down its landmark Bruen decision in June 2022, \u200dwhich declared a constitutional right to\u2064 bear arms in\u200d public \u200cplaces for self-defense. Mr. Rahimi asked the\u2063 courts to review his conviction given the change in\u2062 Second Amendment jurisprudence.<\/p>\n<div class=\"my-5\">\n<p>The \u2062U.S. Court of\u2063 Appeals for the 5th Circuit found that the law had\u2064 ceased to be constitutional in light of the Bruen\u2063 ruling. The ban on the possession of firearms by someone under a domestic restraining order \u201cis an\u200c outlier that our ancestors would never have \u200daccepted,\u201d the \u200dcircuit court stated in its ruling.<\/p>\n<h2>Social Media Blocking<\/h2>\n<p>On Oct. 31, the Supreme Court will hear O\u2019Connor-Ratcliff v.\u2063 Garnier (court\u2064 file 22-324) and \u2064a\u2063 related case, \u2063Lindke v.\u200b Freed (court file 22-611).<\/p>\n<\/p><\/div>\n<p>The issue is whether Americans can sue government officials who block them on social media, a controversy that \u2062arose during President Trump\u2019s time in office. The cases\u200d are \u200dlikely to have an impact on \u200call levels \u2062of government as citizens increasingly turn to social\u2062 media to interact with public officials.<\/p>\n<p>The Supreme Court is expected to decide whether a public official is engaging in state action subject to the\u2062 First Amendment to the \u2062U.S.\u200d Constitution when \u2063he blocks an individual from\u2064 accessing his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sickening-video-shows-antifa-allegedly-stab-4-trump-supporters-in-washington-dc\/\" title=\"Sickening Video Shows Antifa Allegedly Stab 4 Trump Supporters in Washington DC\">social media account<\/a>.<\/p>\n<div style=\"margin-left:0;margin-right:0;max-width:1200px\">\n<figure style=\"width:640px;margin-left:auto;margin-right:auto\" class=\"alignnone\"><figcaption>The icon \u200bof the mobile messaging service application WhatsApp (3rd row, 2nd column) is seen on the screen of a smartphone on May 26, 2021. (Sajjad Hussain\/AFP via\u2062 Getty\u200c Images)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>Katie Fallow, an attorney at the Knight First Amendment Institute at Columbia University, which participated in\u200b a lawsuit against \u200dPresident Trump, previously told \u2063NBC News \u200dthat government officials are required to accept feedback from the\u200d public.<\/p>\n<div class=\"my-5\">\n<p>\u201cAs\u200b many courts have held, it doesn\u2019t \u2062matter whether it\u2019s \u2063the \u2062president or a local city manager; government officials can\u2019t block people from\u2064 these forums simply because they don\u2019t like what they\u2019re saying,\u201d she \u2062said.<\/p>\n<h2>Veteran Education Benefits<\/h2>\n<p>On Nov. 8, the Supreme Court will hear Rudisill v. McDonough\u200d (court\u200c file 22-888), a case that could make 1.7 million post-9\/11 veterans eligible\u200c for\u2062 additional education benefits that could be \u2064worth billions of dollars.<\/p>\n<\/p><\/div>\n<p>The case is about whether a veteran\u2063 who qualifies for education benefits under multiple GI Bill programs is required to use up or abandon the benefits of one \u200bprogram in order to take \u2062advantage of benefits under \u2064another. \u2064The petitioner is FBI Special Agent James Rudisill, a decorated U.S. Army veteran.<\/p>\n<p>The case centers \u2064on the \u200cDepartment \u200bof Veterans Affairs\u2019s interpretation of administrative provisions of the Post-9\/11 Veterans Educational \u200dAssistance Act, also known \u200bas the Post-9\/11 GI \u2064Bill, which then-President George W. Bush signed into law in 2008.<\/p>\n<div class=\"my-5\">\n<p>The\u200c law \u200cwas enacted to provide enhanced educational benefits that were more generous than\u2064 the then-prevailing peacetime Montgomery GI Bill, a Korean\u200d War-era law that permits veterans to\u200b use benefits from any individual programs or a combination of them for up to\u200d 48 \u2063months. Congress approved the Post-9\/11 measure in recognition of the \u201cespecially arduous\u201d wartime service required\u200c of veterans since \u2064the \u2062Sept. 11, 2001, terrorist attacks, Mr. Rudisill\u2019s attorneys previously told The Epoch Times.<\/p>\n<h2>Property Seizures<\/h2>\n<p>On Oct. 30,\u2062 the Supreme Court will take up Culley v.
