min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>On Wednesday, \u200dJudge David Alan Ezra filed court documents \u200bordering the state of Texas to remove the bayous in Rio \u2062Grande that are \u2062meant to stop migrants from crossing the border illegally.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote data-service=\"twitter\" data-category=\"marketing\" data-placeholder-image=\"https:\/\/c3.oann.com\/wp-content\/plugins\/complianz-gdpr\/assets\/images\/placeholders\/twitter-minimal.jpg\" class=\"cmplz-placeholder-element twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BREAKING: A federal judge has ordered Gov \u2063Abbot \u200bto REMOVE the barrier in the \u2064Rio \u200bGrande, and has ENJOINED him from building any more. \u200bA win for DoJ. <a href=\"https:\/\/t.co\/3r6quIVJfH\">https:\/\/t.co\/3r6quIVJfH<\/a> <a href=\"https:\/\/t.co\/lt0jWdMGF9\">pic.twitter.com\/lt0jWdMGF9<\/a><\/p>\n<p>\u2014 Mueller,\u200c She Wrote (@MuellerSheWrote) <a href=\"https:\/\/twitter.com\/MuellerSheWrote\/status\/1699524271897468947?ref_src=twsrc%5Etfw\">September\u200b 6, 2023<\/a><\/p><\/blockquote>\n<p><script type=\"text\/plain\" data-service=\"twitter\" data-category=\"marketing\" async data-cmplz-src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script> <\/div>\n<\/figure>\n<p>The border\u200b barrier \u2063has been a controversial topic since they were placed as part of \u200bGovernor Greg Abbott\u2019s (R-Texas) border security\u2063 plans. <\/p>\n<p>The Justice Department claimed in the \u200blawsuit that Texas and Abbott \u2064violated the Rivers and Harbors Appropriation Act by constructing a structure in U.S. waters without permission from the U.S. Army Corps\u2062 of Engineers, and sought an injunction to prevent Texas from constructing \u2062additional barriers in the river. <\/p>\n<p>Meanwhile, the Republican \u2064governor has \u2062claimed that the buoys are intended to dissuade migrants from coming into\u200d the state from\u200b Mexico and has appealed the\u200d order.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThis ruling is incorrect\u200b and will be \u200coverturned \u2062on appeal. We will continue to utilize every strategy to secure the border, including \u2063deploying\u2062 Texas\u2064 National Guard\u200b soldiers\u200c and Department of Public Safety troopers and installing strategic barriers,\u201d Abbott\u2019s office said in\u200d a\u200d statement, \u2062adding that the \u2064state \u201cis prepared to take\u2064 this fight all \u2064the\u2064 way to the\u200c U.S. Supreme Court.\u201d<\/p>\n<\/blockquote>\n<p>The judge argued that Abbott needed permission to install the barriers, as \u200ddictated by law.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cGovernor\u2064 Abbott announced that\u200b he was\u2062 not \u2018asking for permission\u2019 for Operation Lone Star, the\u2062 anti-immigration \u2064program under which Texas constructed the floating barrier. Unfortunately for Texas, permission is exactly what federal law \u200drequires \u200bbefore installing obstructions\u2062 in the nation\u2019s navigable waters,\u201d the judge wrote in his ruling.<\/p>\n<\/blockquote>\n<p>Ezra also considered Texas\u2019 defense argument, saying that the barricades were erected in response to\u200c invasions.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThis argument fails because (1) the RHA has\u200d already\u2062 balanced policy interests \u200dand determined that the nation\u2019s interest in \u200cfree navigation of its waterways is supreme to \u200cunauthorized state action, and (2) whether \u2062Texas\u2019s claim of\u200d \u2018invasion\u2019 is legitimate is a non<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-orders-texas-to-remove-border-buoys\/\" title=\"Judge orders Texas to remove border buoys.\">-justiciable political\u2062 question demonstrably\u200d committed<\/a> to the federal political branches,\u201d \u200dhe wrote.<\/p>\n<\/blockquote>\n<p>The Justice Department filed \u200cthe complaint\u200b after Abbott stated that he would\u200b not order the removal of the floating obstacles from the Rio \u2063Grande,\u200b despite the department\u2019s request \u200da few days\u200d prior.<\/p>\n<p>Last month, Ezra heard\u2064 arguments \u200din the case, during which the Justice \u2064Department focused not\u200c only on its claim that the buoys violated federal\u2063 law, but also on the buoys\u2019\u2064 role \u2064in fraying relations \u200dwith Mexico,\u2063 which has expressed concern about the \u200c\u201cinhumane\u201d barriers and claimed that they \u2064are partially \u200con its territory.<\/p>\n<p>Meanwhile, Texas officials claimed that they had the constitutional authority to deploy the\u200c floating barriers.\u2064 <\/p>\n<p>Ezra \u200burged that the \u2064state\u2019s \u200cattorneys focus on the buoys rather than other matters, such\u2064 as fentanyl\u200d being transported into the U.S. and illegal immigration on\u200c the U.S. southern \u200bborder.<\/p>\n<p>Another lawsuit against the barriers had been \u2063filed in\u200c early July by the owner \u200bof a Texas canoe and kayaking company that operates on the Rio \u2063Grande.<\/p>\n<p>The judge has now ordered that Texas removes the barrier at their own \u200dexpense by September 15<sup>th<\/sup>.<\/p>\n<p>Stay informed!
